(I AN ORDINANCE SETTING HEARING WITH RESPECT TO PROPOSED ANNEXA-
TION OF THE LANDS OF FARMERS U.'dDERWRITERS ASSOCIATION et el in Sec. 1, T23,
Rlw, W.M.
WASHINGTON COUNTY, OREGON, AND DIRECTING GIVING OF NOTICE THEREOF.
WHEREAS, there has heretofore been filed with the City Re-
corder of the City of Tigard, petition for annexation of certain
lands in See. 1, T2S, R1W, W.M.
Washington County, Oregon, as hereinafter described; and
WHEREAS, said premises are contiguous to the City of Tigard
and not within the corporate limits of any other City, and lie
wholly within the County of Washington, State of Oregon; and
WHEREAS, it appears that said premises may properly be
annexed to the City of Tigard without submitting the question to
the registered voters of the territory, since the owners thereof,
Parmers Underwriters Assn; Truck Underwriters Assn. Richard G. Schultz; Anna M.
Schultz; Daniel W. Gay; Doris C. Gay and the State of Oregon
have by signed petition requested and consented to said annexation;
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That the City Council of the City of Tigard does hereby
elect to dispense with submitting; the question of the
annexation of the hereinafter described premises to the registered
voters of the City.
Section 2: That Monday, the 12th day of , '96-a

hour of 8:00 p.m,, at the City all in the City of
Tigard, be, and the same is, hereby Nixed as the date, time and place
:for public hearing before the City Council of Tigard of the petition

Of Farmers Underwriters Assn; Truck Underwriters Assn, Richard G. Schultz; Anna M.
Schultz; Danie W. Gay; Doris C. Gay and the state of Oregon
for annexation of the hereinafter described lands to the City of
Tigard and all registered voters of the City may appear at said
time and place and be heard on the question of said annexation.
Section 3: The City Recorder of the City of Tigard be, and she is
hereby, directed to give notice of said hearing by pub-
lication once each week for two successive weeks, or three publish-
ings in all, prior to the date of the hearing, in the Tigard Times,
a newspaper of general circulation in the City, and said Recorder
be, and she Is hereby further directed to post notices of said hear-
ing in four public places in the City of Tigard for a like period.
Section 4: That the area proposed to be annexed be, and the same

That portion of the Varns Acres Tracts being located in
the Northerly half of the Southeast quarter of Section 1, T2S,
R1W, W.M. Washington County, Oregon more particularly described
as follows:
Beginning at the quarter section corner on the Easterly �
line of said section 1, said corner also being the initial point
of Varns Acres a duly recorded subdivision; running thence West
along the Northerly line of said subdivision to the Northwest
corner of Lot 11 Varns Acres; thence South along the Westerly
line of said Lot to the intersection of the South westerly right
of way line of the Beaverton-Tigard Highway; thence Southeasterly :
along said right of way line to the intersection of the Westerly
line of Lot 4 Varns Acres; thence North 00 45' East along said
lot line to the Northwest corner of said Lot 4; and continuing then
along an extended line to the center1lis of S. W. Varns Street,
(C.R. #1286); thence North 890 52' East along said centerline to
a point marking *':e beginning point of C.R. #1286; thence continuing
along an extension of said centerline to the East lire of said V
Section 1; thence North along the East line of said Section 1 to
the point of beginning. Excepting that portion of Lot 10 of said
subdivision which is not within the right of way of the Beaverton-
Tigard Highway.
Section. 5: Inasmuch as the hearing of the petition for annexation
of the lands herein described should be conducted with
the least possible delay, an emergency is hereby declared to exist,
and it is declared to be necessary for the peace, health and safety
of the City of Tigard that this ordinance become effective upon its
passage by the Council and signature Dy the Mayor.
PASSED: By the Council, by unanimous vote of all Council members
present, after being read three times by,number and
