ORDINANCE No. 66-13
AN ORDINANCE GRANTING A ZONE CHANGE WITH RESPECT TO THE LANDS
OF SOUTHEAST COMPANY (Fred Meyer,Ine.) IN SECTION 36, TOWNSHIP 1
SOUTH, RANGE 1 WEST, W.M., TIGARD, WASHINGTON COUNTY, OREGON, FROM
R-5 TO C-2.
WHEREAS, the hereinafter described lands, by action of the
City Council of the City of Tigard, Oregon, pursuant to the Zoning
Code of said city, have heretofore been limited in use to those
uses permitted by said Code under, and have been classified and
zoned for, R-5 (Residential) purposes; and
WHEREAS, pursuant to prescribed procedures, the owner of said
lands has applied to the City of Tigard for reclassification of said
property and change of zone thereof to permit the use thereof for
C-2 (General Commercial) purposes, and said application has been
duly publicized and public hearing held by the City Planning Commis-
sion on February ;, 1966 _, after due and legal notice; and
WHEREAS, the City Planning Commission has recommended approval
of said zone change to the City Council, and due and legal notice of
City Council hearing having been given by publication in the Tigard
Times, and the City Council having heard same at its special meeting
of March 16, 1966, and the City Council finding that no public detri-
ment will result from the granting of said petition, and that it is
In the public interest that said zone change be approved, and the
property re-.zoned from R-5 (Residential) to C-2 (General Commercial);
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That the following described lands be, and the same are,
hereby reclassified for General Commercial use and are
hereby zoned as C-2, for use in accordance with the C-2 General
Commercial classification of the Zoning Code of the City of Tigard,
and subject to all conditions, limitations and requirements thereof,
which Zoning Code with respect to the C-2 classification is by
reference herein made a part hereof:
A tract of ].and in Sec.36, T1S, R1W, W.M.,Washington
County, Oregon, more particularly described az follows:
Beginning at an iron pipe at the Southwest corner of
Block "A", Metzger Acre Tracts, a duly recorded subdivision
In Washington County, Oregon; thence N0015 W. along the
West line of said Block "A", 131.94 feet to the Northwest
corner thereof.; thence N 890521E. along the North line of
said Block "A", 145 feet to an iron pipe; thence 80°15'E
133.76 feet to an iron pipe on the South line of said
Block "A",said point being a point on the North line of
that certain tract described in deed to Southeast Company,
an Oregon corporation, recorded June 24, 1965 in Book 558,
page 42, Records of Washington County; thence N88°56' E.
along the North line of said Southeast Company tract, 265.30
feet to a point on the Westerly line of S.W.71st Avenue;

thence S 2p003' E. along said Westerly line 273.85 feet
to a point on the Northwesterly right of way of S.W.Barbur
Blvd., said point being the most Easterly corner of that
certain tract described in deed to M. McHenry, a single
woman, recorded May 6, 1963, in Bk.486,page 232, said
records; thence along the Northwesterly boundary of
S.W.Barbur Blvd.,the following courses and distances:
S 53047120" W. 117.44 feet; N 36012,40" W. 10.0 feet;
S 53047120" W. 599.66 feet; S 36012,4011 E. 10.0 feet;
_ S 5304712011 W. 392.13 feet to an iron pipe on the WEst
line of that certain tract described in deed to Jack
Wersh .a single man, recorded Oct. 6,1965 in Bk-572,
page A4, said records; thence N 0°12' E. along the West
line of said Wersh tract 445.4 feet to the Northwest
corner thereof; thence S 89010' E. along the North line
of said Wersh tract 20.60 feet to a point, said point
being the Southeast corner of that certain tract de-
scribed in deed to David J. Nelson et ux, recorded April
29, 1952 in Bk-332, p•129, Washington County Deed Records;
thence N 0'12' E. along the East line of said Nelson
tract 452.0 feet to an iron pipe on the South boundary
of Metzger Aare tracts; thence S 890001 E. along said
South boundary 328.10 feet to the point of beginning.
Section 2: :Inasmuch as it is necessary for the orderly development
and use of the area above designated, and for the
preservation of the peace and safety of the City of Tigard, that
said zone change be made, an emergency is hereby declared to exist
and this Ordinance shall be in full force and effect from and after
its passage by the Council.
PASSED: By unanimous vote of all Council members present, after
being read three times by title only, this
16th day of March, 1966.
