Ordinance No. 70-09 CITY OF TIGARD, OREGON ORDINANCE No-70- Ali ORDINANCE AMENDING AND SUPPLE;11"NTING Chapter VIII (Parkin; Regulations) of Ordinance No.66-20 "MOTOR VEHICLE, CODE OF THE CITY OF TIGARD",, RLPEALING ORDINANCES Nos. 66-21, 66-29, 67-25, 6`,-41, 67-74 and 68-9;, AND PRESCRIBING EFFECTIVE ;CATS. THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: That Chapter VIII (Parking Regulations) of Ordinance No.66-20 "MOTOR VLFICLE CODE OF THE CITY OF TIGARD", as heretofore amended and supplemented, be, and the same is hereby, amended and zupplemented to read as follows: CHAPTER VIII FARMING REGULATIONS: :vection 1: Definitions: "Parking" - The term 'parking" or "parked" for purposes of' the Motor Vehicle Code of the City of Tigard, shall mean the stooping or standing of any vehicle upon any street or highway within the City, whether such vehicle is occupied or not, otherwise than temporarily for the purpose of and while actually en- gaged in loading; or unloading passengers or freight, or in obedience to traffic regula- tions or traffic signs or signals. "Parking Time Limit" -• It shall be unlawful for any per- son to park or stop any vehicle for a longer period of time than that designated by official signs, parking meters or other mark- ings placed by or under authority of the City of Tigard. Such parkin, tine limit shall in- clude the aggregate of time of all stopping or standing of the sa;ae vehicle or, the same side of the street within a space of ;00 lineal feet measured along the curb line and between intersections, and the parking, stand- ing or stopping of any vehicle within such expanse shall not exceed the designated time limit during any three-hour period. "Truck trailer," )- E Section 2: No person shall park a vehicle on the ri^:ht-of-way of any highway, or upon any public street or pub- lie way wiuhin the corporate limits of the City of Tigard for any of the f ollowin purposes: ` (a) Advertising, selling or offerinr; mcccIandlse .for sale (b) Displaying such vehicle for sale (c) :Dashing, greasing or repairing such vehicle except as may be necessitated by emergency (d) Displayiag advertising upon such vehicle (e) Storage, junk or dead storage :for any period of more than 48 hours, except that this sub-section shall be subject to the limits elsewhere pre- scribed In the PRotor Vehicle Core of the City of Tigard or as may be prescribed by the Oregon State Motor Vehicle Code. Section .3: No person shall at any time park or leave standing a house trailer, motor bus, motor truck, tractor trailer, truck_ tractor or truck trailer, as hereinabove defined., whether attended or unattended, on any improved public highway, public street or other public way within the corporate limits of the City of Tigard, for a period greater than thirty (30) minutes, between the hours of 12:01 o'clock a.m. and 6:00 o'clock aim. Section 4: Whenever the owner or driver of a vehicle discovers that such vehicle is parked immediately in front of or close to a building to :which the fire department has been summoned, he shall immediately remove such vehicle from the area � unless otherwise directed by police or fire officers. Section 5: No person having control or charge of a rotor vehicle shall allow it to stand on any street unattended without first fully setting its parking brakes, stopping its wtor and removing the ignition key, and, when standing upon any precipitous grade, the front wheels of the vehicle shall be angled. into the curb. Page 2 - ORDINANCE NO.701-• Section_ 6: No person shall stand or park a vehicle in a street other than parallel with the edge of the roadway, headed in the direction of lawful traffic movement, and with the curbside wheels of the vehicle within 18 inches of the edge of the curb, except where the street is marked or signed for angle parking. Section 7: Where parking space markings are placed on a street, no person shall stand or park a vehicle other than at the indicated direction and within a single marked space. Section 8: All parking of .aotor vehicles on that portion of S. V. Iain Street between the intersection thereof With S. W. Burnham Avenue and the Orei;on Electric Railroad right-of•-way shall be parallel with the centerline of S. t:'.Dlain Street, and all diagonal or "head-in" parking is hereby prohibited. r.< Section 9: No person shall park or leave standing a vehicle of any kind or character, whether rotorized or not, continuously in excess of two (2) hours, except on Sundays and holidays, on the following public streets and highways, or Portions thereof, during the hours herein specifically designated: (a) Between 8:00 a.m. and 5:00 p.m. 1. On that portion of the West half of S.W.Hall ,< Blvd. from a point 125 feet Southerly of the inter- section of the West right-of-way line of S. W. hall Blvd. with the South right-of-way line of S. W. Pacific High- way (99-W, to an extension of the South boundary line of Tax Lot 490 (Bissett residence). 