AN ORDINANCE GRANTING A ZONE CHANGE WITH RESPECT TO THE
.LANDS OF Arthur A. Biederman, BEING TAX LOTS 2300 and 2301, 2 S 1,
2 BD, at-.0030 S. W. WALNUT AVENUE, TIGARD, OREGON, FROM R-5 to A-2.
WHEREAS, the hereinafter described lands, by action of the
City Council of the City of Tigard, Oregon, pursuant to the Zoning
Code of said city, have heretofore been limited in use to those
uses permitted by said Code under, and have been classified and
zoned for, R-5 (Residential) purposes; and
WHEREAS, pursuant to prescribed procedures, the owner of
said lands has applied to the City of Tigard for reclassification
of said property and change of zone thereof to permit the use
thereof for A-2 (Multiple Dwelling) purposes, and said application
has been duly publicized and public hearing held by the City Plan-
ning Commission on darnarY 20, ',9�^ , after due and legal notice;
WHEREAS, the City Planning Commission has recommended approval
of said zone change to the City Council, and due and legal notice of
City Council hearing having been given by publication in the Tigard
Times, and the City Council having heard same at its regular meeting
of February 14, 1966, and the City Council finding that no public
detriment will result from the granting of said petition, and that
it is in the public interest that said zone change be approved, and
the property re-zoned from R-5 (Residential) to A-2 (Multiple
Dwelling);
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS AS HOLLOWS:
Section 7.: That the following described lande be, and the same are
hereby re-classified for Multiple Dwelling use and are
hereby zoned as A-2, for use in accordance with the A-2 Multiple
Dwelling classification of the Zoning Code of the City of Tigard, and
subject to all conditions, limitations and requirements thereof,
which Zoning Code with respect to the A-2 classification is by refer-
ence herein made a part hereof:
A parcel of land in Lot 40, North Tigardville Addition,
in the City of Tigard, in Section 2, T2S, R1W, W.M.,
Washington County, Oregon and being more particularly
described as follows:
Beginning at the most Northerly corner of said
Lot 40, thence S57038' E. along the Northeasterly line
of said Lot 40, 215.82 feet, to the most Easterly
corner thereof; thence S420I21W. along the Southeasterly
line thereof 219.35 feet to a point; thence N52°20' W.
205.15 feet to a point on the Northwesterly line thereof;
thence N39053' E. along the said Northwesterly line,
199.85 feet to the point of beginning; EXCEPTING rights
of the public in the Northeasterly 20.0 feet and the
Northwesterly 20 feet thereof, being in public streets.

Section 2: This ordinance shall be effective on the 31st day
after its enactment by the City Council of Tigard,
Oregon.
PASSED: By unanimous vote of all Council members present,
after bein;; read three times by title only, this
14th day of February, 1966.
