BACKGROUND INFORMATION Property History: The subject parcel is located within the City of Tigard. The property is designated Industrial Park on the Tigard Comprehensive Plan. In 1990, Site Development Review was approved to convert an existing single-family residence to commercial use for the manufacture and retail sales of woolen goods. Approval was also given to construct 'a 1,000 square foot storage shed for various businesses conducted by the owners of the site. In 1999, Sensitive Lands Review approval was given to develop a trail within the 100-year floodplain. No other land-use cases were found to be on file with the City. Site Information and Proposal Descriptions The owner of record of the subject property requests permission to allow a Land Partition to divide a 2.43-acre creek-side parcel into two (2) lots. Parcel #1 will contain 1.57 acres and Parcel #2 will contain 0.79 acres. The purpose of the partition is for the construction of a paved trail through the portion of the property within the floodplain in association with the Fanno Creek Trail alignment project. SECTION IV. PUBLIC COMMENTS No comments were received. • SECTION V. APPLICABLE REVIEW CRITERIA AND FINDINGS Land Partitions, 18.420.010 requires that the proposal be consistent with all of the following standards: The proposed partition complies with all statutory and ordinance requirements and regulations; The proposed partition does not violate any City statutes or ordinances. Therefore, this criterion is met. NOTICE OF TYPE II DECISION MLP1999-00014-SNYDER/CITY OF TIGARD PARTITION PAGE 2 OF 5 • • • There are adequate public facilities available to serve the proposal; Existing sanitary sewer, water, electric and natural gas lines run along Fanno Creek and SW Grant Avenue. Grant Avenue is located within 50 feet of the property's edge and the property has service from SW Tigard Street. The second parcel is located within the floodplain and is proposed to be used for park and trail purposes. Therefore, this criterion is met. All proposed improvements meet City and applicable agency standards; and The only improvement proposed is for the construction of a soft or hard surface trail along Fanno Creek through the floodplain portion of the property. The alignment and design of the trail has previously been approved through a separate City land use application (CPA1999-00001/SLR1999-00003). Therefore, this criterion is met. All proposed lots conform to the specific requirements below: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. The zoning on the property in uestion is Industrial Park; I-P. According to Community Development Code provision 1.530.040, there is no minimum lot size for this zoning district. The lot dimensions of approximately 200 feet by 300 feet of this irregularly shaped lot far exceed the minimum 50-foot width requirement set in the Code. Therefore, this criterion has been met. The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area. The two proposed lots will consist of 1.57 acres and 0.79 acres respectively. There is no • minimum required lot area within the I-P zone. Therefore, this criterion is satisfied. Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot-wide access easement. Parcel 1 has frontage on SW Tigard Street. Parcel 2 will have access to SW Grant Avenue via a 30-foot-wide access easement once the easement is obtained from owners of Washington County tax map 2S102BA, tax lot 02000. The City is in the process of obtaining this easement that will serve to connect this site on both sides to the City's existing trail system. Setbacks shall be as required by the applicable zoning district. The only development proposed is the extension of a paved trail through the property in accordance with the conditions of approval under (CPA1999-00001/SLR1999-00003). Therefore, this criterion does not apply. When the partition lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. • The partition is not a flag lot. No structures are proposed, therefore, this criterion does not apply. NOTICE OF TYPE II DECISION MLP1999-00014-SNYDER/CITY OF TIGARD PARTITION PAGE 3 OF 5 • • • A screen shall be provided along the property line of a lot or record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.745.040. Screening may also be required to maintain privacy for abutting lots and to provide unable outdoor areas for proposed development. The proposed accessway is located within ten feet of the abutting lot. Since the accessway is entirely within the floodplain, the screening provision would best be met through the planting of native vegetation. The placement of a structure or the use of non-native vegetation within the floodplain is prohibited by Tigard Development Code, Chapter 18.775 (Sensitive Lands). The applicant is proposing to screen the accessway with native vegetation which will satisfy this requirement, as well as, the requirements of Chapter 18.797 (Water Resource Overlay). The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire-fighting capabilities. No structure is proposed to be built on the subject parcel, therefore, this criterion does not apply. • Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintain rights shall be recorded with the approved partition map. The accessway is a public pathway and is not designed to serve any additional lots. Therefore, this criterion does not apply. Any accessway shall comply with the standards set forth in Chapter 18.705, Access, Egress, and Circulation. Because the applicant is proposing a 30-foot-wide accessway through the partitioned property, this criterion has been met. FINDING: Based on the analysis above, all of the specific approval standards have not been met. If the applicant complies with the condition specified below, the standards will be met. CONDITION: Submit proof of ownership of the 30-foot-wide easement before final plat approval. ADDITIONAL APPLICABLE STANDARDS Tree Removal — Chapter 18.790 The applicant is not proposing to remove any trees. Therefore, this criterion does not apply. Water Resources (WR) Overlay District— Chapter 18.797 This Chapter is addressed under a previous Sensitive Lands Review approval (SLR1999-00003). Therefore, this