As you recall, I visited your jobsite at 12190 SW James St in Tigard Oregon on January 5, 2012 to oversee the placement of fencing for root protection zones around selected trees per City of Tigard requirements. At your request, the following is a report of my observations. Fencing was placed at or near the drip line of the canopies of four trees to be retained during construction. These trees included two walnuts, one maple, and one plum. The maple is a poorly formed volunteer tree that was growing near a structure which has since been demolished. Due to the demolition of this structure, the tree is perched three to five feet from a three to five foot vertical drop off. As such, protection from construction damage is prevented by this pre existing condition. The fencing follows the top of the vertical drop off and is suitable for root protection under these circumstances. I have discussed construction damage and tree root protection with the general contractor and am satisfied that the tree protection fencing is properly placed. Regular inspections of tree protection zones will be performed for the duration of the project per city requirements. Unfortunately I've discovered an inconsistency that I'm hoping you can clarify. Details are below. For quick reference I'm also including a copy of the arborists report. On November 16 the City authorized the removal of tree #19, declared dead by your arborist in a letter dated November 10. Your tree protection plan shows this tree being located near the east property line. On November 22 we received a site plan from Steve Wilson showing the location of tree protection fencing. On that plan tree #19 is not shown at all, consistent with the letter detailed above. However, tree #4 is present on the site plan but crossed out with the words "removed" written adjacent. This tree is located along the south property line and is shown as preserved in your tree protection plan. Both trees are birches, and both are approximately the same size (16" and 15" respectively). Is it possible there was a mix -up regarding which of the birches is dead and to be removed (i.e. the arborist reported #19 when the dead tree is actually #4)? Or are both proposed for removal? While in the neighborhood I drove by the James Street property and observed what appeared to be a dead birch at the back of the property where #4 is located, and a living birch along the east of the property approximately where #19 is. That said, I'm not an arborist and did not enter the property to verify with any certainty, I am only posing this hypothesis in an attempt at identifying the discrepancy. If you could look into this and get back to me, we can identify how to move this forward as efficiently as possible. Also, I'm going to hold off on preparing the paperwork necessary for the deed restrictions until we clarify which trees are being preserved and which are being removed as a result of your project. On a related but important topic, you still need to pay fees and record your plat with the County. I recommend you coordinate with Mike White on getting those items completed. Before we can approve a plan it has to show all the elements that our approval will cover. 2. The project arborist needs to verify proper installation of the tree protection. This was not done at the partition stage. 3. The street trees need to be labeled by type and size on this building site plan. They are not labeled. 4. You will need to record the tree deed restriction for the trees to be preserved but this is not required yet, it is required prior to final inspection.
