AN ORDINANCE RATIFYING, CONFIRMING AND RECORDING CHANGE IN
THE BOUNDARIES OFF THE CITY OF TIGARD BY THE BOUNDARY COMMISSION,
INVOLVING LANDS OF George Anderson and Ruth Anderson
IN Section 2, T2S, R11,7, W.M. WASHINGTON COUNTY, OREGON,
RECORDING EFFECTIVE DATE AND DECLARING AN EMERGENCY.
WHEREAS, the Boundary Commission established pursuant to
Chapter 491 Oregon Laws of 1969 for the Portland Metropolitan Area,
by its final order dated September 10, 1969 approved the herein-
after described change id Ehe boundaries of he City of Tigard, and
a copy of said final order has been filed with the City Recorder,
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That the final order of ttie Boundary Commission adopted
on the 10 day of �S�e�te__n�iber , 19 69, as filed with the
City Recorder on the day of se tender , �

the same is hereby ratified, confirmed and adopted by reference to
the sam* legal force and effect as if set forth herein in full.
Sention 2: That the boundaries of the City of Tigard be, and they
are hereby, Changed to (inch the lands as described
in the within order of the Boundary Commission, and the corporate
limits of the City of Tigard are hereby changed in conformity there-
with.
Section 3: That the Recorder of the City of Tigard be, and she is
hereby,directed to forthwith file a copy of this ordi-
nance, including a copy of said Order, in the following offices:
(a) Secretary of State
(b) Department of Revenue and Taxation, Washington County
(c) Department of Records and Elections, Washington County
(d) Department of Public Works, Attention: Surveyor,
Washington County
Section 4: That the City Planning Commission be, and it is hereby,
authorized and directed to conduct such proceedings as
may be necessary to conform the authorized zoning and land use of
the described premises to the requirements of the City's Zoning Map
and Code.
Section Inasmuch as it is necessary for the peace, health and
safety of the people of the City of Tigard that the
foregoi:►g change in tro boundaries of the City become a permanent
part of the City's records, an emergency is hereby declared to exist,
and this ordinance shall be effective upon its passage by the Council,
and approval by the Mayor.
PASSED: By onanimous vote of all Council Members present, after

FINAL ORDER NO. 13
RE: BOUNDARY CHANGE PROPOSAL NO. 13 - Annexation of the following ter-
ritory to the City of Tigard,
Legal Description
That tract of land in Section 2, Township 2 South, Range 1 West,
Willamette Meridian, Washington County, Oregon, being more par-
ticularly described as follows:
Commencing at a point on the Westerly line of Lot 21, FREWING°S
ORCHARD TRACTS, Washington County, Oregon, and in the center
line of County Road 713, said point being South 53° 16' East
193 feet from the Northwesterly corner of said LOT 21, being
further identified as the point in the county road where that
certain tract of land described in Deed Book 195, page 495,
intersects said County Road at the Northwesterly corner thereof;
thence from said beginning point South 53° 16' East along the
Westerly line of said LOT 21, 84.8 feet; thence North 45° 48'
East 134 feet to an iron pipe at the Southwest corner of a tract
conveyed by J. N. Atterbury and wife to Lidvig Anderson and wife
by geed recorded April 11, 1924, in Deed Book 127, page 285; thence
North 46a 18' West 83.7 feet to an iron pipe; thence South 450 48'
West 143.8 feet, more or less, to the place of beginning. Subject
to the Rights of public in and to that part of the herein described
premises lying in South West Frewing Street, County Road #713.
WHEREAS, on July 16, 1969 the Commission received a petition from property
owners requesting that the property described above be annexed to the
City;
WHEREAS, the petition meets requirements for initiating boundary change t
proposals set forth in ORS 222.170 and paragraph (a), subsection (1) fi
Section 16a of Chapter 494Oregon Laws 1969;
WHEREAS, The Commission scheduled and conducted a public hearing on this
proposal as provided in paragraph (b), subsection (1) Section 13 of Chapter
494 Oregon Laws 1969 in Room 680 of the Multnomah County Courthouse on
September 10, 1969 at 8:00 p.m.;
WHEREAS, The Commission caused notice of the public hearing to be adver-
tised in a newspaper of general circulation in the county, posted in the
territory to be annexed, and broadcast over radio all as provided in Sec-
tion 20, Chapter 494 Oregon Laws 1969;
WHEREAS, the Commission caused a study to be made of this proposal as pro-
vided in paragraph (a), subsection (1) Section 13 of Chapter 494 Oregon
Laws 1969;

WHEREAS, on the basis of the study the Commission found that:
a) the territory to be annexed is contiguous to the city;
b) the territory to be annexed contains approximately .24 acres and
.• single family dwelling is located on the property;
C) the property owner needs sewer service for the single family
dwelling;
d) the City has sewer facilities in the vicinity of the property and
is able to provide the service; and
e) the boundary change would not adversely affect any other unit
of local government;
WHEREAS, on the basis of the findings the Commission approved BOUNDARY
CHANGE PROPOSAL NO. 13 on September 10, 1969;
NOW THEREFORE IT IS ORDERED that the territory described above be annexed
to the City of Tigard as of this date.
