AN ORDINANCE PROVIDING FOR A SPECIAL CITY ELECTION TO BE HELD IN
THE CITY OF TIGARD, OREGON ON MAY 26, 1970, IN CONNECTION WITH THE
GENERAL STATE PRIMARY ELECTION, FOR THE PURPOSE OF SUBMITTING TO
THE LEGAL VOTERS OF THE CITY OF TIGARD, OREGON, THE QUESTION OF
ESTABLISHING A NEW TAX BASE PU11LOUANT TO SECTION 11, ARTICLE XI,
CONSTITUTION OF THE STATE OF OREGON.
WHEREAS, the Council of the City of Tigard has determined
that sufficient funds to properly operate the essential functions
of the City of Tigar-1 cannot be made available within the limits
of the presently existing tax base of the City and that there
should be submitted to the legal voters of the City the question
of establishing a new tax base in accordance with the provisions
of Section 11, Article XI, Oregon Constitution; and
WHEREAS, pursuant tr� Section 11, Article XI, Oregon Consti-
tution, it is necessary to submit such question of establishing
a new tax base to the legal voters of the City at the state-wide
primary election to be held on May 26, 1970;
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That it is necessary and in the best interests of the
people of the City of Tigard that there be submitted
to the legal voters of the City at the regular state-wide primary
election to be held and conducted at all voting precincts within
the City and throughout the state on May 26, 1970, and as a part
thereof, the proposition hereinafter stated in accordance with
Section 11, Article XI, Constitution of the State of Oregon.
Section 2: That there should be submitted to the legal voters of
the City of Tigard voting at each precinct, or part
thereof, within the City at the said primary election of May 25,
1970, the following proposition for which purpose the following
ballot title, number and form in which the question shall be prin-
ted upon the official ballot is prescribed:
Submitted to the legal voters b the City Council
For the reason that the amount of taxes that may
may be levied by the Council of the City of Tigard
within the present Gnus Lase of the CJ*Ly deter-
mined. by Section 11, Article XI, Constitution
of Oregon, is insufficient to cover the increased
costs of personal services, maintenance and oper-
ation of essential city functions, the following
proposition is referred to the legal voters:

Section 3: That the foregoing proposition shall be submitted to
thelegal voters of the City of Tigard by separate
ballot at each precinct, or part thereof, in the City of Tigard,
at said primary election of May 26, 1970, and the said election
with respect to said proposition,shall be conducted by the regu-
lar election boards_designated to conduct the regular state-wide

primary election in said precincts on May 26, 1970. Such election
boards regularly designated to conduct said primary election are
hereby designated as the election boards to conduct the election
with respect to the foregoing tax base proposal.
Section 4: In all respects the conduct of the election on the
tax base proposition shall conform to the procedures
established pursuant to law for the conduct of the primary election
in said precincts and the polls shall be opened at the same hour
and closed at the same hour and all other applicable provisions in
accordance with the elections laws of the State of Oregon.
Section 5: Notice of the City tax base proposal in form substan-
tially as he>einafter set forth shall be given by three
weekly publications in the Tigard Times on May 7, May 14, and May
21, 1970 and by posting notice substantially in the following form;
the following designated places, such posting to be accomplished not
later than May 8, 1970:
(a) At the frons door of the City Hall exposed to
public view, Main Street, Tigard, Oregon.
(b) In one public place in each voting precinct, or
part thereof, within the City.
The City Recorder is directed to cause to have published and posted
said notices and shall file in the records of said Flection an
affidavit of posting in usual form prior to May i3, 1970.

AT PRIMARY ELECTION OF MAY 26, 1970
Notice is hereby given that pursuant to Ordin
ince No. 70-12 enacted by the Cit_V Council of Tigard
onAril 27 1970, at the state-
wide primary election of May 26,1970, between the
hours of 8:00 o'clock A. M. and 8:00 o'clock P.M. at
each precinct within the City of Tigard, there will be
submitted to the legal voters of the City of Tigard
for their approval or rejection the following proposition:
For the reason: that the amount of taxes that
may be levied by the Council of the City of Tigard
within the present tax base of the City determined
by Section ll, Article XI, Constitution of Oregon, is
insufficient to cover the increased costs of personal
services, maintenance and operation of essential cite
functions, the following proposition is referred to
the legal voters:
Mark X or V in the square opposite answer voted for:

The foregoing proposition, if adopted, will establish
a new tax base for the City of Tigard pursuant to Section
11, Article XI, Oregon Constitution. The polling places
in the City of Tigard for the purpose of submitting,the
foregoing proposition will be the same as those designated
for the state-wide primary election of May 26, 1970, and

the election will be conducted in all respects by the
same election boards as designated and appointed for
the state-wide primary election.

Section 6: That the Council of the City of Tigard deems it unneces-
sary for the City of Tigard, or any officer thereof,
to furnish the legal voters of the city any tax base election pam-
phlets containing the text of the proposition or arguments in support
- of or in opposition to the proposition.
Section 7: The City Recorder be and she is hereby authorized and
directed to furnish to the Department of Records and
Election of Washington County, Oregon, and to the extent required
by tba.,Director of Records and Elections, Washington County, Oregon,
furnished to the election boards of each precinct of the City ballots,
ballot boxes and all necessavy election materials and to te.ke any
and all other and further actions as may be required to give effect
to the provisions of this ordinance.
Section_ 8: It is necessary for the preservation of the public peace,
health and safety of the people of the City of. Tigard
this ordinance to take effect immediately in order that the tax
base proposal may be properly submitted to the people of the City
of Tigard at the state-wide primary election of May 26, 1970, and
an emergency is hereby declared to exist and this ordinance shall
be effective upon its passage by the Council and signature by the
Mayor.
