Dear Mr. Shields:
I am in receipt of a copy of your letter to my client, Glenn Hayter, regarding payment of
the outstanding TIF fees for the building at 7400 SW Landmark in Tigard. As you are probably
aware, Mr. Hayter has filed a lawsuit in the Washington County Circuit Court challenging the
City's ability to exact the fee it has demanded from Mr. Hayter. For the reasons we have stated in
the lawsuit, Mr. Hayter does not believe that the City can exact the TIF it is demanding.
In order to avoid an additional lawsuit, Mr. Hayter will pay the TIF fees the City is
demanding. As you indicated in your letter, however, Mr. Hayter is paying the TIF fees under
protest, and believes that the City is acting in an unlawful manner by attempting to collect the
fees, and in threatening Mr. Hayter with a lawsuit if he does not pay the fees by Friday, September
29. By making the TIF payment, Mr. Hayter is not waiving any claims which he has or may have
against the City of Tigard or Washington County.

Dear Mr. Hayter:
Thank you for your Fax of 9/25 and for your declaration that the TIF fees due on the
above property will be paid on Wednesday, 9/27. I appreciate your prompt cooperation
in this matter.
Upon payment of the outstanding fees we will issue the Certificate of Occupancy which
will correct the violation and no further enforcement action will be necessary.
Regarding "temporary occupancy" of the premises, there has been no approval by the
City of Tigard of any occupancy of the premises, temporary or otherwise, and the fee
deferral that you requested is only granted on the clear understanding that no occupancy
will be allowed until the fees are paid. If you have received any communication from
the City acknowledging and approving such occupancy, please accept my apology for
any misunderstanding and let me have a copy of the communication so I may correct
the records in the property file.

In accordance with your request, we have completed our construction observation and materials
testing services for the above subject project and site. As you, are aware, we previously
performed a Geotechnical Investigation for the project the results of which were presented in our
formal report to Mr. Lonny Deffenbaugh of Epping / Deffenbaugh Associates, P.C., dated
November 16, 1998.
Specifically, during the period of October 12, 1999 through April 12, 2000, our representatives
have been present at the site on a part -time basis -to observe the site preparation and grading
work associated with the new building addition and parking area. During this period, we have
observed and approved the stripping of existing vegetation and topsoil materials as well as other
unsuitable subgrade soils from both the proposed new building addition footprint and proposed
parking area.. Additionally, we have monitored the placement and compaction of various
structural fill materials used for support of the new building addition as well as the proposed new
parking lot. Further, we have checked the condition of the building addition footing excavations
prior to the placement of structural concrete to evaluate the suitability of the exposed bearing
surfaces for support of the foundation loads.
Based on the results of our observations made during our site visits as well as the results of the
field density tests performed on the structural fill materials placed and compacted across the
site, we are of the opinion that the subject new building addition and parking lot areas were
prepared and completed in substantial conformance with our recommendations and as, per the
approved project plans and specifications for the project.

. the following information with regard-to our recent evaluation of the potential for liquefaction at
the above subject project site. As you are aware, we previously performed a Geotechnical
Investigation at the site the results of which were presented in our formal report to Mr. Lonny -
• Deffenbaugh dated November 16, 1998:
• Specifically,, we previously performed a total of-six (6) exploratory backhoe test pits at the-site. -
The test pits were advanced to depths of at least seven (7) feet beneath existing site grades. The .
test pits generally encountered existing gravel and silty fill soils as well as native silty soils. The
fills -
fills
' gravel fills consist of about 8 to 12 inches of compacted. base,rock while the silly. soil . were
found to extend to depths of about 2.5 feet. Below the gravel and 'silty soil fills were soft to
. - medium stiff clayey silt soils. Only minor ground water seepage was encountered at the time of • -•
our excavation work.
As such, based on our recent field exploration work at the site as well as our past experience in
• • the area of the subject site, we are of the opinion that the potential for liquefaction at the site and
• within the soft to medium stiff clayey silt subgrade soils is considered to be low for the earth=
. quake events typically associated- with the Tigard area.

