AN ORDINANCE PROPOSING THE WITHDRAWAL OF ANNEXED AREA WITHIN
THE CORPORATE LIMITS OF THE CITY OF TIGARD FROM COTTONWOOD PLACE_
LIGHTING DISTRICT; SETTING A DATE, TIME AND PL_CE 0, H NG

GIVEN BY PUBLICATION AND POSTING; RESERVING TO COUNCIL DETERMINA-
TION OF RE"OT-UTION TO BOUNDARY COMMISSION AND DECLARING AN EMERGENCY
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: The Council of the City of Tigard finds that those certain
lands described in the attached Exhibit "A" - Description,
by this reference made a part hereof, were regularly annexed to the

Section 2: The Council further finds that said landG prior to said
annexation were included within Cottonwood Place Lighting
District and said lands have not heretofore been withdrawn therefrom.

of whether withdrawan of said lands from Cottonwood Place Lighting
District is in the best interests of the City.
Section 4: Pursuant to the authority conferred uponthe City Council
by Sec. 222.520 and 222.524 O.R.S. , a public hearing is
hereby called to be held at Fowler Jr. High School,b ithinnthe City
the
of Tigard, on Monday, the 13th day of April,
1-70, whereat the
hour of 8:00 p.m. Pacific standard Time of said day,
City Council will hear objections to the withdrawal of the lands de-
scribed in Exhibit "A" from the Cottonwood Pla^.e Lighting District,
and the Council will thereafter determine whether said withdrawal
is in the best J--iterests of the City of Tigard.

(a) Publish notice thereof once each week for two suc-
cessive weeks, for three publishings in all, prior
to the date of hearing in the Tigard Times, a news-
paper of general circulation within the City.
(b) Post notice of said hearing in not less than four (4)
public and conspicuous places in the City for a like
period of not less than 14 calendar days prior to the
day set for said hearing.
(c) All notices as herein provided shall state the time,
date, place and purpose of said. hearing.

Section 6: Inasmuch as it is necessary for the peace, health and
safety of the people of the City of Tigard and of the
Ar
Cottonwood Place Lighting District that the question of whether the
withdrawal of territory as herein described be determined with the
least possible delay to enable compliance with constitutional and
statutory budgetary procedures, an emergency is hereby declared, and
this ordinance shall be effective inunediately upon its passage by
the Council and approval by the mayor.
PASSED: By tuianimous vote of all Council membera present after
being read three times by number and title only,

EXHIBIT "A"
PARCEL I That portion of land in Sections 2 and 3, Township 2 South, Range
1 West, Willamette Meridian, Washington County, Oregon, being
more particularly described as follows:
Beginning at the initial point of Cottonwood Place, a duly
recorded subdivision in said County; running thence North 140 55'
East 160.0 feet to the Northeast corner of Lot 3 of said subdivision;
thence South 750 05' East 190.89 feet to the Southeast corner Cf
Lot 16 of said subdivision; thence South 190 20' West 185.57 feet
to a point on the centerline of County Road No. 494 (S- W. Walnut
Street) , thence North 750 05' West along the centerline of said
County Road 176.61 feet to a point; thence North 140 55' East 25.0
feet to the point of beginning of this description - excepting that
portion lying within the public right-of-way.

Willamette Meridian, Washington County, Oregon, being more particu-
