ORDINANCE No. 69 -30
AN ORDINANCE SETTING HEARING WITH RESPECT TO PETITION PROPOSING
ANNEXATION OF LAND: TO THE CITY OF TIGARD IN SECTION 36, T1S, R1W, W.M.,
WASHINGTON COUNTY, OREGON, COMMONLY DESIGNATED THE "FRUITLAND ACRES
ANNEXATION", DIRECTING THE GIVING OF NOTICE, AND DECLARING AN EMERGENCY.
WHEREAS, there has heretofore been filed with the City Recorder `
of the City of Tigard, petition for annexation of certain lands in
Section 36, T1S, R1W, W.M., Washington County, Oregon as hereinafter
described; and
WHEREAS, said premises are contiguous to the City of Tigard
and not within the corporate limits ref any other City, and lie wholly
within the County of Washington, State of Oregon; and
WHEREAS, it appears from said petition that the ownerships
of all tracts included within the total area, more than two-thirds
of the land owners owning more than two-thirds of the land repre-
senting more than two-thirds of the assessed value have joined in
said petition and have thereby conssnted to the annexation of the
respective tracts and the total ar:a to the City of Tigard;
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That the City Council of the City of Tigard does hereby
elect to dispense with submitting the question of the
annexation of the hereinafter described premises to the registered
voters of the City.
Section 2: That Monday, the 14th day of April, 1969, at the hour
of 9:00 P.M., at the City Hall in the City of Tigard, ;
be, and the same are, hereby fixed as the date, time and place for
public hearing before the City Council of Tigard of the petition of
land yawners within the area designated as the "FRUITLAND ACRES
ANNEXATION" 'for annexation of the hereinafter described lands to
the City of Tigard, and all registered voters of the City may appear
at said time and place and be heard on the question of said annexation.
Section 3: The City Recorder of the City of Tigard be, and she is ((
hereby directed to give notice of said hearing by pub-
lication once each week for two successive weeks, or three publish-
ings in all, prior to the date of the hearing, in the Tigard Times,
a newspaper of general circulation in the City, and said Recorder
bra, and she is hereby, further directed to post notice of said
hearing in four public places in the City of Tigard for a like period.
Section 4: That the area proposed to be annexed be, and the same is
described on the attached sheet headed "DESCRIPTION"
which by reference herein is made part hereof.
^ Section 5: Inasmuch as the hearing of the petition for annexation of
i� the lands herein described should be conducted with the

least possible delay, an emergency is hereby declared to exist, and
it is declared to be necessary for the peace, health and safety of
the City of Tigard that this ordinance become effective upon its
passage by the Council and signature by the Mayor.
PASSED: By the Council, by unanimous vote of all Council members
present, after being read three times by number and

DESCRIPTION
EXHIBIT A
FRUITLAND ACRES ANNEXATION
Beginning at the S.E. corner of Lot 1, Fruitland Acres,
Washington County; running thence, N. 00 40' W, a distance
of 514.5 feet, more or less, to the S.W. corner of that tract
of land conveyed to Marry D. Wilson, et ux, recorded in Book 323,
Page 103, Washington County Deed Records; thence, East 95.2 feet
to the S.W. corner of said Wilson tract; thence, North along
the east line of said Wilson tract a distance of 435 feet,
more or less, to the Southerly right--of-way line of the SW
Pacific Highway, thence Southwesterly along the right-of-way
line to its intersection with the Easterly line of the G. R.
Richardson DLC 55; thence, South along said DLC 05 to a point
on the extension of the North line of Lot 7, Fruitland Acres;
thence, east along said extension and lot Une a distance
599,70 feet to the point of beginning.
