AN ORDINANCE SE11IN3 HEARING WITH RESPECT TO PROPOSED ANNEXA-
TION OF THE LANDS OF Air-King Mfg. Corp., et al, in Section 2 _
T2S, R1W, W.M., Washington County, Oregon, COMMONLY KNOWN AS THE
"BURNHAM STREET ANNEXATION" AND DIRECTING GIVING OF NOTICE THEREOF.

WHEREAS, a petition for the<aanexation of the following de-
scribed lands has been duly filed with the City Recorder of the City
of Tigard, said petition alleging that the petitioners who executed
same are each and all of the owners of the real property therein
described, and as hereinafter described, and that each of them has
consented to the annexation of said premises without submitting of
same to a vote; and
WHEREAS, said premises are contiguous to the City of Ti3ard
and are not within the corporate limits of any other city and lie
wholly within the County of Washington and State of Oregon; and
WHEREAS, it appears that said premises may properly be
annexed to the City of Tigard without submitting the question to
the registered voters of the City;
NOW, THEREFORE,
THE CITY OF TICARD ORDAINS AS FOLLOWS:
_Section 1. That the City Council of the City of Tigard does hereby
elect to dispense with the submitting of the question
of annexation of the hereinafter described premises to the registered
voters of the City of Tigard.
Sec3an.2: That Monday, the 14th day of February, 1966 at the hour
-` of 8:00 p,m., in the Council Chamber, City Hall, Main
Street, City of Tigard, Oregon, be, and the same are, hereby fixed
as the date, time and place for a public hearing by the City Council
of the petition of AIR-KING MFG. CORP., TOM L. BARRETT and ALICE E.
BARRETT, GEORGE E. SPARLING, HENRY 0. ENNEN and BERNICE L. ENNEN for
annexation of the hereinafter described lands to the City of Tigard,
and all registered voters of the City may appear at said time and
place and be heard on the question of said annexation.
Section 3: That the City Recorder of the City of Tigard be, andshe
is hereby, directed to give notice of said hearing by

publication once each week for two successive weeks, or three pub-
lishings in all, prior to the date of said hearing, in the Tigard
Times, a newspaper of general circulation in the City of Tigard, and
the City Recorder further be, and she is hereby directed to post
notices of said hearing in four public places within the City of
Tigard for a like period.

` Section fie: That the area proposed to be annexed be, and the same
is, hereby described as set forth on the attached sheet
headed "DESCRIPTION", which by reference herein is made part hereof.

Section 5: That inasmuch as it is for the benefit of the City of
Tigard and those interested in the petition for annexa-
-tion that this matter be heard with the least possible delay, and
it is necessary for the peace, health and safety of the City of
`r Tigard that .this ordinance become effective with the least possible
delay, an emergency is hereby declared and this ordinance shall be-
come effective upon its passage by the City. Council and approval by
the Mayor.

DESCRIPTION
Beginning at the most easterly corner of Lot 6, BURNHAM TRACT in the
center of S.W. Burnham Street in Section 2, T2S, R1W, W.M. and running
thence easterly along the center of S. W. Burnham Street 527 feet, more
or leas, to its intersection with the centerline of County Road 0227,
new known as State Highway 237; thence southerly along said State Hiaithuay
centerline to the easterly extenslon of the south line of that certain
tract of land in said Section 2 conveyed to George Sperling at nx by
deed recorded on page 9 in Book 249, Washington County, Oregon, Dead
