t AN ORDINANCE ANNERING TO THE CITY OF TIGARD, OREGON, LANDS
COMPRISING A PORTION OF LOT 20, FREWING ORCHARD TRACTS, AND THAT
PORTION OF S. W. PACIFIC HIGHWAY (99W) ABUTTING ON LOT 21 and
ABUTTING ON A PORTION OF LOT 20, FREWINGORCHARD TRACTS.
WHEREAS, a petition for the annexation of the hereinafter
described lands, in due and legal form, was presented to the City
Council of the City of Tigard on the 27th day of July, 1964; and
WHEREAS, all the owners of the said Lands or any portion

arew: to the City of Tigard; and
WHEREAS, the area hereinafter described is contiguous to the
City of Tigard and is wholly within the County of Washington and
none of said area is included within the boundaries of any other
Incorporated city; and
WHEREAS, by Ordinance No. 64-10 duly passed by the City Coun-
cil of the City of Tigard on the 27th day of. July, 1964, the City
Council of the City of Tigard did elect to dispense with submitting
the question of annexation of said area to the registered voters,
and a hearing was called to be held on the 17th day of August, 1964
at 8 p.m. at the City Hall on Main Street in the City of Tigard, with
respect to said petition for the annexation of the hereinafter
described area; and
WHEREAS, notice of said hearing was given by publication
once each week for two successive weeks, or three publishings in
all, prior to said hearing in the Tigard Times, a newspaper of
general circulation in the City of Tigard, and by posting notice
of said hearing in four public places within the City of Tigard,
as more fully appears from the affidavits of publication and
posting in the records and files of the City of Tigard; and -

and a hearing with respect to said petition was duly and
regularly held at the regular meeting of the City Council
on August 17, 1964, and it was thereafter determined that
additional area within the boundaries of Pacific Highway West
should be included within the annexation proposal and request
was duly made to the State of Oregon through its Highway
Commission for its consent with respect to said area within
` said hi hway and contiguous to the boundaries of the city and
l to the lands to be annexed, and said consnet was duly granted;
WHEREAS, by Ordinance No. 64-21 of the City of Tigard
the said petition for annexation together with said additional
area within the boundaries of Pacific Highway West wwas duly

set for re-hearing on Monday cue 14U. ,
by said ordinance the City Couboil elected to dispense with the
submitting of the question to the registered voters of the City;
WHEREAS, due and legal notice was given by publication and
postingin the manner provided by law of the said re-hearing
and sad re-hearing was duly and regularly held at the CityIn`l
Hall within the City of Tigard on the 14th day of uecewucr —.1
at 4 regular meeting of the City Council, whereat, after due
deliberation the City Council in regular meeting abScw— Q
did pass a motion favoring the annexation of the following
described area; NOW THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That the following described lands, including that
portion thereof within the boundaries of Pacific
Highway West, be and the same are hereby:- nnexed to the City of
Tigard, Oregon, and the boundaries of the City of Tigard, be
and they are hereby extended to include the same:
Beginning at the most westerly corner of Lot 2, FREWINGS
ORDHARD TRACTS on the northwesterly line of the Geo. Richard-
son D. L. C."No. 38 in Section 2, T. 2 S. R 1 W. W. M. and
ro nning thence S. 43*47'E, along the southwesterly boundary of
said Lot 2 to the southeasterly right-of-way boundayy of H. W.
Pacific Highways thence southwestcrly along said highway boundary
to the northeasterly line of Lot 20, FREWING S ORCHARD TRACTS
in the center of S. W. Frewing Street; thence S. 530 16 E.
along aid northeasterly line of Lot 20 to the most easterly
corner of the certain tract of land 6n said Lot 20 conveyed to
Vance R. Lee, et al by deed recorded on Pag 132 of Deed Book 506
Washington County, Oregon Deed Records; thence southwesterly to
the most southerly corner of said Lee Tract; thence northwesterly
to;the most westerly corner of said Lee Tract on the northwesterly
line of said Geo. Righardson,D. L. C. No. 38; thence N. 45 12 E.
along said cldilm line 504 feet, more or less to the place of
beginning, in the County of Washington and State of'Oregon.
Section 2: That the Recorder of the City of Tigard be and he
is hereby directed to make, -certify, and submit
to the Secretary of State of Oregon:

(2y A copy of the petition for annexation and
a copy of consent to annexation
