ORDINANCE No. 71 - 17
AN ORDINANCE GRANTING A ZONE CHANGE WITH RESPECT TO THE LANDS OF
Garfield R. Hubble & Ardath Hubble in Section 10, T2S, RV,
WILLAMETTE MERIDIAN, TIGARD, WASHINGTON COUNTY, OREGON; PRESCRIBING
EFFECTIVE DATE ANL' DECLARING AN EMERGENCY.
WHEREAS, the hereinafter described lands, by action of the
City Council of the City of Tigard, Oregon, pursuant to the
Zoning Code of said City, have heretofore been limited in the use
to triose uses permitted by said Code, under, and have been clas-
sified and zoned for, an. R-7 - Single Family Residential.
WHEREAS, pursuant to prescribed procedures, the City of
Tigard has applied for reclassification of said property and
change of zone thereof to permit the use thereof for P-D,
Planned Development purposes, and said application has been duly
publicized and public hearing held by the City Planning Com-
mission on April 20, 1971 after due and legal notice, and
WHEREAS, the Planning Commission has recommended approval
of said zone change to the City Council, and due and legal notice
of City Council hearing having been given by publication in the
Tigard Times, and the City Council having heard same at its regular
meeting of May 10, 1971, and the Council finding that no public
detriment will result from granting of said petition, and that it
is in the public interest that said zone change be approved, and
the lands re-zoned from R-7, Single Family Residential to P-D,
Planned Development.
NOW, THEREFORE,
THE CITY OF TIGARD ORDAI"1S AS FOLLOWS:
Section 1: That the following described lands be, and the same are
herpbv. zoned as P-D for use in accordance with the
P-D, Planned Development classification of the Zoning Code of the
City of Tigard, whim Zoning Code with respect to the Planned
Development classification is by reference herein made a part
hereof:
See attached description marked Exhibit "A".
Section 2: Inasmach as it is necessary to preserve the integrity
of the zoning regulations of the hereinabove described
lands and to enable the developer thereof to pursue the orderly
development without financial or other hardship induced 'oy delay,
it is declared to be in the public interest and necessary for the
peace, health and safety of the people of the City of Tigard that
this ordinance become effective with the least possible delay, and,
therefore, an emergency is hereby declared to eiist and this
ordinance shall be effective upon its passage by the Council and
approval by the Mayor.

being read three times by number and title only,

EXHIBIT "A"
That portion of land in Section 20, Township 2 South, Range 1
West, Willamette Meridian, Washington County, Oregon, being masa
particularly described as follows,
~ ` Beginning at a point on the West boundary of the best Side Highway
which beginning point is North 89027' East 447.7 feet and North
13042, East 427.1 feet from an iron at the center of Section 10,
Township 2 South, Range 1 West, W.M., Washington County, Oregon;
thence South 89027' Nest 277 feet to an iron; thence North 0*051
West 651.5 feet to a point in the center of the &i11 Mountain
Road; thence along center of said road, North 78017' East 670.3
feet; thence South 31030' West 501.1 feet; thence South 26°51'
West 300 feet; thence South 21°391 West 100 feet; thence South
13°42+ West 192.6 feet to an iron at the place of beginning.
EXCEPT that portion of said land conveyed to the State of Oregon,
by Deed recorded June 21, 1962, its Book 334, Page 56, Deed Records
of Washington County, Oregon. Also EXCEPTING THEREFROM, that
portion of land lying within the right-of-gray of 60 feet gide
S.W. Bull Mountain Road.
