ORDINANCE No. 6
AN ORDINANCE AUTHORIZING CONDITIONAL USES ON LANDS OF Bissett
and Bissett in Section 35, T1S, RM W.M., TIGARD, 'W'ASHINGTON
CQNMa OREGON
WHEREAS, the owners of the lands described on attached
Exhibit "A" by reference made a part hereof, havz filed with 'the
City an application for authorization to conduct the following
described conditional uses on the said premises; and
WHEREAS, the zoning classification of said lands here-
tofore established by the zoning ordinances of the City of
Tigard is C-3 (General Commercial) and the conditional uses re-
quested by the applicants may be properly permitted in conformity
with the said classification; and
WHEREAS, the City Planning Commission on the 16th day of
July, 1369, held a public gearing with respect to said applica-
tion and said Commission has recommended to the City Council that
said application be approved; and
WHEREAS, a public hearing before the City Council with
respect to said application was duly and regularly held on the
11th day of August, 1969, and the City Council finds that no
-public detriment will result from the granting of said petition
and that it is in the public interest that said conditional uses
be authorized,
NOW, THEREFORI3,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
See--t on-1: That the following conditional uses as defined in
the City of Tigard zoning Ordinance under the zone
classification C-3 (General Commercial), to-wit-
Auto Service
Auto Parts
Accessory Sales
be and the same are hereby authorized with respect to the lands
described on Exhibit "A" by reference made a part hereof, subject
to compliance with the following conditions:
1. That development be in accordance with the site plan
submitted as amended by the Commission_,
Z. That oaly one free-standing sign be permitted:
one non-moving free-standing sign on 99k7 only,
located as shown on the site development plan
submitted with the exception that it should not
project into the right-of-way.
3. That no banners, pennants, festoons of lights or
other similar suspended devices used for advertising
purposes in connection with any sign or commercial
enterprise be permitted.
4. That written approval from the Planning Department

shall be obtained prior to any outdoor display or
outitdoox merchandising.
5. That specific plans for signs and landscaping be
submitted at the time of application for the building
permit.
b. That this conditional uses permit-shall expire within
one year if the project has not been started and
continual progress toward its completion is not in
evidence.
Section 2: The City Recorder is hereby authorized and
directed to certify a true copy of this
Ordinaace and forward same to the applicant forthwith.
Section 3: This Ordinance shall be effective on and after
the 31st day from its enactment by the City
Council of the City of Tigard, Oregon.

CONDITIONAL USE APPLICATION
EXHIBIT "A"
A tract of 1.nd in Section 35, Tl S, R1W, W.M.,
Washiagton County, Oregon, described as follows:
Beginning at the intersection of the northwesterly
right of way line of the relocated S.W. Pacific
Highway and the easterly right of way line of S.W.
Greenburg Road, said intersection being the south-
westerly corner of the tract conveyed to R. A.
Bissett and Rose E. Bissett, husband and wife, as
described on page 517 in Boole 213, Washington County
Deed Records; thence N 620 38' 35" E. along said S.W.
Pacific Highway right of war like 125.95 feet to the
truebeginning point of the tract herein described;
thence N 270 211 25" W., at right angle to said S.W.
_ Pacific highway right of way line, 201.95 feet to
the angle point on the northerly line of the tract
conveyed to R. A. Bissett, et ux, as described on
pa-- 375 .Book 2599, said Deed Records; thence N
628%:211 E. along said northerly line and the nor-
therly line of the tract conveyed to Bissett and
{ Bissett as described on page 351 in Book 357, said
Deed Records, 106.21 feet to the northeast corner
s of the last above defined Bissett tract; thence S 270
23' E. 202.,66 feet to southeast corner of said last
above defined Bissett tract, being a point on said
S.W. Pacific highway right of way line, thence S 620
381 350 W. 106.90 feet to the true ,place of beginning
of this description, subject to any portion thereof
lying in public roads and highways.
