AN ORDINANCE RATIFYING, CORFIRMING AND RECORDING CHANGE IN
THE BOUNDARIES OF THE CITY OF TIGARD BY THE BOUNDARY CO3*11SSION,
ORDER NO. 172, INVOLVING LANDS OF Duane Company, in Section 36, �
TIS, R1W, W.M., WASHINGTON COUNTY, OREGON, RECORDING EFFECTIVE 'ATE',
AND DECLARING AN EMERGENCY y�
WHEREAS, the Boundary Commission established pursuant to
Chapter 494 Oregon Laws of 1969 for the Portland Metropolitan Area,
by its final order dated June 24, 1970, approved the hereinafter
described change in the boundaries of the City of Tigard, and a copy
of said final order has been filed with the City Recorder,
NOW, THERVORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 11: That the final order of the Boundary Commission adopted
on the 24th day of June, 1970, as filed with the City
Recorder on the 20th day of July, 1970, a copy whereof is hereto '
attached and by this reference made a part hereof, be, and the same
is, hereby ratified, confirmed and adopted by reference to the same
legal force and effect as if set forth herein in full.
Section 2: That the boundaries of the City of Tigard be, and they
are hereby, changed to include the lands as described
in the within order of the Boundary Commission, and the corporate
limits of the City of Tigard are hereby changed in conformity there-
with.
Sect on 3: That the Recorder of the City of Tigard be, and she is
hereby, directed to forthwith file a copy or this ordi-
nance, including a copy of said Order, in the following offices.-

(c) Department of :lecords and Elections, Washington County
(d) Department of Public Works, Attention: Surveyor,
Washington County
Section 4: That the City Planning Commission be, and it is hereby,
authorized and directed to conduct such proceedings as
may be necessary to conform the authorized zoning and land use of
the described premises to the requirements of the City's Zoning Alan
and Code.
Sect-on 5: Inasmuch as it is necessary for the peace, health and
safety of the people of the City of Tigard that the
foregoing change in the boundaries of the City become a permanent
part of the City's records, an emergency is hereby declared to exist,
and this ordinance shall be effective upon its passage by the Council,
and approval by the Mayor.
PASSED: By unanimous vote of all Council Members present, after
being read three times by number and title only, this

FINAL ORDER
RE: BOUNDARY CHANGE PROPOSAL NO. 172 Annexation of the follow-
ing territory to the City cf Tigard
Legal Description
That portion of land in Section 36, Township 1 South, Range
1 West, Willamette Meridian, Washington County, State of
Oregon, being more particularly described as follows:
Beginning at an iron pipe at the Southwest corner of Block
"A" of Metzger Acre Tracts, a duly recorded subdivision in
Washington County, Oregon; thence running North OOo 151
West, along the West line of said Block f1A", 131.94 feet to
the Northwest corner thereof, said Northwest corner also being
a point on the South right-of-way boundary line of
Cognty Road No. 929 (S, W. Spruce Street) ; thence South
89 521 West, along the South right-of-way boundary line of
County Road No. 929 (S. W. Spruce Street), 200 feet to a
point; thence running South OOo 151 East to a point of inter
section with the North line of the George Richardson D. L, C.
Aro 55, said D. L. C. North line also being the South boundary
of said Metzger Acre Tracts subdivision; thence South 890 001
East, along the South boundary of said Metzger Acre Tracts
Subdivision, a distance of 200 feet to the point of beginning
of this description.
WHEREAS, on May 29, 1970, the Commission received a petition from
a ,property owner requesting that the property described above be
annexed to the City;
WHEREAS, the petition meets the requirements for initiating boundary
change proposals in ORS 222.170 and paragraph (a) , Section (1) of
ORS 199.495;
WHEREAS, the Commission duly published notice of ;public hearing in
accordance with ORS 199.520 and conducted a public hearing on June 24,
1970, in accordancewith the rules of the Commission and paragraph (b) ,
Section (1) of ORS 199.475;
WHEREAS, the Commission caused a study to be made of this proposal
as provided in paragraph (a) , Section (1) of ORS 199.475;
WHEREAS, onthebasis of the study which considered economic, demo-
graphic, and sociological trends and physical development of the land,
and the public hearing, the Commission found that:
