ORDINANCE No. 70-1
AN ORDINANCE: RATIFYING, CONFIRMING AND RECORDING CHANGE IN
' THE BOUNDARIES OF THE CITY OF TIGARD BY THE BOUNDARY COMMISSION, ORDER NO.61,
INVOLVING LANDS OF Lester G. Mock and Betty Jean mock
IN Section 35, Tis, RIW, W.1-1, WASHINGTON COUNTY, OREGON,
RECORDING EFFECTIVE DATE, AND DEQLARING AN EMERGENCY.
WHEREAS; the Boundary Commission established pursuant to
Chapter 494 Oregon Laws of 1969 for the Portland Metropolitan Area,
by its final order dated December 17, 1969 approved the herein-
after described change in the boundaries of the City of Tigard, and
a copy of said final order has been filed with the City Recorder,
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That the final order of the Boundary Commission adopted
on the 17 day of December , 1969 , as filed with the
City Recorder on the day of Januar , 1970, a copy whereof is
hereto attached and by this reference made a part hereof, be, and
the same is hereby ratified, confirmed and adopted by reference to
the same legal force and effect as if set forth herein in full.
Section 2: That the boundaries of the City of Tigard be, and they
are hereby, changed to (inci�uQe; the lands as described
in the within order of the Boundary Commission, and the corporate
limits of the City of Tigard are hereby changed in conformity there-
with.
Section 3: That the Recorder of the City of Tigard be, and she is
hereby,direeted to forthwith file a copy of this ordi-
nance, including a'copy of said Order, in the fallowing offices:
(a) Secretary of State Washington County
(b) Department of Revenue and Taxation,
(c) Department of Records and elections, Washington County
(d) Department of Public Works, Attention: Surveyor,
Washington_ County
Section J4: That the City Planning Commission be, and it is hereby,
authorized and directed to conduct such proceedings as
may be necessary to conform the authorized zoning and land use of
the described premises to the requirements of the City's Zoning Map
and Code.
Section 5: Inasmuch as it is necessary for the peace, health and
safety of the people of the City of Tigard that the
foregoing change in the boundaries of the City become a permanent
part of the City's records, an emergency is hereby declared to exist,
and this ordinance shall be effective upon its passage by the Council,
and approval by the Mayor.
PASSED: By unanimous vote of all Council Members present, after

Rea BOUNDARY CHANGE PROPOSAL NO. 61 - Annexation of the following
territory to the City of Tigard,
Legal Description
That portion of land in Section 35, Township 1 South, Range 1 West,
Willamette Meridian, Washington County, Oregon, being more part-
icularly described as follows:
Beginning at a stake on the South line of the North one-half of
the John L. Hicklin D.L.C. in Section 34, Township 1 South, Range
1 West, W. M. Washington County, Oregon, said stake bears East 1959.21
feet from the Southwest corner of the said North one-half of the said
Hicklin Donation Land Claim; Thence running Nerth 00 12' West 995.3
feet to a point which lies on North line of the South one-half of
the said North one-half of the said Hicklin zonation Land Claim, said
point also being a point on the center line of County Road #916 (S.W.
Tigard Street); thence, South 890 45' East 1121.2 feet along the center
line of County Road #916 to an iron pipe, said iron pipe being the true
point of beginning of this description; thence, running South 20 feet
to an iron pipe; thence, South 31.1 feet to an iron pipe; thence, South
340 0, West 173.8 feet along the Northwesterly boundary line of County
F Road #179 (S, W. Tiedeman Avenue) to an iron pipe; thence, :forth 660
44' West 192.4 feet to an iron pipe; thence, continuing North 660 44,
West 20 feet to a point on the centerline of Fanno Creek; thence,
Northerly along the centerline of Fanno Creek to a point of intersection
with the Southerly boundary line of said County Road #916; thence,
continuing Northerly along the centerline of Fanno Creek to a point
of intersection with the centerline of said County Road #916; thence,
South 890 45' East along the centerline of said County Road #916 to the
true point of beginning of thie description. Containing 0,94 Acres.
r WHEREAS, on November 3, 1969, the Commission received a petition from property
owners requesting that the property described above be annexed to the city;
1 REAS, the petition sheets the requirements for initiating bound change
prop sale set forth in ORS 222.170 and paragraph (a), subsection (1),
Section 16a of Chapter 494 Oregon Lags 1969;
WHEREAS, the Commission duly published notice of public hearing in accord-
ance with Chapter 494 Oregon Laws 1969, Section 20 and conducted a public
i hear--irk or, Decee:ber 17, 2969 in accordance with the rules of the Commission
and Chapter 494 Oregon Laws 1969, Section 13 (1); and
QpWHEREAS, the Commissions caused a study to be aide of this proposal as provided
in paragraph (a), Subsection (1) Section 13 of Chapter 494 Oregon Laws 1969;

WHEREAS, on the baths of the study, which considered econimi,c, demographic,
and sociological trends and physical development of the land; and the public
hearing, the Commission found that:
a) the territory to be annexed is contiguous to the city;
b) the territory to be annexed contains appr cx:ma tely one acre and.
is occupied by a single family residence;
c) the property owner requires city services;
d) the city is able to provide needed municipal services; and
e) the boundary change would not adversely affect any other unit
of government.
WHEREAS, on the basis of the findings, the Commission approved B0TMAR
CHANGE PROPOSAL NO. 61 on December 17, 1969;
NOW THEREFOR; IT IS ORDERED that the territory described above be sexed
