AN ORDINANCE GRANTING A ZONE CHANGE WITH RESPECT TO THE LANDS OF
}} C. H. McGarr, Mary F. McGarr and Kay F. McGarr in Section 12, T2S,
T( R1W, W.M.
TIGARD, WASHINGTON COUNTY, OREGON
wHEREAS, the hereinafter described lands, by action of the
City Council of the City of Tigard, Oregon, pursuant to the Zoning
Code of said City, have: heretofore been limited in the, use to those uses
permit�ashingtonsaid
County M-3(Tight have been saed zoned
and
WHEREAS, pursuant to prescribed procedures, the owners of
said lands have applied to the City of Tigard for reclassification of
said property and change of zone thereof to permit the use thereof
for City of Tigard m-3 (Lt. Ind.turpo*ses, and said application has
been duly publicized and public hearing held by the City Planning
Commission on July 16,1969 after due and legal notice; and
WHEREAS, the Planning Commission has recommended approval
of said zone change to the City Council, and due and legal notice of
City Council hearing having been given by publication in the Tigard
Times, and the City Council having heard same at its regular meeting
of August 11, 1969 , and the Council finding that no public
dot rs- ant will resu t room granting of said petition, and that it is ,
in the public interest that said zone change be approved, and the lards
re-zoned from Washington County 13•-3 (bight Industrial) to City of Tigard
NOW, THEREFORE, M-3 (Light Industrial)
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That the fallowing described lands be, and the same are
M� hereby, zoned as m-3 for use in accordance with tha
M-3 (Light industrial) cTassifieation of the Zoning Code of
the City of Tigard, which Zoning Code with respect to the M-3
classification is by reference herein made a part hereof: —"
Beginning 20 chains South of the North line of Section 12,
Township 2 South, Range I West of the Willamette Meridian, and 39.95
chains West of the East line of said Section; thence Southerly and
parallel with the East line of said Section 212.70 feet; thence
Easterly and parallel with the North line of said Section 424.50 feet
to a point 75 feet Westerly from the center of the Oregon Electric
Company's right-of-way, thence Northerly and parallel with said right-
of-way 215.40
ight-of-way"215.40 feet; thence Westerly and parallel with the North line of
saidSection292.88 feet to the place of beginning, excepting that
portion within roads and streets dedicated for public use.
Section 2: This ordinance shall be effective on the 31st day after
its enactment by the City Council of Tigard, Oregon.
