CITY OF TIGARD, OREGON ORDINANCE NO. 69- Zi'V AN ORDINANCE. CONFIRMING AND RATIFYING THE RESOLUTION OF THE CITY COUNCIL OF JUNE 23, 1969 WITH RESPECT TO "DERRY DELL TRUNK SEWER IMPROVEM.EN'T DISTRICT"; APPROVING, RATIFYING AND ADOPTING PLANS, SPECIFICATION.9 AND ESTIMATES FOR CO_T.STRUCTION OF SANITARY SEWER SYSTEM; DECLARING RESULTS OF HEARING FIELD WITH RESPECT THERETO; DIRECTING SOLICITATION OF BIDS FOR CONSTRUCTION PROVIDING FOR THE MAKING OF SAID IMPROVEMENTS, AND DECLARING AN EMERG ENCYr- WHEREAS, a resolution was duly passed by the City Council of the City of Tigard at its regular meeting of June 23, 1969, a copy whereof is hereto attached and by this reference made a part hereof to the same legal force and effect as if set forth herein in full, by the terms of which the boundaries of a proposed sewer im- provement assessment distric� were described, and the Council de- clared its intention to construct a sanitary sewer system and to ,assess the costs thereof against the property within the boundaries specially benefited; and WHEREAS, by the terms of said resolution a hearing was duly _ called to be held in the Tigard Community Center at 8845 S.W. Com- mercial Street in Tigard, Oregon on July 14, 1969 at the hour of 8:00 P.M. for the purpose of affording an opportunity to any parties aggrieved by the proposal to make objections or remonstrances to the proposed improvement; and WHEREAS, pursuant to said resolution, due and legal notice of said hearing was given by publication in the Tigard Times for three consecutive publishings on June 27, July 4, and July 11, 1969 prior to said hearing; and WHEREAS, said hearing was duly and regularly called to order and held in the Tigard Community Center at 8845 S.W. Commercial Street in Tigard, Oregon on July 14, 1969 at the hour of 8:00 P.M., whereat certain persons appeared and were heard; and WHEREAS, by the terms of said resolution and publication, written objections or remonstrances from, not less than 66-2/3% of the owners of property within the boundaries of said area were in- vited, and all objections and remonstrances as thus presented prior to and at the nearing represent less than 66-2/3 of the owners of this property in the area within the improvement assessment district and that the percentage of remonstrances is not a ban to further pro- ceedings in the ?Waking of said improvements; WHEREAS, all proceedings to date have been in conformity w'th 233.387 and 223.359 Oregon Revised Statutes and Ordinance 62-6 of the City of Tigard, and all procedures were regularly and law- fully conducted, NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: That all matters set forth in the resolution of the City Council of the City of Tigard, Oregon of June 23, 1969, a copy whereof is hereto attached marked Exhibit "A" and by reference herein made a part hereof to the same legal force and effect as if set forth herein in full, be, and thea same are, hereby approved, ratified and confirmed, and the boundaries of the area known as "DERRY DELL TRUNK SEWER IMPROVEMENT DISTRICT" as heretofore des- cribed in said resolution, be, and the same are hereby, declared and fixed Page 1 ORDINANCE No. 69-514 in accordance with said description. The formula used for the assessrnent of eachtax lot by this method is as follows: Assessment = $350. 00 + $727. 869 x Acreage of lot. (The $727. P69 figure was derived as follows: 46 tax lots are adjacent to the Derry Dell Trunk Sewer, multiplying this by the $350. 00 connection charge per tax lot we obtain $16, 100. 00. Subtracting this $16, 100. 00 from $116, 000. 00, estimated cost of Derry Dell Trunk Sewer based on 8-inch lateral sewer, we obtain $99, 900. 00. Dividing this $99, 900. 00 by 137. 25 Acres, total acreage of the 46 tax lots, we obtain the figure of $727. 869/Acre. ) The assessments by Method x for each tax lot adjacent to Derry Dell Trunk Sewer are tabulated on the following pages under the column headed "Method A." Method B Method B assessment is based on a $350. 00 connection charge per tax lot plus a portion of the 8-inch lateral sewer cost based on the acreage of the tax lot and the front lineal footage of sewer abutting the tax lot. The formula used for the assessment of each tax lot by this method is as follows Assessment = $350. 00 + $363. 934 x Acreage of lot + $2.385 x front lineal footage. (The $353. 934 and $2,385 figures were derived as follows: Subtracting the $16, 100. 00 total connection charge from. $116, 000. 00 estimated cost of Derry Dell Trunk Sewer based on 8-inch lateral sewer, we obtain $99, 900. 00 as des- cribed under Method A above. Taking 50% of the $99, 900. 00 we obtain $49, 950. 00,such that $49, 950. 00 will be proportioned on an acreage basis and $49, 950. 00 will be proportioned on a front lineal footage basis. 'Dividing $49, 950. 00 by 137. 25 Acres we obtain the figure of $363. 934/Acre, and dividing $49,,950. 00 by 20, 941. 5 front lineal footage, total for all abutting tax lots, we obtain $2.385/front lineal footage. ) The assessments by Method B for each tax lot adjacent to Derry Dell Trunk Sewer are tabulated on the following pages under the column headed":'Method B." 68-�P--486. 054 R Method C ANlethod C assessment is based on a charge per acre for the excess cost of providing a trunk sewer as compared to an 8-inch lateral sewer. The formula used for the assessment of each tax lot by this method is as follows: Assessment = $52. 00 x Acreage of lot. The $52. 00 is derived as follows: Dividing $26, 000. 00, the excess cost of providin;- a trunk sewer as compared to an 8--inch lateral sewer, by 500 Acres total acreage of tax lots within the ultimate service area, we obtain the $52. 00/ Acre figure. This assessment is shown for each tax lot adjacent to Derry Dell Trunk Sewer on the following pages under the column headed "Method C." The total for this colun-in, as you %will note. i9 ,$7137. 00. Subtracting this amount from the _ o $26, 000, we obtain $18, 863. 00.