Dear Lonny,
Thanks for the additional information, with it I have concluded a cursory review of your
planned expansion.
Placing the new building, effectively places the existing building in violation of OS SC,
Section 505. With only two yards, the narrowest being 43 feet the allowable increase for
the Type IIA building would be 28.75 %. With the increase allowed for sprinkler, the
building size is limited to 46, 350 sq. ft. That is 3,150 sq. ft. less than the existing
building or nearly 7% over area.
Friday morning I met with Eric McMullen, Assistant ire Marshal for Tualatin Valley
Fire and Rescue (TVFR), and discussed each of my findings and concerns. We
concluded the following violations within the existing building needs to be addressed as
well as those for the proposed building.
Existing Structure: Construction Type II -N.
1. The facility is being used for high piled storage of Class IV commodities.
2. Permits are required for the rack installation and fire protection in
accordance with UFC Standard 81-2.
3. The storage area exceeds 20,000 sq. ft. requiring compliance with UFC,
Table 81 -A and NFPA 231C. Both Eric and I agree the area of the
existing building is not our greatest concern. However, the rack storage
issue shall be addressed.
4. Mitigation of the combustible construction.
Proposed Building: Construction Type II -N.
With the resolve of the existing building's high piled storage and combustible
construction violation the proposed building concept is doable, provided the
following issues are addressed:
1. Fire apparatus access road shall be within 150 feet of all portions of the
southeast exterior walls.

2. General fire protection and life safety requirement listed in the UFC, Table
81 -A shall be provided if the facility is designated for high piled storage
use.

Submittal documents for the above referenced project have been reviewed for conformance with
the applicable 1998 Oregon Specialty Codes and other applicable codes and standards. The
following comments are noted:
1. Provide on Drawing C1 the location of the required accessible parking spaces.
2. At least one accessible route shall be provided within the boundary of the site from public
transportation stops, accessible parking spaces, passenger loading zones if provided,
and public streets or sidewalks to an accessible entry. When more than one building is
located on a site, an accessible route shall be provided between the buildings and
accessible site facilities. The accessible route shall connect to the public way. Provide
walkways and curbside ramps, with detectable warnings, in accordance with OSSC,
Section 1103.1.
3. Vehicular areas. Where an accessible route crosses or adjoins a vehicular way and
where there are no curbs, railings or other elements separating the pedestrian and
vehicular areas detectable by a person who has a severe vision impairment, the
boundary between the areas shall be defined by a marked crossing have a continuous
detectable warning not less than 36 inches wide (914 mm), complying with Section
1109.16. See Oregon Figure 42 (OSSC, Section 1103.2.3.2).
4. Width. All walks on accessible routes shall be continuous with a minimum clear width
complying with Section 1109.4.1 (OSSC, Section 1103.2.4.1).
5. Passing space. Walks less than 60 inches (1524 mm) in continuous width shall provide
passing space at reasonable intervals but not to exceed every 200 feet (60,960 mm)
complying with section 1109.2.1. Passing space may be provided at landings at building
entrances or at the intersection of two walks. The passing space at the intersection of
two walks shall have the minimum possible running slope and a cross slope that does not
exceed 1 unit vertical in 50 units horizontal (2% slope) (OSSC, Section 1103.2.4.4).
6. Shortest accessible route. Accessible parking spaces shall be located on the shortest
practical accessible route to an accessible building entry. In facilities with multiple
accessible building entries with adjacent parking, accessible parking spaces shall be
dispersed and located near the accessible entries. Wherever pratical, the accessible
route shall not cross lanes of vehicular traffic. Where crossing traffic lanes is necessary,
the route shall -be designated marked crossing with detectable warnings at each entrance
to crossing lanes of vehicular traffic (OSSC, Section 1104.4.5).

