ORDINANCE N0.67- 20
AN ORDINANCE ANNEXING TO THE CITY OF TIGARD, OREGON, A CERTAIN
AREA CONTIGUOUS TO THE CITY, INCLUDING "PINEBROOK" SUBDIVISION,
WASHINGTON COUNTY, OREGON
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: The Council of the City of Tigard finds that pursuant
to Ordinance #66-47 duly passed by the Council on Decem-
ber 12, 1966 and in accordance therewith, an election was duly held
on January 19, 1967 in the area hereinafter described, whereat
there was submitted to the legal voters of said territory the pro-
position of whether or not the legal voters thereof favored the
annexation of said area to the City of Tigard; and the Council further
finds that a canvass of the votes cast was duly conducted by the
City Council at its regular meeting of January 23, 1967 and by reso-
lution at said meeting it was declared by the Counci that a majority
of the votes cast by the legal voters in the territory proposed to
be annexed, favored the annexation proposition; and the Council fur-
ther finds that by Ordinance #67-6 duly passed by the Council at its
regular meeting of January 23, 3967, the Council elected to dispense

istered voters of the City and, pursuant to Sea.222.120 O.R.S., the
Council by said ordinance called a public hearing to be held at 8:00
p.m, on Monday, February 13, 1967 and directed that due and legal
notice of said hearing be given as required bylaw, and that the City
Recorder, under authority and direction of the Council, give ertofe
of said hearing by publication in the Tigard Times a newspap
general circulation and published in the City of Tigard, once each
week for two successive weeks, or three publishings in all, to-wit:
on January 26, 1967, February 2, 1967 and February 9, 1967, and
Further, that the City Recorder pest notice of said hearing in four
public and conspicuous places within the City of Tigard for a like
period; that an affidavit of said publication, together with the City
Recorder' affidavit with respect to said posting, is on file herein.
The Council finds that the said hearing of February 13,
1967 was duly opened at the time and place as by said ordinance pro-
vided, and various persons were heard, and by resolution of the City
Council, duly passed at said meeting, the hearing was recessed and
continued to March 13, 1.967 at 8:00 p.m. to enable the registered
voters of the City to appear and be further heard on the question of
said annexation.
The Council further finds that by Ordinance#67-11 duly
passed at its regular meeting of February 27, 1967, said resolution
was duly ratified and confirmed; that the continuation of said hear-
ing to March 13: 1967 was duly publicized by notice published once
each week for two successive weeks, or three publishings in all, to
wit: on February 23, 1967, March 2, 1967 and March 9, 1967 in the
Tigard Times, a newspaper of general circulation and published in the
City of Tigard, Oregon; that an affidavit of said publication is on
file herein and that notice of said hearing was further given by post-
ing in four public and conspicuous places within the City for a like
period, and that the affidavit of the City Recorder with respect to
said posting is on file herein.

The Council further finds that the hearing as recessed
on February 13, 1967 was duly reconvened by the City Council at the
City Hall on March 13, 1967 at 8:00 p.m., and all registered voters
of the City were afforded an opportunity to be heard, and said hear-
ing was thereupon duly concluded and closed.
Section 2: That the Council of the City of Tigard does hereby
ratify and confirm all prior proceedings pursuant to
said annexation proposal, and does hereby declare that all proceed-
ings have been duly and regularly conducted in the manner provided
by law, and the Council does hereby confirm its prior election to
dispense with submitting to the registered voters of the City the
question of the annexation to the City of the hereinafter described
territory.
Section 3: That the Council of the City of Tigard does hereby pro-
claim the annexation of the hereinafter described terri-
tory to the City of Tigard, and that the said territory be, and the
same is hereby, declared to be included within the corporate limits
of the City of Tigard.

Section 5: That the Recorder of the City of Tigard be, and she is I
hereby directed, within 10 days from the date hereof, to
make and submit to the Secretary of State of Oregon:
a. A certified copy of Ordinance #66-47, calling an election
in the territory proposed to be annexed
b. An abstract of the vote showing the whole number of voters
voting in the territory, the number of votes cast for
the annexation and the number of votes cast against
the annexation.
c. A certified copy of Ordinance #67-6 whereby the City
Council declared that no election is required in the
City, and setting a public hearing
d. A certified copy of Ordinance #67-11 confirming the
recess of the hearing and resetting same.
e. A certified copy of this ordinance of annexation,
and to file herein the acknowledgment of the Secretary of State of
said filing.
Section 6: That the Recorder of the City of Tigard be, and she is
hereby directed, within 10 days from the date hereof, to
file with each of the Department of Revenue and Taxation and the
Department of hecords and Elections of the County of Washington, the
following:
a. A certified copy of this ordinance of annexation
b. A certified copy of Ordinance #67-6
and that a copy of this Ordinance be directed to the Office of the
Washington County Surveyor, and to file herein the acknowledgments
of said Departments of said filings.
Section 7: The annexation hereby ordained shall be effective on the
"-'-� date of the filing with the Secretary of State of Oregon
of copies of the proceedings hereinabove required to be filed, subject
to the filing, if any, of a referendum petition in accordance with
the provisions of Chapter 222 Oregon Revised Statutes.
PASSED; By the Council, by unanimous vote of all Council members
present, after being read three times by title and
