Ordinance No. 68-23 a CITY OF TIGARD, OREGON ORDINANCE No. 68-_.2�— AN ORDINANCE SETTING HEARINiG WITH RESPECT TO PROPOSED ANNEXATION OF CERTAIN LANDS IN THE HE 1111 AND THE SE 1/4 OF SECTION 12, T28, RZW, W.M., WASHINGTON COUNTY, OREGON, INCLUDING OWNERSHIPS OF W, R. CHAMBERLIN & COMPANY, FOUGHT AND COMPANY, INC., A. T. NELSON ET UX, ROBERT G. ROGERS ET UX, SOUTHERN PACIFIC COMPANY, AND PRE- DELIVERY SERVICE CORP.; DISPENSING WITH SUBMITTING THE QUESTION OF ANNEXATION TO THE VOTERS OF THE CITY; DIRECTING THE GIVING OF NOTICE THEREOF; and DECLARING AN EMERGENCY. WHEREAS, certain owners of lands within the area hereinafter described have petitioned the City of Tigard to annex their respec- tive tracts to the City; and WHEREAS, pursuant to contract dated the 22nd day of August, 1968, between Rogers Machinery Corporation, an Oregon Corporation, and the City, consent to annexation of additional lands was granted; and WHEREAS, all of said lands as hereinafter described are con- tiguous to the i;ity of Tigard and nc'c within the corporate limits of any other city; and WHEREAS, the tracts for which consent is not now available involved less than one-third of the land owners who own less than one-third of the land representing less than one-third of the assessed value of all real property in the hereinafter described area, and the total of said premises may therefore properly be considered for annexation to the City of Tigard without submitting the auestion of annexation to the registered voters of the terri- tory, NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section l: That the City Council of the City of Tigard does hereby elect to dispense with submieting the question of the annexation of the hereinafter described premises to the registered voters of the City. Section 2: That Monday, the 13th day of May, 1968, at the hour of 8:00 P.M., at the City Hail in the City of Tigard,he, and the same is, hereby fixed as the date, time and place for public hearing before the City Council of Tigard of the petition of FOUGHT & COMPANY, et al for annexation of the hereinafter described lands to the City of Tigard, and all registered voters of the City may appear at said time and place and be heard on the question of said annexation. Section 3: That the City Recorder of the City of Tigard be, and she is hereby, directed to give notice of said hearing by publication once each week for two successive weeks, or three pub- lishings in all, prior to the date of the hearing, in the Tigard Times, a newspaper of general circulation in the City, and said Recorder be, and she is hereby further directed to post notices of said hearing in four public places in the City of Tigard for a like period. Page l - ORDINANCE No. 68-�2 3 Section 4: That the area proposed to be annexed be, and the same is hereby described as follows: All of that certain part of the Northeast and Southeast quarter of Section 12, Township 2 South, Range 1 West, Willamette Meridian, in the County of Washington, State of Oregon, and more particularly described as follows: Beginning at the northwesterly corner of Lot 5 of Bonita Gardens as recorded in Book 5, Page 11, Deed Records Washington County; running thence South 890 57' East a distance of 546.59 feet to the centerline of S. W. 72nd Avenue; thence North along the centerline of S. W. 72nd Avenue a distance of 495 feet, more or less, to the cen- terline of S. W. Bonita Road, known as County road #736; thence westerly along the centerline of S. W. Bonita Road a distance of 730.7 feet, more or less to the easterly right-of-way line of the Southern Pacific Railroad; thence northerly along said railroad right-of-way to the northwest corner of that tract of land conveyed to Thomas K. Kloster- man by deed recorded in Book 382, Page 16, Deed Records of said County; thence easterly 853 feet, more or less, to the northeast corner of said Klosterman tract, said corner being on the west line of County road #126, kno:•rn as S. W. 72nd Avenue; thence easterly across said road to the south- west corner of that tract of land conveyed to Fought and Company, Inc. as described in Book 447, Page 498, Deed Records of Washington County; thence South 890 49' east a d;stance of 498.4 feet to the northeast corner of that tract of land conveyed to A. T. Nelson and Doris E. Nelson as described in Book 665, Page 425 Deed Record said County; thence South 00 09' west a distance of 322.53 feet to the southeast corner of said Nelson tract; thence continuing south across S. W. Bonita Road to a point on the northerly line of lot 4 Bonita Gardens, said point being easterly of the northwest corner of lot 4 a distance of 10.4 feet more or less; thence easterly along the north line of said lot 4 a distance of 81.6 feet, more or less, thence south along a line 92 feet easterly and parallel with the westerly line of lot 4 a distance of 473 feet; thence easterl.y alor.-' the northerly line of Lot 5, across a vacated alley, and continuing along the northerly line of Lot 2 of said Bonita Gardens a distance of 638.90 feet to a point on the westerly right-of-way line of the R. H. Baldock Freeway; thence southerly along said right-of-way a distance of 1012 feet to point 132 feet southerly of the southerly line of Lot 1, of said Bonita Gardens_ thence westerly along a lire 132 feet southerly of and parallel with the southerly line of Lots 1, 6 and 7 of said Bonita Gardens a distance of. 1208.30 feet to the easterly right-of-way line of S. W. 72nd Avenue (county road #126); thence northerly along the easterly right-of-way line at S. W. 72nd Avenue a distance of 577.50 ILI feet; thence easterly along the northerly line of that land described in an Indenture and recorded in Book, 509, Page 408 ' Deed Records of said county a distance of 487.40 feet to a point on the westerly line of Lot 5 of Bonita Gardens; thence northerly along the west line of said Lot 5 a distance of 434.50 feet to the place of beginning. Section 5: Inasmuch as the hearing of the petition for annexation of the lands herein described should be conducted with the least possible delay, an emergency is hereby declared to exist, and it is declared to be necessary for the peace, health and safety of the City of Tigard that this ordinance become effective upon its passage by the Council and signature by the Mayor.