2. On the Easterly side of S. tv,. Hall Blvd- from the Southerlymost access driveway of Knauss Chevrolet Company appurtenant to Lot 5, Tigard Road Gardens, Wash- ington County, Oregon, to the extension of the South boundary of said Lot �5` (b) Between 9:00 a.m. and 6:00 p.m. t} I. On S. W. Main Street Section 10: NO person shall park or leave standix.r a motor vehicle of any kind or character, whether motorized or not, and whether attended or unatterder., between the hours- of ' 8:00 a.m. and 2:00 p•ru., inclusive; each day except Sundays and holidays, for a continuous period of longer than fifteen (15) r� minutes 1. Within the Northeasterly half of S.a.Burnham Street from a point 15 feet Southeasterly of the Intersection of the northeasterly line of 5 W.Burnha_m Street with the Southeasterly line of S.W.Main Street, and extending" Southeasterly to a point forty-five (45) feet from said intersection. Section 11: No person shall park or leave standing a mcto.r vehicle of any kind or character, between the hours of 8:00 a.m. and 6:00 p.m., each day except Suxrdays and hollna.y-,, for 9--continuous period of more than twenty (20) minutes: 1. Section 12: No person shall park or leave standing a vehicle of any kind or character, whether motori-,ed or not, continuously in excess of fiftFen (15) minutes, except on Sun- days and holidays: 1. On the Southeasterly side ctf S.W.Main Sheet within that certain parking; space located immediately in front of the City Ball and marked for use as a loading zone, for ,ihich purpose said parking space is hereby so designated. Section 13: No person shall park a motor vehicle of any land or character between the hours of 6:00 a.m. aru, 12:00 noon, on Sundays, according to Pacific: Sti.ndc-d Time or Pacific Daylight Time as may be then in effect, ox, the follow- ing defined portions of public streets in the Ci`v of Tigard: 1. The Westerly side of S. W. Grant Street extending from the intersection there of with S.W. Johnson Street to the intersection thereof with S. W. Walnut Avenue. 2. The Southerly side of S. W. 14cKenzle Street extendir_g from the intersection thereof w1 th S.W. Grant Street to the intersection tLereof with S. W. Pacific Highway (99-W)• Section III: NO PARKING: No person shall at any tine park or leave standing a vehicle,of 'a.ny kind-15F character, whether motorized or not, and whether attended or unat:;ended, within the following defined po,:t4ons of oublic streets and highways within the City of Tigard: 1. Within the improved portion of tine right-of way as bounded by the curb lines, on each side of S. W. Pacific Highway (99-W), extending from the intersection of the centerline of S�W-3ull nit, Road and the same extended to the Southeasterly right-of- way line of S. W. Pacific Highway, Northeasterly to the Northeasterly corporate limit-, of the City of Tigard, being an extension of the Easterly line of that tract of land deeded to Max R. Peed and recorded in Book 611, page 286, Deed Records, Washington County, Oregon. 2. Within that portion of the Last Ralf of the right-of-way of S. W. Hall Blvd. between the inter- section of the Southerly right-of-way line of S.W. Pacific Highway (99-W) with the Easterly right-of-way line of S. W. Hall Blvd and the most Southerly access driveway of Knauss Chevrolet Company appurtenant to Lot 5, Tigard Road Gardens, Washington County, Oregon. 3. Within the East half of the right--of-way of S. W. hall Blvd., within 1135 feet Northerly of the intersection of the East right-of--way line of S. W. Pacific Highway (99--W). 6. On the Southeasterly side of S. W. Main Street within. fourteen (14) feet Northeasterly of the inter- section thereof with S. Td. Janoe and Emma Janoe to Tigard Rural Fire protection District as described in deeds of record in :took: 571 page 290 and Book 571 page 289, Deed Records of Wash- ington County, Oregon, upon which premises is now located the Tigard Fire Station of the Tualatin Rural Fire Protection District. s 9. The date, place and nature of the charge b. The time and place for defendantls appearance in courtU. c. The name of the arresting; officer. d. The license number of the vehicle. (2) The notice provided for in subsection (1) of this section shall either be delivered to the defendant or placed in a conspicuous place upon the vehicle involved in the viola- tion. The notice shall serve as the complaint in the case. Inall other respects the procedure now provided by law in such casev shall be followed: Section 16: PENALTIES: Any violation of the provisions of any section of Chapter VIII or any rule or regula- tion therein stated, shall, upon conviction, be puni-shable by a fine of riot more than $1100. for each violation.
