AN ORDINANCE AUTHORIZING CONDITIONAL USE(S) ON LANDS OF Daniels,
Wiggins & Daniels, Contractors, in Section 2, T2S, R1W, W.M.
TIGARD. WASHINGTO14 rOLNTY, OREGON
WHEREAS, the owner(a) of the laaids described on attached
Exhibit "A" by reference made a part hereof, X11 (have) filed
with the City an application for authorization to conduct the
following described conditional uses) on the said premises; and
WHEREAS, the zoning classification of said lands hereto-
fore established by the zoning ordinances of the City of Tigard
is M-4 (Industrial Park) and the condi,.ional use
requested by the applicants) may be properly permitted in con-
formity with the said classification; and
WHEREAS, the City Planning Commission on the 19thday
of May 19 70, hc.ld a public hearing with respect
to rain application and said Commission has recommended to the
City Council that said application b3 approved; and
WHEREAS, a public hearing before the City Council wit"'
respect to said application was duly and regularly held on the
dtth day of June_ _, 19 70, and the City Council finds
that no public detriment will result from the granting of said
petition and that it is in the public interest that said condi-
tional use(s) be authorized,
NOW, THEREFORE,
THE CITY OF TIGARD "RDAINS AS FOLLOWS:
Section 1: That the following conditional use(s) as defined in
the City of Tigard Zoning Ordinance under the zone �
classification M-4 (Industrial Park) to-wit: f
General Contractor's Office and Warehouse
be and the same are hereby authorized with respect to the lands
described on Exhibit "A" by reference made a part hereof, subject
to compliance with the follotring conditions:
1. That the development must be in accordance with the u
set of plans submitted, but with the following addi-
tions, which must be made prior to the application
for a building permit:
a, the zoning ordinance requires that "all areas
used for the standing and maneuvering of vehicles
be improved according to the same specifications
as required for City streets"; this is to De
shown on the plans, with the exception that the
rear 71' of the property may be planted or im-
proved to lesser standards, such as with graven.
b', the ordinance also provides that approved outside
storage areas must be screened from view of all

adjacent properties by a sight-obscuring fence,
not less than six feet in height and/or by
sight-obscuring landscaping; this screening
must be detailed on the plans. No storage shall
be permitted above the height of the fence.
2. That this conditional. use shall expire in one year if

toward its commletIon is not in evidence.
section 2: The City Recorder is hereby authorized and directed
to certify a true copy of this Ordinance and forward
same to the applicant forthwith.
Section 3; This Ordinance shall be effective on and after the
31st day from its enactment by the City 0ouncil of
the City of Tigard, Oregon.

after being read three times by number and title

EXHIBIT "A"
. A portion of I,ot or Tract 5, B'URNRAM TRACTS, City
of Tigard, Washington County, Oregon, more particularly
described as follows:
Beginning at a point on the Northeasterly lime of
Lot 5, Burnham Tracts, South 450 46 ' East 189.4 feet from
the most Northerly corner thereof, said beginning point
being the most Easterly corner of that tract described in
that deed to William Henry Walker, et ux, recorded in Book
324, Page 501., Washington County Deed Records; thence South
420 06° West along the Southeasterly line of said Walker
tract a distance of 270 feet to a point on the Northeasterly
line of that tract described in that deed to the Tigard
Sanitary District recorded in Book 384, Page 359, Deed
Records, Washington County, Oregon; thence South 450 46'
East along the Northeasterly line of said Tigard Sanitary
District tract to a point on the Northwesterly line of a
16-foot strip described in Deed Book 151, mage 153, thence
Forth 420 05' East along the Northwesterly line of said 16-
foot strip to the most Southerly corner of that tract des-
cribed in that deed to Clarence M. Stupfel, et ux, recorded
in B00% 624, Page 385, Records of Washington County; thence
North 450 46" West a distance of 50 feet to the most Westerly
corner of said Stupfel tract.; thence North 420 05' East along
the Northwesterly 'Line of said Stup£el tract and its extension,
a distance of 130 feet to a point on the Northeasterly line of
Tit 5, Burnham"
