ORDINANCE NO. 63- �
AN ORDINANCE GRANTING A ?ANE CHANGE WITH RESPECT TO LANDS
OF DEAN T. WRIGHT, IN SECTION 2, T014NSHIP 2 SOUTH, RANGE 1 WEST,
W.M., WASHINGTON COUNTY, OREGON (NORTH TIGARDVILLE ADDITION)
WHEREAS, the hereinafter described lands, by action of the
City Council of the City of Tigard, Oregon, pursuant to the Zoning
Code of said city, have heretofore been limited in use to those
usas a +rrPd by said Code under, and have been classified and
zoned for, A-2 (Apartment Residentxai) purpotw6, a=.
WHEREAS, pursuant to prescribed procedures, the owner of
said lands has applied to the City of Tigard for reclassification
of said property and change of zone thereof to permit the use
thereof for C-2 (General Commercial) purposes, and said application
was duly publidized and public hearing held after legal notice
thereof, on the 24th day of June, 1963; and
WHEREAS, having afforded all interested persons an oppor-
tunity to be heard with respect to said application, and the City
Co•.:ncil f4"Mng that no public:: detriment will resu'LL from the
granting of said petition, and that it is in the public interest
that said change be approved and the property rezoned fr^m A-2
to C-2.
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS.
Section 1: That the following described lands in Section 2,
Township 2 South, Range 1 West, W.M., Washington
County Oregon, in the City of Tigard be, and the same are here-
by reclassified for general commercial. use, and are hereby zoned
as C-2 (General Commercial), for use in accordance with the C-2
Comm
classification of the Zoning Code of the City of Tigard,
Oregon, and subject to all conditions, limitations and requirements
thereof, which Zoning Code with respect to the C-2 classification
is by reference herein made a part hereof:
The North 78 feet of Lot 36, NORTH TIGARDVILLE ADDITION,
as shown on the duly recorded map and plat, in the County
of Washington, State of Oregon, EXCEPTING therefrom a
parcel of land beginning at the easterly corner of said
Lot 36; thence North 44 51' West, along the Northeasterly
line of said Lot 36, a distance of 8.3 feet to a point
which is opposite and 40 feet distant from Station ill
plus 27.8 on the relocated centerline of the Pacific
Highway West; thence South 45 45 30 West, parallel to
'said center line, a distance of 78 feet to the Southwest

line of the pnperty; thence South 44 41 East, along
said property line, a distance of 8.9 feet to the South-
easterly line of Lot 36; thence North 44 19 East, along

said Lot line, a distance of 78 feet to the point of
beginning; SUBJECT TO conditions and restrictions con-
tained in Deed recorded April 6 1907 in Deed Book 74
3 ppage 474- in Deed recorded Mardi 10, 1907 in Deed Book�i
75 page 104 and Deed recorded March 6, 1908 in Deed
Book 79 page 22, reference to which is hereby made; also
certain restrictions of record set out ir. Deed to the
State of Oregon, by aid thru its State Highway Commission,
recorded October 10, 1951 in Deed Book 325 page 544, and
a slope easement recorded in Deed Book 325 page 584.
Section 2: This ordinance shall be effective on the 31st day
after its enactment by the City Council of Tigard,
