ORDINANCE No.67-
AN ORDINANCE AMENDING AND SUPPLEMENTINC ORDINANCE No.66-20. AS HERE-
TOFORE AMENDED AND SUPPLEiISNTED, TO CONFORM Sections 482.999(T),483.050(T)
483.302(T), 483.304(T), 483.402(T), 483.508(T) and 483.518(T) THEREOF
TO NPPLICABLF SECTIONS OF OREGON REVISED STATUTES AS AMENDED BY APPLI-
CABLE CHAPTERS OF OREGON LAWS OF 1967, ADDING NEW SECTIONS 483.480(T),
483.482(T), 484.330(T) and 484.332(T) TO THE MOTOR VEHICLE CODE OF
THE CITY OF TIGARD, OREGON; AND DECLARING AN EMERGENCY.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: Chapter III, Section 482.999(T) (Penalties) of Ordinance
T No.66-20, be,and the same ib hereby amended to conform
to Section 482.990 Oregon Revised Statutes as amended by Section 1
of Chapter 579 Oregon Laws of 1967 EXCEPT that sub-section (3) of
§482.990 O.R.S. as so amended, is deleted therefrom hereunder.
Section 2: Chapter IV of Ordinance No.66-20 as heretofore amended
and supplemented, be, and the same is hereby amended
and supplemented as follows:
(a) Section 483.050(T) shall conform to provisions
of §483.050 Oregon Revised Statutes as amended
by Chapter 212 Oregon Laws of 1967.
(b) Section 483.3002(T) shall conform t.,, provisions
of §483.302 Oregon Revised Statutes as amended
by Section 3 of Chapter 237 Oregon Laws of 1967.
(c) Section 483.304(T) shall conform to provisions
of §483.304 Oregon Revised Statutes as amended
by Section 4 of Chapter 237 Oregon Laws of 1967.
(d) Section 483.402(T) shall conform to provisions
of §483.402 Oregon Revised Statutes as amended
by Chapter 490 Oregon Laws of 1967.
(e) Section 483.508(T) shall conform to provisions
of §483.508 Oregon Revised Statutes as amended
by Chapter 192 Oregon Laws of 1967.
(f) Section 483.518(T) shall conform to provisions
of §483.518 Oregon Revised Statutes as amended
by Chapter 149 Oregon Laws of 1967.
Section 3: Chapter IV of Ordinance No.66-20 as heretofore amended
and supplemented, be, and the same is hereby, amended
and supplemented to add thereto the following new sections:
(a) Section 483.480(T): No person shall operate or
ride a motorcycle within the corporate limits of
theCity of Tigard on or after January 1, 1968
unless he is wearing protective headgear of a type j

approved by the Oregon State Department of Motor
Vehicles as prescribed by Section 2 of Chapter
393, Oregon Laws of 1967.
` (b) Section 483.482('T): Section 2 of Chapter 237,
Oregon Laws of 1967, be, and the same is, hereby
adopted, reading as follows:
"On a highway that has only two lanes for traffic
moving in opposite directions, when an overtaking
vehicle being operated in conformity with ORS483.102
does not have a clear lane for passing as required
by subsection (1) of ORS 483.308, the driver of a
slower-moving, overtaken vehicle shall, at the
first opportunity, whenever sufficient area for a
safe turnout exists, move the overtaken vehicle
off the main-traveled portion of the highway until
the overtaking vehicle is safely clear of the
overtaken vehicle."
Section 4: Chapter V of Ordinance No.66-20, be, and the same is,
hereby amended and supplemented to add thereto. the
following new sections:
i
(a) Section 484.330(T): 9s used in this chapter, unless
.? the context otherwise requires, "owner" means the
person having all the incidents of ownership in a
vehicle or where the incidents of ownership are in
different persons, the person, other than a security
interest holder or lessor, entitled to the possession
of a vehicle under a security agreement, or a lease
for a term of 10 or more successive days.
(b) vection 484.332(T):
(1) When a person is convicted for driving a
motor vehicle in violation of ORS 482.650, any motor
vehicle of which the convtoted person is the owner
shall be ordered impounded for from 30 to 120 days
from Judgment. He shall be liable for the expenses
incurred in the removal and storage of the vehicle
i under this subsection, whether or not the vehicle
is returned to him. The vehicle shall be returned
to the person convicted only upon payment of such
expenses.
t (2). If redemption, is not made or the vehicle is
not returned au provided in this section, within
$ 34 days after the time set for the return of the
vehicle in the impounding order, the vehicle may
_ be disposed of in accordance with Chapter VII of
Ordinance No.66-20 - rotor Vehicle Code of the
City of Tigard.

MOTOR VEHICLE CODE OF THE CITY OF TIGARD (Ordinance No.66:.20., as
amended) be brought into conformity with Oregon Laws of 1967 of
the Oregon Legislative Asseiably with the least possible delay, an
emergency hereby is declared to exist and this ordinance, except
where otherwise expressly stated, shall become effective upon its
passage by the City Council and approval by the Mayor.
