AN ORDINANCE SETTING HEARING WITH RESPFr.T TO PROPOSED ANNEXA-
TION OF THE LANDS OF L. W. CHRISTEN and BERTHA C. CHRISTEN
in Section 36, TIS, R1W, W.M.,

WASHINGTON COUNTY, OREGON, AND DIRECTING GIVING OF NOTICE THEREOF.
WHEREAS, there has heretofore been filed with the City Re-
corder of the City of Tigard, petition for annexation of certain
lands in Section 36, T1S, R1W, W.M.,
Washington County, Oregon, as hereinafter described; and
.WHEREAS, said premises are contiguous to the City of Tigard
and not within the corporate limits of any other City, and lie
Wholly within the County of Washington, State of Oregon; and
WHEREAS, it appears that said premises may properly be i
annexed to the City of Tigard without submitting the question to
the registered voters of the territory, since the owners thereof,
L. W. CHRISTEN and BERTHA C. CHRISTEN
have by signed petition requested and consented to said annexation;
NOW, THEREFORE,
THE CITY OF TIGARD ORDAIN:. !S FOLLOWS:
Section 1: That the City Council of the City of Tigard does hereby
elect to dispense with submitting the question of the
annexation of the hereinafter described premises to the registered
voters of the City.
Section 2: That Monday, the13th day of November 196_y_ at the
hear of 3:00 p.m., at the City Hall in the City of
Tigard, be, and the same is, hereby fixed as the date, time and place
for public hearing before the City Council of Tigard of the petition E
of L. W. CHRISTEN et ux
for annexation of the hereinafter described lands to the City of
Tigard, and all registered voters of the City may appear at said
time and place and be heard on the..question of said annexation. F
s Section 3: The City Recorder of the City of Tigard be, and she is
,= hereby, directed to give notice of said hearing by pub-
lication once each geek for two successive reeks, or three publish-

ings in all, prior to the date of the hearing, in the Tigard Times,
a newspaper of general circulation in the City, and said Recorder
, I be., and she is hereby further directed to post notices of said hear- '
t Ing in four public places in the City of Tigard for a like period.

Section 4: That the area proposed to be annexed be and the same
is hereby described as follows:

— A tract of land in Section 36, Township 1 South, Range 1 West of
Willamette Pieridian described as follows:
Beginning at the Northeast corner of Palmer Acres and running
thence South 1°38' West along the east line of Palmer Acres
1019.8 feet to the Northwest corner of that certain tract conveyed
to Bert Turnbow by deed recorded May 8, 1939 in Book 180, pa;e 331;
thence South 85°41' Gast along the North line of said Turnbow tract
538.5 feet to the Southwest corner of that certain tract conveyed
to A. Lippman by deed in Book 153, page 313; thence North 00112'
e West 1016 feet to the Southeast corner of that certain tract
described in mortgage to L. W. Lowry et ux recorded May 24, 1950,
in Mortgage Look 244, page 49; thence North 85022-1/2' West 5115.5
feet to t-1c place of beginning.

Section 5 Inasmuch as the hearing of the petition for annexation
of the lands herein described should be conducted with
the least possible delay, an emergenny is hereby declared to exi.^t,
and it is declared to be necessary for the peace, health and safety
of the City of 'Tigard Lhat this ordinance become effective upon its
passage by the Council and signature by the Mayor.
PASSED: By the Council, by unanimous vote of all Council members
present, after being read three times by number and
title only, this 9th _ day of October , 196Z.
