ORDINANCE GRANTING A ZONE CHANGE AND APPROVING CONDITIONAL
USE WITH RESPECT TO LANDS OF LYLE GOODELL and EVELYNGOODELL in
Section 3, T2S, R1W, W.q., WASHINGTON COUNTY, OREGON, FROM "WASH-
INGTON COUNTY S-R" CLASSIFICATION TO "PLANNED RESIDENTIAL DEVEL-
OPMENT" UNDER "SINGLE-FAMILY RESIDENTIAL R-•71" ZONE OF THE CI`.PY OF
TIGARD. . ^.,.
WHEREAS, the hereinafter described lands, by action of the
Washington County Planning Commission have heretofore been limited
in use to those permitted by the "Suburban-Residential S-R" clas-
sification of the Washington County Zoning Code; and
WHEREAS, pursuant to prescribed procedures, the owners of
said lands have applied to the City of Tigard for reclassifica-
tion of said property from Washington County S-R (Suburban Resi-
dential) to City of Tigard "Planned Residential Development" as a
conditional use under the R-7 (Single-family Residential) zone
pursuant to the zoning code of the City of Tigard; and
WHEREAS, said application was duly publicized and hearing
held on February 18, 1969 by the City Planning Commission, after
due and legal notice; and
WHEREAS, the City Planning Commission has approved the
"Plannod Residential Development" conditional use and has recom-
mended approval of a zone change to R-7 (Single-family Residen-
tial), subject to the conditional use, and notice of City Council
r hearing thereon having been duly given by publication in the Ti-
gard Times, and the City Council having conducted said hearing at
its regular meeting of March 10, 1969, the Council finds that said
lands are well-adapted to and meet the criteria for "Planned Resi-
dential Development" under the R-�7 (Single-family Reside:atial)
classification, subject to the conditions prescribed by the Plan-
ning Commission= and the Council further finds that it is in the
public interest that said conditional use and zone change be ap-
proved and granted.
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That the lands described on the attached sheet headed
"DESCRIPTION" be, and the game are, hereby reclassi-
fied to permit the use thereof for Planned Residential Development
under the R-7 (Single-family Residential) classification of the
Zoning Code of the City of Tigard, subject to the conditions set
forth on the attached sheet entitled "CONDITIONS" which by refer-
ence is made a part hereof, to each and all conditions and re-
quirements the development of said lands shall be and remain sub-
ject.
Section 2: Thiry ordinance shall be effective on the 31st day after
its enactment by the City Council of Tigard, Oregon.

South 89 40' East, along the North line thereof, 660.0 feet to
a stake at the Northeast corner of said Goodell tract; thence
South 00 30' West along the East line of said Goodell tract,
449.62 feet to the Northeast corner of that tract described as
Parcel II in Contract between Lyle D. Goodell, et ux, and Arrow
Heating Co., recorded June 23, 1965, in Book 557, page 626, Records
of Washington County; thence South 830 27' West along the North
line of said Arrow Heating Co, tract, 101.04 feet to the North-
west corner thereof; thence South 010 41' West, along the West

angle corner on the West line of said Goodell tract, said corner
hearing North 25.0 feet and East 75.0 feet from the Southwest corner
of the Northwest quarter of the Northwest quarter of said Section 3;
thence West 75.0 feet to a point on the Wiest line of said Goodell
tract, being also a point on the West line of said Section 3; thence
North, along said West line, 1.295 feet to the point of beginning.

CONDITIONS
. -' 1. That the park area shown on the preliminary plat be
dedicated to the City and a $1200 fund be put in
trust for future development of the park, above and
beyond the development described in condition 2 (ex-
cept for the pathways).
2. That the creek be drained, the park areas rough gra-
ded and seeded, and that pathways of asphalt or con-
crete approved by the City Staff be constructed in
the park areas.
3. That.-the::entranae to the park be paved and land-
scaped and oriented to pedestrian traffic, although
controlled vehicular access should be provided for
maintenance.
4. 7nat all stilitieR be underground.
5. That the total number of apartment units be limited
to 26: 10 unity on lot 33 and 16 units on lot 63.
6. That the height of the townhouse units not exceed 30'.
7. That a site development plan for the townhouse areas
be approved by the Planning & Zoning Commission prior
to issuance of the building permit.,
B. That the major arterials in the development (124th,
125th, and Katherine Street) be planted with trees-
at I-ast one tree per lot, 1h" caliper, along the
entire length within the development.
9. That due to the topography and required setbacks, lots
6 and 7 b increased to 85 feet minimum width, and lots
1 - 5 be approved by the City Staff.
10. That a portion of lot l facing on Walnut Street and
125th be landscaped heavily: such landscaping to be
maintained with that of the townhouse developments..
11. That written confirmation be obtained from the ad-
joining property owner approving of the encroachment
of the road on his property.
12. That a 10-foot strip of land along Walnut Street be
dedicated to the public for future street improvements.
