Ordinance No. 69-40 CITY OF TIGARD, OREGON ORDINANCE No. 69-.qD ORDINANCE GRANTING A ZONE CHANGE AND APPROVING CONDITIONAL USE WITH RESPECT TO LANDS OF J. G. CHAMBERLAIN AND ARLENE V. CHAMBERLAIN in Section 3, T2S, R1W, W.M., WASHINGTON COUNTY, OREGON, FROM " WASHINGTON COUNTY S-R" CLASSIFICATION TO "PLANNED RESIDENTIAL DEVELOPMENT" UNDER "SINGLE-FAMILY RESIDENTIAL R-15" ZONE OF THE CITY OF TIGARD. WHEREAS, the hereinafter described lands, by action of the Washington County Planning Commission have heretofore been limited in use to those permitted by the "Suburban-Residential S-R" classi- fication of the Washington County Zoning Code; and WHEREAS, pursuant to prescribed procedures, the owners of said lands have applied to the City of Tigard for reclassification of said property from Washington County S-R (Suburban Residential) to City of Tigard "Planned Residential Development" as a conditional use under the R-15 (Single-family Residential) zone pursuant to the zoning code of the City of Tigard; and WHEREAS, said application was duly publicized and hearing held on March 13, 1969 by the City Planning Commission, after due and legal notice; and WHEREAS, the City Planning Commission has approved the "Planned Residential Development" conditional use and has recommended approval of a zone change to R-15 (Single-family Residential) , subject to the conditional use, and notice of City Council hearing thereon having been duly given by publication in the Tigard Times, and the City Council having conducted said hearing at its regular meeting of April 14, 1969, the Council finds that said lands are well-adapted to and meet the criteria for "Plaftned Residential Development" under the R-15 (Single-family Residential) classification, subject to the conditions prescribed by the Planning Commission; and the Council further finds that it is in the public interest that said conditional use and zone change be approved and granted. NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section l: That the lands described on the attached sheet headed "DESCRIPTION" be, and the same are, hereby reclassified to permit the use thereof for Planned Residential Development under the R-15 (Single-family Residential' classif=.cation of the Zoning Code of the City of Tigard, subject to the conditions set forth on the attached sheet. entitled "CONDITIONS" which by reference is made a part hereof, to each and all conditions and requirements the development of said lands shall be and remain subject. Section 2: This ordinance shall be effective on the 31st day after its enactment by the City Council of Tigard, Cneaon. Mayor - City of Ti rd ORD114ANCk No. 69-_Ma' "DESCRIPTION" A tract of land in the Northwest quarter of Section 3, Township 2 South, Range 1 West, Willamette Meridian, Washington County, Oregon described as follows; Beginning at an iron pipe which is South £90 58' East 666.25 feet and South 00 28' West 449.51 feet from the Northwest corner of said Section 3, and going thence from said iron pipe South 830 27' West 101.04 feet; thence South 00 41' West 1211.66 feet to a point in the center of Miller's Ferry Road (county road No. 494); thence along the centerline of said road North 630 21' East 33.07 feet; the,.ce North 620 48' 20" East 80.95 feet; thence North 600 19' East 471.41 feet to a point in the roadway; thence Noa.th, 070 30' East 29.15 feet to an iron pipe; thence North 070 30' East 483.66 feet to an iron pipe; thence North 220 42' West 553.0 feet to an iron pipe; thence South 820 14' West 257:98 feet to the point of beginning, containing 12.47 acres more or less and excluding that portion of the described area within the public roadway. �s 3w s r- 1 S CONDITIONS ` 1. That the Planned Residential is approved only in concept at this time; 2. That plans for the multi-family areas be submitted for approval by the Planning s zoning Commission prior to the issuance of a building permit; 3. That the number of multi-family units be limited to a total of 15; 4. That access to the lot 12 not be directly off Walnut Street, but off the new road which will be developed along the easterly boundary of thero t p per3 5. That access be guaranteed to lots 2 - 7 onto the public toad shown on the westerly adjoining property; f>. That a guarantee for perpetual maintenance of the lake as an asset to the subdivision be drawn up and approved by the City prior to the recording of the final plat; 7. That the easterly road be a 50' right-of-way ending in a cul-de-sac at lot 11 and that a "mutually non-exclusive easement" be drawn up,for recording for those access drives serving lots 8, 9 and 10; 8. That park area be dedicated to the City in the northwest corner of the property in order to continue progress in our greenbelt system, such area to be delineated and then approved by the Planning and Zoning Commission prior to the approval of the final plat; 9. That a lO ft. strip of land along Walnut Street be dedicated to the public for future street improvement. 49 xg"