7. Accessible parking stalls for the disabled shall have signs and pavement markings of the
international symbol of accessibility clearly visible and designated to standards adopted
by the Oregon Department of Transportation [OSSC, Section 1104.1 and ORS 447.233].
8. Revised plans shall show details of the accessible signage, including the van accessible
sign, and parking in accordance with Oregon Department of Transportation minimum
standards (OSSC, Section 1104.1).
9. Provide water quality calculations to Brian Rager.
10. Water Quality Facility observation by Engineer of record.
The owner shall employ the Engineer of record, responsible for the design and ,
specifications of the Water Quality Facility, to perform construction and visual observation {
of the Water Quality Facility for compliance of the design and specifications, at significant
stages, and at completion of the construction. • 1 .
Prior to final occupancy approval of the construction under permit for the site, the
Engineer of record shall provide the City of Tigard, "Attention Plans Examiner" and
"Supevising Inspector" with written confirmation that the Water Quality Facility is in
compliance with the design and specifications of same.

1. Provide a key box (Knox) mounted to the exterior wall 10' above finish grade and
adjacent to the right side of the main entry door. The box shall be of sufficient size to
contain all keys necessary to gain access as required by the Fire Marshal [UFC 902.4]. If
you have any questions regarding this requirement, please contact the Fire Marshal at
526 -2502.
2. COMMERCIAL BUILDINGS - REQUIRED FIRE FLOW: The required fire flow for the
building shall be 4500 gallons per minute (GPM) at 20 psi. Hydrants shall be flow tested
in accordance with NFPA 291. Results shall be submitted to the City of Tigard,. Attn:
Plans Examiner, 13125 SW Hall Blvd., Tigard, OR 97223, on the form enclosed.
3. Provide 2 hydrants in accordance with your agreement with Eric.
4. COMMERCIAL BUILDINGS - FIRE HYDRANTS: No portion of the exterior of a
commercial building shall be located more than 250 feet from a fire hydrant when
measured in an approved manner around the outside of the buidling and along an
approved fire apparatus access roadway. (UFC Sec. 903.4.2.1)
5. FIRE HYDRANT DISTANCE FROM AN ACCESS ROAD: Fire hydrants shall be located
not more than 15 feet from an approved fire apparatus access, roadway. (UFC Sec.
903.4.2.4
6. FIRE HYDRANT /FIRE DEPARTMENT CONNECTION: A fire hydrant shall be located
within 70 feet of a fire department connection (FDC). Fire hydrants and FDC's shall be
located on the same side of the fire apparatus access roadway. (UFC Sec. 903.4.2.5)
FDC locations shll be approved by the building official. (1996 Oregon Structural Specialty
Code, Sec. 904.1.1)

1. The storm drainage plan shall adequately address the number of catch basins required to
handle the parking lot and hard surface runoff. The Uniform Plumbing Specialty Code
[UPSC, Section 1108] allows a maximum 6" outlet on each catch basin, and Table 11 -2
limits the maximum surface area one catch basin can serve to 7,133 square feet at 1%
slope of the horizontal line from the catch basin. Additional catch basins are required to
adequately serve the area.
A. Sizing of all storm drain piping is determined by OPSC, Table 11 -2. If an
engineered system is to be used in lieu of a table 11 -2, two sets of plans
stamped by an engineer licensed in Oregon and the hydrodynamic calculations
must be submitted for review and approval.

