Ordinance No. 71-15 CITY OF TIGARD, OREGON ORDINANCE No. 71 - 15 AN ORDINANCE AUTHORIZING CONDITIONAL USE(S) ON LANDS OF DONALD E. POLLOCK & JULIA G. POLLOCK in Section 2, T•2S, R1W, W.M., TIGARD, WASHINGTON COUNTY, OREGON. WHEREAS, the owner(s) of the lands described on attached Exhibit "A" by reference made a part hereof, have filed with the City an application for authorization to conduct the following described conditional use(s) on the said premises= and WHEREAS, the zoning classification of said lands hereto- fore established by the zoning ordinances of the City of Tigard is .R-7 (Single Family Residential) and the conditional use(s) requested by the applicant(s) may be properly permitted in con- formity with the said classification; and WHEREAS, the City Planning Commission on the 15thday of December , 1970, held a public hearing with respect to, said application and said Commission has recommended to the City Council that said application be approved; and WHEREAS, a public hearing before the City Council with respect to said application was duly and regularly held on the 25th day of January , 1971, and continued to April 26, 1971, and the City Council finds that no public detriment will result from the granting of said petition and that it is in the public interest that said conditional use(s) be authorized. tTOW THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS. Section 1: That the following conditional use(s) as defined in the City of Tigard Zoning, Ordinance under the zone classification R-7 (Single Family Residential), to-wit: To allow a planned residential development of 35 single family dwellings. be and the same are hereby authorized with respect to the lands described on Exhibit "A" by reference made a part hereof, subject to compliance with the following conditions: 1. The total number of dwelling units shall be no more than 35 and shall be residentiAl in character and compatible to sur- rounding residential developments. 2. Thru-traffic within the development shall be one-way only, from Walnut Street to Fonner Street. 3. Streets nay be paved to a width of no less than 24 feet, with appropriate cutba to provide storm drainage--plans to be approved by City Staff--provided that parking shall be prohibited on such street and that each dwelling unit shall have a minimum of 2.5 parking stalls for its use (a total of xu 88 parking spaces). ORDINANCE No. 71 - 15 � h 4. Normal front, side and rear setbacks may be waived, provided that each: dwelling unit shall have at least one yard of 20 feet or more. 5. That the land may be subdivided in accordance with procedures established by the City's Subdivision ordinance. S. That the area designated as open space be dedicated to the City for park purposes with satisfactory guarantee of appropriate grading, seeding, and other planting as reviewed and approved by the Planning Department. 7. That all utilities shall be underground. 8. That final plans showing typical elevations, proposed land- scaping, walkways, street tree plantings, decorative lighting, park area, storm drainmge specifications, utility provisions, and off-street parking, shall be submitted for Planning Department approval prior to issuance of building permits. 0. That prior to tree cutting, excavation and building construc- tion, the Planning Department shall review and approve indi- vidual plot. and design plans to insure adequate open space, :.f tree conservation and housing privacy. 10. A storm water control basin shall be developed to alleviate potential flooding of downstream properties. Applicant shall also save the City harmless from liabilities arising as a result of the development of the proposed facilities. 13. Home owners association agreement shall be reviewed and approved by City Attorney before the issuance of building permits. Section 2: The City Recorder is hereby authorized and directed to A certify a true copy of this Ordinance and forward same { to the applicant forthwith.
