AN ORDINANCE SETTING HEARING WITH RESPECT TO PROPOSED
ANNEXATION AND DIRECTING GIVING OF NOTICE THEREOF
WHEREAS, JOSEPH BALOGH and MARTHA 0. BALOGH did on the 12th
day of November, 1962 file with the City Clerk of the City of Tig-
ard, Oregon, a Petition and proposal for annexation of the herein-
after described real property to the City of Tigard, said petition
alleging that petitioners are the sole owners thereof and consent
to the annexation of said premises without submitting the same to
a vote; and
WHEREAS, said premises are contiguous to the City of Tigard
and not within the corporate limits of any other city and lie
wholly within the County of Washington, State of Oregon; and
WHEREAS, it appears that said premises may be properly an-
nexed to the City of Tigard without submitting the question to the
registered voters of zha City;
NOW, THEREFORE:
IT IS ORDAINED BY THE COUNCIL OF THE CITY OF TIGARD
Section 1: That the City Council of the City of Tigard does here-
by elect to dispense with submitting the question of
the annexation of the hereinafter described premises to the regis-
tered voters of the City of Tigard.
Section 2: That Mondathe _/� `day of December 1962 at the
hour of 8:66 pvm., at-the Community Hall on Commercial
Street, in the City of Tigard, be, and the same is hereby, fixed
as the date, time and place for public hearing before the City
Council of Tigard of the Petition of Joseph Balogh and Martha 0.
_ Balogh for annexation of the hereinafter described territory to the
City of Tigard, and all registered voters of the City may appear at
said time and place and be heard on the question of said annexation.
Section 3: The City Clerk of the City of Tigard be, and he is
hereby, directed to give notice of said hearing by
publication once each week for two successive weeks, or three'pub-
lishings in all, pier to the date of the hearing, in the Tigard Times

a newspaper of general circulation in the City and said %ieYk L:,

in four public maces in the City of Tigard for a like period.
Section4: That the area vMposed to be annexed be, and the same
is hereby, described as follows:
The West half, coraiisting of one (1) acre, of the follow-
ing described real property: Beginning at the Northeast
corner of Lot 21 of North Tigardville Addition, as desig-
nated upon the amended plat of said Addition recorded and
on fila in the office of the Recorder of Conveyances of
said county and state, and running thence North 64° 49'
West along the north boundary of said Lot 21, 1.08 chains
to an iron pipe; thence south 16° 00' West 7.70 chains to
an iron pipet_ center

ALSO, all of said Lot 21 of North Tigardville Addition
as designated upon the amended plat of said Addition
recorded and on file in the Office of the Recorder of
Conveyances of said county and state, lying South and
West of the above described real property;
ALSO, all of Lot 22 of North Tigardville Addition as
desiinated upon the amended plat of said Addition re-
corded and on file in the office of the Recorder of ron-
veyances of said county and state, except that tract
cone ed to L. Paul Winn and wife by dedd recorded in
Book 247, page 53.
Section 5: Inasmuch as the hearing of the Petition for annexa-
tion of the area hereinabove described should be con-
ducted `with the least possible delay, an emergency is hereby_de-
claxed to exist, and it is declared to be necessary for the peace,
health and safety of the City of Tigard that this Ordinance become
effective upon its passage by the Council and signature by the Mayor.
