CITY OF TIGARD, OREGON ORDINANCE No. 70-27 AN ORDINANCE PROVIDING FOR A SPECIAL ELECTION TO BR HELD IN THE CITY OF TIGARD, OREGON ON JULY 28, 1970 FOR TI3E PURPOSE OF SUBMITTING TO THE LEGAL VOTERS OF THE CITY THE QUESTION OF LEVYING TAXES FOR THE YEAR BEGINNING JULY 1, 1970 AND ENDING JUNE 30, 1971 FOR THE Mk!NTBNANCE AND OPERATION OF THE CITY, 1N THE SCSI OF $99,325. IN EXCESS OF THE TAX BASE, AND DECLHRING AN EMERGENCY WHEREAS, the Council of the City of Tigard has determined that sufficient funds to operate the essential functions of the City Of Tigard for the period July 1, 1970 to June 30, 1971 cannot be made available within the limits of the presently existing tax base of the City and, therefore, it is necessary to submit the following proposition to the voters of the City at a special election called and held for that purpose; and WHEREAS, of the total proposed genera]. fund tax levy for said period, $104,543. is within the limitation of Section 11, Article XI, Oregon Constitution, and the sum of $99,325, is in excess of said limitation, it is necessary to submit to the legal voters the question hereinafter set forth; and WHEREAS, the legal voters .rejected the proposed budget at a special election July 13, 1970 and the Council of the City of Tigard has determined that the proposal should be resubmitted to the voters; NOW, THEREFORE, THE. CITY OF TIGARD ORDAINS AS FOLLOWS: section 1: That a special election is hereby called to be held on Tuesday, July 28, 1970 between the hours of 8;00 a.m. and 8:00 p.m. at the designated polling place, Fowler Junior High School building, 12080 S. W. Main Street, Tigard, Oregon, for the purpose of submitting to the legal voters of the City the following proposition, for which purpose the following ballot title, number and form in which the question shall be printed upon the official ballot is prescribed: Submitted to the legal voters by ;he City Council: For the reason that the amount of taxes that can be levied by the Council of the City Of Tigard within the present tax blase of the City, computed in accordance with Section 11, Article XI, Oregon Constitution, is insufficien to cover the increased costs of personal services, materials and supplies for the maintenance and operation of the City during the fiscal year beginning July 1, 1970 and ending June 30, 1971, the .following proposition is referred to the legal voters: Marr X or in the square 0 site answer voted forty "Shall the City Of Tigard be authorized to levy for maintenance and operation of the City for the period beginning July 1, 1970 and ending June 30, 1971, the sum of $99,325. in excess of the tax base of the City, computed z in accordance with Section 11, Article Y>x, Oregon Constitution, involving a maximum rate of levy of $1.25 per $1,000. of true cash value of taxable property within the City, deemed necessary to raise said sum of $99,325.?" I vote in favor of the proposed levy YES 1 vote against the proposed levy NO Rection 2: In all respects the conduct of the election on the tax levy proposition shall conform to the procedures estab- lished pursuant to law for the conduct of the primary election, and the polls shall be opened at the same hour and closed at the same hour and all other applicable provisions in accordance with the election laws of the State of Oregon. Section 3: Notice of the City tax levy proposal, substantially in _` the form hereto attached, designated k,xhhibit "A" and by this reference made a part hereof, shall be given by publication in two issues of the Tigard Times, to-wit: on July 16 and July 23, 1970, and by posting to be accomplished not later than July 16, 1970, at each of the following places: 1. At the front door of the City Hall, exposed to public view, Main Street, Tigard, Oregon. 2. At the front door, exposed to public view, of the Fowler Junior High School, the designated polling place. 3. At the front door, exposed to public view, of the U. S. National Bank, Main Street, Tigard, Oregon. 4. At the front door, exposed to public view, of the Tigard Community Halt, Commercial Street, Tigard, Oregon. The City Recorder is directed to cause to have published and posted said notices and shall file in the records of said election an affidavit of posting in usual form. Section 4: The Council deems it unnecessary to furnish the legal voters of the City any election pamphlets or any materials setting forth the text of the proposition or arguments in support of or in opposition to the proposition. Sectionn55: The City Recorder be; and she is hereby, authorized and directed to cause to have prepared ballots in due and legal form as herein prescribed and to furnish to the election board a proper ballot box and all necessary election materials and to take any and all other and further actions that may be required to give effect to the provisions of this Ordinance and to incur reasonable and necessary expenses in connection therewith, chargeable to the general fund of the City. . ' Section 6: That Rogene Regeher, .Doris Cooper, Erma Butterfield, — Hazel Adams, Carolyn Kuhn, and virginia ,Dean are hereby designated as members of the Election Board, to serve as such in connection with the election hereby called to be held. Page 2 - Ordinance No. 70-27 section : Inasmuch as it is necessary for the preservation of the public peace, health and safety of the people of the City of Tigard that proper provision be made to provide funds for the operation and maintenance of tt- City through submitting the proposition hereinabove set forth the voters at the earliest passible date, an emergency is hereby declared to exist and this ordinance shall be effective upon its passage by the Council and approval by the Mayor. PASSED: By the Council, by unanimous vote of all Council members present, after being read three times by number and title only, this 14th day of July, 1970.
