AN ORDINANCE RATIFYING, CONFIRMING AND RECORDING CHANGE IN
THE BOUNDARIES OF THE CITY OF TIGARD BY THE BOUNDARY COMMISSION,
INVOLVING LANDS OF William 11. Parker and Mary Parker
IN Section 2, T2S, RIW, W.M. WASHINGTON COUNTY, OREGON,
RECORDING EFFECTIVE DA'PE fi Nd DECLARING AN EMERGENCY.
WHEREAS, the Boundary Commission established pursuant to
Chapter 494 Oregon Laws of 1969 for the Portland Metropolitan Area,
by its final order dated September 10, 1969 approved the herein-
after described change in the boundaries of the City of Tigard, and
a copy of said final order has been filed with the City Recorder,
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That the final order of the Boundary Commission adopted
on then 10 day of September , 19 69 , as filed with the
City Recorder on th; 24 day Of Septelrl?er , 19 69, a copy whereof is
hereto attached and by--this reference made a part hereof, be, and
the same is hereby ratified, confirmed and adopted by reference to
the same legal force and effect as if set forth herein in full.
Section 2: That the boundaries of tiIa City of Tigard be, and they
are hereby, changed to (include) the lands as described
in the within order of the Boundary Commission, and the corporate
limits of the City of Tigard are hereby changed in conformity there-
with.
Section 3: That the Recorder of the City of Tigard be, and she is
hereby,directed to forthwith file a copy of this ordi-
nance, including a copy of said Order, in the following offices:
(a) Secretary of State
j. (b) Department of Revenue and Taxation, Washington County
(c) Department of Records and Elections, Washington County
(d) Department of Public Works, Attention: Surveyor,
Washington County
Section 4: That the City Planning Commission be, and it is hereby,
authorized and directed to conduct such proceedings as
may
be necessary to conform the authorized zoning and land use of
the described premises to the requirements of the City's Zoning Map
and Code.
Section Inasmuch as it is necessary for the peace, health and
safety of the people of the City of Tigard that the
foregoing change in the boundaries of the City become a permanent
part of the City's records, an emergency is hereby declared to exist,
and this ordinance shall be effective upon its passage by the Council,
and approval by the Mayor.
PASSED: By unanimous vote of all Council Members present, after

h RE: BOUNDARY CHANGE PROPOSAL NO. 10 - Annexation of the following territory
to the City of Tigard.
Legal Description
Beginning at an iron pipe at the most southerly corner of tract
22 of Frewing's Orchard Tracts in Section 2, T 25., R 1W.,
W.M., a subdivision of record in Washington County, Oregon;
running thence N. 30° 04' W. Along the southwesterly line of
said lot 22 a distance of 215.0 feet to a point from which an
iron bears N. 54° 27' E. 25.1 feet; thence N. 54° 27' East
175.0 feet to an iron; thence south 30° 04' east parallel
with the southwesterly line of said lot 22, a distance of 162.5
feat, to a point on the southeasterly line thereof, from which
point an iron bears north 30° 04' west 26.9 feet; theace south
38° 16' west 187.44 feet to the place of beginning, the south-
eaater.ly 25.0 feet of which are to be used for roadway purposes
only.
WHEREAS, on my 30, 1969 the Commission, received a petition from property
owners requesting that the property described above be annexed to the City;
WHEREAS, the petition meets requirements for initiating boundary change
propozals set forth in ORS 222.170 and paragraph (a), subsection (1)
Section 16a of Chapter 494 Oregon Laws 1969;
WHEREAS, the Commission scheduled and conducted a public hearing on this
proposal as provided in paragraph (b), subsection (1) Section 13 of Chapter
494 Oregon Laws 1969 in,Room 680 of the Multnomah County Courthouse on
September 10, 1969 at 8:00 p.m.
WHEREAS, the Commission caused notice of the public hearing to be adver-
tised in a newspaper of general circulation in the county, pasted in the
territory to be annexed, and broadcast over radio all as provided in Sec-
tion 20, Chapter 494 Oregon Laws 1969;
WHEREAS, the Commission caused a study to be made of this proposal as
provided in paragraph (a), subsection (1) Section 13 of Chapter 494 Oregon
Lawn 1969;
WHEREAS, on the basis of the study the Commission :found that;
a) the territory to be annexed is contiguous to the City;
b) the territory to be annexed contains approximately one-half acre
and a single family dwelling is located on the property;

c) the property owner needs sewer service;
d) thy City has sewer facilities in the vicinity of the property and
-. is able to provide the service; and
e) the boundary change would not adversely affect any other unit
of vocal government;
WHEREAS, on the basis of the findings the Commission approved BOUNDARY CHANGE
PROPOSAL NO. 10 on September 10, 1969;
NOW THEREFORE IT IS ORDERED that the territory described above be annexed d
to the City of Tigard as of this date. {