This letter is a follow up to your July 27, 1999 memo on the above referenced project.
Existing Building;
• The building tenant (Bonita Products) has retained the services of Ron Melott, fire
protection engineer, to provide a plan for any revisions required to the existing racking
system. I have attached a copy of the purchase order from Bonita Products. Ron will
probably be talking directly with Eric Mullen at TVFR since he has visited the site on
several occasions and has had discussions with the tenant ( Bonita Products).
• We can provide additional protection between the wood construction and the non-
combustible construction. Because the building is existing, it is not possible to provide
"one- hour protection" in the same way we would in a new building. We can provide a
layer of 5/8" type "X" gypsum on the interior face of the existing rooms and smoke
detection on either side of the combustible construction. Note; the existing building plans
call for 5/8" sheetrock on the warehouse side and ' /2" sheetrock on the other. Framing is
shown at 16 inches on center.
• New 3' - 0 "x 7' -0" door can be added along the south side of the existing building. These
doors will not have on grade access do to the existing rail spur.
• This past Tuesday (August 2, 1999) I met with Eric Mullen (TVFR), our civil engineer
and the owner at the job site to address the location of fire hydrants for this project I will
forward your July 27, 1999 memorandum to them.

• Site development review conditions are being addressed to Julia Hajduk at the City of
Tigard planning department. except that "Section V. Other Staff Comments" items
number 1 and 2 were discussed at the project site with Eric Mullen on August 2, 1999.
• We will be resubmitting our site utilities plan and the architectural site plan with the
changes noted above. Also, I am getting another copy of the structural calculations from
our engineer; ou noted that it did _lot appear that one had been submitted.
• The new building addition permit application is essentially a shell permit. The
anticipated tenant has not signed a lease at this time. We will be submitting tenant
improvement plans as soon as we get definition of the size and location of tenants.

PURPOSE:
Several months ago, I discussed a proposed building addition at the above address with Jim Funk
regarding allowable area of the existing building and proposed addition. Since that time we
have proceeded through the site review process in Tigard and will soon be ready to make a
submittal for final approval. Determining the conditions of site approval have helped establish
the feasibility of the proposed project. During the interim time, discussions between the property .
owner and the tenant have resulted in the need for specific definition of where and how area
separation walls will be needed. The purpose of this correspondence is to illustrate the proposed .
building configuration and to describe a framework that will satisfy the provision of the
allowable area portion of the Uniform Building Code (UBC). The resulting plan will make
significant improvement to the existing building's fire, life, safety components in a way that is
not cost prohibitive in the lease market. A preliminary estimate for resetting the current tenant
production equipment to allow an area separation wall near the midpoint of current building
appears to be cost prohibitive . p

The existing building was constructed in 1975 . and is a pre- engineered steel building. The total v
building area is 49,708 square feet (sq. ft.) floor. Incorporated within the building at a Y✓`�
portion of the building east wall perime ‘r (and projecting 4 feet beyond it) is a small 1,900 sq.

ft. wood frame office, and restrooms. here is also a 1,248 sq. ft second floor over the first floor.
Thus,, first floor area breaks down to 47 808 q. ft. of noncombustible pre- engineered steel
building and 1,900 s . ft of wood frme uildin 3.8% wood frame). All

existing building are provided with an Ipproved automatic fire protection system. See the
enclosed plan diagram. Regardless of . he proposed building addition, the existing building
is 1,708 sq. ft. over allowable area by Lurrent UBC standards using all allowable area
increases permitted by the code.

GENERAL REFERENCE INFORMATION:
• The existing building is occupied by a tenant who is not intending to relocate. This tenant
has production equipment and process in place that needs to be maintained.
• If the existing building were co .' : ered T .e • would not be over area

