ORDINANCE NO. 69- 7
AN ORDINANCE REDEFINING THE MEMBERSHIP, POWERS AND DUTIES
OF THE CITY PLANNING COMMISSION, REPEALING THOSE PORTIONS OF
ORDINANCE NO. 63-8 NOT HERETOFORE REPEALED, AND DECLARING AN
EMERGENCY.
WHEREAS, The Planning Commission of the City of Tigard
heretofore has included in its membership the Mayor, City
Attorney, City Engineer and seven (7) other members, as consti-
tuted under authority of Ordinance No. 63-8enacted by the City
Council on June 24, 1963; '
WHEREAS, Section 227.030 ORS, as amended by Chapter 430,
Oregon Laws of 1969, has redefined the membership structure of
a city's planing commission and certain powers thereof;
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: Sections 1, 2, 3, 4 of Ordinance No. 63-8, enacted by
tie City Council on June 24, 1963, being all the remaining sections
of said Ordinance not heretofore repealed, be and the same are
hereby repealed effective with the effective date of this Ordinance.
Section 2: The City Planning Commission of Tigard, Oregon shall
henceforth consist of nine (9) members to be appointed
by the Mayor and 3onPirmed by the Council, not more than two (2)
of whom shall be nonresidents of the City. Commission memtiers
shall va ceive no compensation but shall be reimbursed for duly
authorized expenses.
Not more than two (2) members of the Commission may
be city officers who, if appointed by the Mayor, shall serve as
ex officio nonvoting members.
Section 3: The City Planning Commission of Tigard, at its first
meeting in each odd-numbered calendar year, shall elect a president
and a vice president, who shall hold office during the pleasure of
the Commission; and the Commission shall elect a secretary, who need
not be a member of the Co=nission, and the secretary shall keep
accurate records of all Commission proceedings. The Commission
shall, as of the first day of October of each year, make and file
a resort of its transactions with the City Council.
Section 4: At the first regular meeting of the Commission, after
the effective date of this Ordinance, and after all nine
(9) memberships of the Commission have been filled, and in no event
later than the first regular meeting of the Commission in January,
1970, the nine (9) members of the Commission shall, as reconstituted,
choose the terms of the office by lot, as follows:

2 for a term of 1 year
2 for a term of 2 years
2 for a term of 3 years
3 for a term of 4 years
( Immediately thereafter, the President of the Commission
shall notify the Mayor and Council, in writing, of the allotted term
of office. Each successor to the members whose terms are thus allotted
shall serve a term of four years; any vacancy shall be filled by the
Mayor for the unexpired portion of the term.
Section 5: Five (5) voting members of the Commission shall consti-
tute a quorum. The Commission may mate and alter rules
and regulations for its government and procedure consistent with the
laws of the State of Oregon, the City Charter and the City's Ordi-
nances. The Commission shall meet at least once a month.
The City Council does hereby assign to the Commission
the use of the City Hall of the City of Tigard in which to hold its
meetings, transact its business and 'keep its records.
Section 6- The commission may employ consulting advice on municipal
problems, a secretary and such clerks as may be neces-
sary and pay for their services, and for such other expenses as the
commission may lawfully incur, including the necessary disbursements
incurred by its members in the performance of their duties as members
of the comm).ission, out of funds at the disposal of the commission_,
as authorized by the City Council.
Section--7: In addition to the foregoing powers, and except as
otherwise provided by law, the Commission shall be vested
with all powers and duties and procedures, as set forth in Chapter
227 ORS, as now in effect or hereafter amended, and particularly those
set forth in Section 227.090 ORS.
Section 3: Inasmuch as it 1 necessary for the public health, peace
and safety of the people of the City of Tigard Chet the
City Planning Commission and its membership be reconstituted in
accordance with Chapter 430 Oregon Laws of 1969 with the least pos-
sible delay, an emergency is hereby declared to exist and this
Ordinance shall be in full force and effect immediately upon it;
passage by the City Council and signature of the Mayor.
PASSED: By unanimous vote of the Council members present after
being read three times by title only, this �_ day of
