AN ORDINANCE GRANTING A ZONE CHANGE WITH RESPECT TO THE LANDS OF
` T a W Equipment Company, Incorporated, in Section 1, US, RIIV, p
!EIlamette Meridian, TIGARD WASHINGTON COUNTY, OREGON
WHEREAS, the hereinafter described lands, by action of the
City Council of the City of Tigard, Oregon, pursuant to the Zoning
Cade of said City, have heretofore been limited in the use to those
uees permitted by said Code, .under, and have been classified and
zoned for, and M-4, Industrial Park,
WHEREAS, pursuant to prescribed procedures, the owners of
said lands have applied to the City or Tigard for reclassification of
said property and change of zone thereof to permit the use thereof for p D,
Plastied Development purposes, and said application has been duly pub-
licized and Public hearing held by the City Planning Commission on
ARril 20s 1971 after due and legal notice, and
WHEREAS, the Planning Commission has recommended approval
of said zone change to the City Council, and due and legal notice of
City Council hearing having been givan by publication in the Tigard
Times, ind the City Council having heard same at its regular meeting
of 1n I and the Council finding that no public
detriment will result from granting of said petition, and that it is
in the public interest that said zone change be approved, and the
lands re-zoned from 1-4, Industrial Park.
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That the follow"ng described lands be, and the same are
hereby, zoned as P-D for use in accordance with the P-D,
Planned. Development classification of the Zoning Code of the City of
Tigard, which Zoning Code with respect to the P-D, Plafond Development
classification is by reference herein made a part hereof:
See attached description marked Exhibit "A".
Section 2: This ordinance shall be effective on the 31st day after
its enactment by the City Council of Tigard, Oregon.
PASSED: By unanimous vote of all Council members present, after
being read three times by number and title only,

Exhibit "A"
s A tract of land situated in the Southeast ane-quarter of the
Southeast one-quarter of Section 1, Township 2 South, Range 1
West of the Willamette Meridian in the County of Washington
and State of Oregon, more particularly described as follows:
Beginning at the northwest corner of said legal, stiction sub-
divisionx thence S. 2027120" W. along the west line of said
legal subdivision, a distance of 415.76 feet: thence 5.880
53100"E. parallel with the north line of said legal subdivision,
a distance of 698.22 feet to a point of intersection with the
j southwesterly right of way line of a Beaverton-Tigard Highway
as said Highway has been relocated in Suit No. 27-048, (final
Judgement entered December 30, 1965 in Washington County Circuit
Court); thence on the arc of a 702.96 foot radius curve to the
right and through a central angle of 8039'54", a distance of
106.11 feet (the chord bears N,45052'58"W. 106.01 feet) to a
point of curve to Spiral; thence along the arc of a spiral curve
to the right (which has a chord that bears Y.35003130"W. 222.38
} feet).an arc distance of 222.7 feet, more or less, to a point
of tangency, thence N.30030143"W. continuing along said right of
way line, a distance of 192.41 feet to a point in the north line
of the southeast one-quarter of the southeast one-quarter of
said Section 1, also being the south line of Varnes Acres, a
rftly_y recorded subdivision in Washington county; thence N,880531W.

beginning, containing 5.0 acres, more or less.