building contains only 3.8„.% co .. - • . construction, preventing it from meeting the
Type II criteria.
• As Type V -N construction, the existing building is over the maximum allowable area
using separation on either 3 or 4 sides. Eliminating, one yard with the building addition
and a two hour fire wall at the existing building end wall will not cause the existing
building to become more noncompliant.
• The building is not perpendicular to the property lines. See enclosed sketch. Calculating
separation on 3 sides, 58% of the building perimeter has 60' - 0" or greater yard
separation and 80% of the perimeter has 50' - 0 ` or greater yard separation. Calculating
the existing building allowable area as type V -N construction with 50' - 0" yards on 3
sides, the existing building allowable area would he 42,000 square feet.
• The existing and proposed building will have good access on all sides. The adjacent
properties are developed and as a result, it is improbable that any encroachment to the
conditions as proposed could occur.
PROPOSED MODIFICATIONS TO EXISTING BUILDING IN CONJUNCTION WITH THE
PROPOSED BUILDING ADDITION:
• We propose the addition of 2 layers of 5/8" type "x" gypsum full height on the interior
face of the wood frame wall which separates the combustible and noncombustible
construction.
• We also propose removing the current window openings in this wall and replacing all
doors with 1 %2 hour rated frames and doors.
• Smoke detection can be added in the existing wood frame section of the building and
connected to the dialer for the fire protection system. Smoke detection is the highest
level of early intervention in potential fire conditions.

SUMMARY ( '
The existing building does not meet the allowable area limitations by current U.B.C. standards
regardless of how many or how much "yard" increase is available. No work is being done in the \ )
existing building and the proposed addition does not increase allowable area noncompliance of 07"
the existing building. The existing building is very close to meeting the requirements for a type 0 ��
II building and also is very close to meeting the yard requirement permitting the maximum n Is
allowable area of a type V -N building. The proposed area separation wall defines the addition
as a new building. In addition, the use of the existing building is to remain. No portion of the _(2
existing building contains an "H" occupancy. Section 104.2.7 Modifications, Oregon Uniform 9 3 ,� a .7
Building Code, 1997 Edition states that, in special conditions where practical difficulties are

CONCLUSIONS AND RECOMMENDATIONS - " - t
. .. From 'a Geotechnical Engineering and, con structability standpoint, we are of the opinion that the '
. site is suitable"for the planned warehouse building(s). and pavement areas provided that the .
recommendations contained within this,report are properly incorporated into the design and. •
construction of the project. • , , ,
' The primary feature of concern at the site is the existing and recently placed clayey silt fill.soil
materials located across the westerly portion of the proposed building area. Although the clayey •
silt fill soil materials appear to have been placed and compacted. with conventional construction .
,equipment, the degree' of'compaction found withinthe clayey silt fill `soil materials was generally
' .below percent of ASTM D =1557 (AASHTO T -180). This is believed to be due in part to the
exposure of the clayey siltfill materials to recent inclement (wet) weather conditions.:ln this
• regard, of the opinion that the existing clayey silt'fill soil materials should be recompacted
to a minimum of at least 92 percent of ASTM D - 1557 ( AASHTO T - 1780). However, due to the
existing and relatively high •moisture contents within the clayey silt fill soil' materials, it is . .
_ _ generally recommended that recompaction 'of the clayey silt fill soil'materials not - be done at this
time .but should "wait until, next spring when dryer weather. is available., .
The following sections of this report present specific recommendations for site preparation and
grading as well as foundation and pavement design and construction for the new warehouse .

Based on the results of our investigation, it is our opinion that°the proposed new warehouse
' building addition may be supported 'directly on the - native medium stiff to stiff silty subgrade soils •
and /or the existing dense (well compacted), silty, sandy gravel aggregate base rock fill materials •
. or by properly placed and compacted structural fill materials with conventional continuous and .
individual spread footings. As such, were foundations•are constructed. on approved medium stiff
to stiff native clayey silt subgrade soils, the dense (well compacted),.silty, sandy gravel: .
,aggregate base rock materials or other properly placed and compacted structural fill
materials; an allowable.contact bearing pressure of about 2,500 pounds per square foot (psf) is •
recommended for design. However, as previously noted; the existing, clayey silty. soil.
- materials located across the westerly portion Of. the planned building site are ,not presently •
:•suitable for direct.support of foundations at this time. Additionally, the placement of from 12 to
- 18 inches of properly compacted crushed aggregate base rock beneath shallow continuous (strip)
