a new section authorizi-_no the construction, reconstruc-
tion, repair, operation and maintc-aa.:ce of sewage dis-
posal facilities and a sewer system both wit'_iia and
outside tine corporate limits of said city, and aut_ior-
izing a bond issue to finance said activities, declaring
an eraergency, and calling a special election at waich
the proposed charter amendment shall be submitted to the
voters.
THE CITY OF TIGARD ORDAINS AS FOLL06,TS:
^,ect'i nr, 1. T sere shall be, and there is hereby, adopted,
approved and authorized as amendment to the City Charter of tine
City of Tigard, Oregon, by addin a new section thereto to be
numbered Section 41 of Chapter readin-, as follows:
91Section 41. The City of Tigard small be, and it is hereby
.empowered and authorized to coust-ruct, reconstruct, finance,
maintain, repair and operate sewage disposal facilities and
a sewer system both within and outside the corporate limits
of the City of Tigard, together with all necessary lines,
pumps, machinery, structures and other equipment and
accessories necessary or desirable in connection therewith,
and to sell and furnish sewer service aid disposal services
to persons, firms and corporatiais both within and outside
the corporate limits of the Cid of Tigard. The City of
Tigard and the Qbuncil thereof shall be, and are hereby,
authorized to perform any and all acts necessary and de-
sirable to accomplish and carry out the foregoing. With-
out limiting the foregoing general authority, the City of
Tigard and the City Council thereof is hereby specifically
authorized and empowered to do and perform the following
acts:

1. To construct, reconstruct, repair, operate and
maintain itself or to contract for tine construction or re-
construction of sewage disposal facilities and system of
sewer works and lines both within and outside the city
limits and to repair, operate and maintain a complete system
of swwer works, lines and all appurtenances thereof, for
the purpose of supplying sewer service and disposal to
users both within and outside the cit, limits.
112. To provide for the payment of costs of construe-
`tion of said sewer service and disposal system and sewer
lines and the reconstruction, repair and operation and
maintenance thereof, together with all appurtenances the
City Council is authorized to approve, issue and self
additional sewer bonds in the total amount of $150,000 to
mature withirL twenty (20) years from=.the date thereof, and
bearing interest at such-rates and with such other terms
and conditions as may be approved by the Council of the
City of Tigard.

"3. The City of Tigard shall be authorized, without
limitation and subject only to existing outstanding sewer
bonds and the requirements for payment thereof, to pledge
the net revenue to be derived from the operation and use
of the city's sewer system and the sale of services there-
from and to pledge its general credit and taxing power, sub-
ject to existing outstanding bonds for which previous
pledges exist, for the repayment of such bond issue.
"4. Any and all matters that may require action or approval
by the City Council in connectio with the-authorityand

Section 2. A special election is hereby fixed and called to
be held on the lst day of July, 1963, in the Council Room of the
Tigard City :tall for the purpose of submitting to the legal voters
the question of approving or rejecting the foregoing charter amend-
ment, and said election on said question shall be held in accord-
ance with the provisions of the Charter of the City of Tigard and
the applicable election laws of the State of Oregon.
Section 3. The City.Recorder is hereby authorized and di-
rected to cause to have published in the Tigard Times, a newspaper
published and of general circulation in the City of Tigard, Oregon,
notice of said election i-d the issues thereof on June 13, 20 and 27,
1963, and shall further post notices thereof in three public places
in the City of Tigard, Oregon,
-Section 4. The following persons are hereby designated to
serve,as judges and clerks of the said election, who shall take an
oath to support the Constitution of the State of Oregon and of the
United States and to faithfully perform the duties of said offices:

Section 5. The official ballot title for the foregoing
measure as it shall appear upon the official ballot used at the
special election to be held on said 1st day of July, 1963, is
hereby provided, authorized and approved as follows:

Purpose:

City of Tigard adding.,A new section number-

struction, reconstruction, operation main-
tenance and repair of sewage disposal faci-
lities and a sewer system and sewer lines

sum not to exceed $150,000 to finance the same,
and authorizing the pledging of the net revenue NO

Section 6. Inasmuch as the sewage disposal facilities and
sewer lines of the City of Tigard are in urgent need of reconstruc-
tion, replacement or repair and the entire system of waste disposal,
may be further seriously impaired and the public health threatened
by any delay in remedial action, and it is necessary for the peace,
health and safety of the City that this amendment to the City Charter
be submitted without delay, an emergency is hereby declared, to exist,
and this ordinance shall take effect immediately upon its passing
by the City Council and its approval by the Mayor.
Passed by the unanimous vote of all Copncil members present,
after bezn read first in full and then by title,