criterion has been met. SECTION VI. ADDITIONAL STAFF/AGENCY COMMENTS The City of Tigard Engineering Department and Operations Property Manager were given the opportunity to review the proposal and provided no comments or objections. Approval was also given to construct a 1,000 square foot storage shed for various businesses conducted by the owners of the site. In 1999, Sensitive Lands Review approval was given to develop a trail within the 100year floodplain. No other land-use cases were found to be on file with the City. Site Information and Proposal Descriptions The owner of record of the subject property requests permission to allow a Land Partition to divide a 2.43-acre creek-side parcel into two (2) lots. Parcel #1 will contain 1.57 acres and Parcel #2 will contain 0.79 acres. The purpose of the partition is for the construction of a paved trail through the portion of the property within the floodplain in association with the Fanno Creek Trail alignment project. SECTION IV. PUBLIC COMMENTS No comments were received. SECTION V. APPLICABLE REVIEW CRITERIA AND FINDINGS Land Partitions. 18.420.010 requires that the proposal be consistent with all of the following standards: The proposed partition complies with all statutory and ordinance requirements and regulations; The proposed partition does not violate any City statutes or ordinances. Therefore, this criterion is met. NOTICE OF TYPE II DECISION MLP1999-00014-SNYDER/CITY OF TIGARD PARTITION PAGE 2 OF 5 • There are adequate public facilities available to serve the proposal; Existing sanitary sewer, water, electric and natural gas lines run along Fanno Creek and SW Grant Avenue. Grant Avenue is located within 50 feet of the property's edge and the property has service from SW Tigard Street. The second parcel is located within the property and is proposed to be used for park and trail purposes. Therefore, this criterion is met. All proposed improvements meet City and applicable agency standards; and The only improvement proposed is for the construction of a soft or hard surface trail along Fanno Creek through the floodplain portion of the property. The alignment and design of the trail has previously been approved through a separate City land use application (CPA1999-00001/SLR1999-00003). Therefore, this criterion is met. All proposed lots conform to the specific requirements below: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. The zoning on the property in uestion is Industrial Park; I-P. According to Community Development Code provision 1.530.040, there is no minimum lot size for this zoning district. The lot dimensions of approximately 200 feet by 300 feet of this irregularly shaped lot far exceed the minimum 50-foot width requirement set in the Code. Therefore, this criterion has been met. The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area. The two proposed lots will consist of 1.57 acres and 0.79 acres respectively. There is no minimum required lot area within the I-P zone. Therefore, this criterion is satisfied. Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a regally recorded minimum 15-foot-wide access easement. Parcel 1 has frontage on SW Tigard Street. Parcel 2 will have access to SW Grant Avenue via a 30-foot-wide access easement once the easement is obtained from owners of Washington County tax map 2S102BA, tax lot 02000. The City is in the process of obtaining this easement that will serve to connect this site on both sides to the City's existing trail system. Setbacks shall be as required by the applicable zoning district. The only development proposed is the extension of a paved trail through the property in accordance with the conditions of approval under (CPA1999-00001/SLR1999-00003). Therefore, this criterion does not apply. When the partition lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. The partition is not a flag lot. No structures are proposed, therefore, this criterion does not apply. NOTICE OF TYPE II DECISION MLP1999-00014-SNYDER/CITY OF TIGARD PARTITION PAGE 3 OF 5 A screen shall be provided along the property line of a lot or record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.745.040. Screening may also be required to maintain privacy for abutting lots and to provide unable outdoor areas for proposed development. The proposed accessway is located within ten feet of the abutting lot. Since the accessway is entirely within the floodplain, the screening provision would best be met through the planting of native vegetation. The placement of a structure or the use of non-native vegetation within the floodplain is prohibited by Tigard Development Code, Chapter 18.775 (Sensitive Lands). The applicant is proposing to screen the accessway with native vegetation which will satisfy this requirement, as well as, the requirements of Chapter 18.797 (Water Resource Overlay). The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire-fighting capabilities. No structure is proposed to be built on the subject parcel, therefore, this criterion does not apply. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintain rights shall be recorded with the approved partition map. The accessway is a public pathway and is not designed to serve any additional lots. Therefore, this criterion does not apply. Any accessway shall comply with the standards set forth in Chapter 18.705, Access, Egress, and Circulation. Because the applicant is proposing a 30-foot-wide accessway through the partitioned property, this criterion has been met. FINDING: Based on the analysis above, all of the specific approval standards have not been met. If the applicant complies with the condition specified below, the standards will be met. CONDITION: Submit roof of ownership of the 30-foot-wide easement before final plat approval. ADDITIONAL APPLICABLE STANDARDS Tree Removal — Chapter 18.790 The applicant is not proposing to remove any trees. Therefore, this criterion does not apply. Water Resources (WR) Overlay District— Chapter 18.797 This Chapter is addressed under a previous Sensitive Lands Review approval (SLR1999-00003). Therefore, this criterion has been met. SECTION VI. The proposal meets all of the approval criteria listed under 18.420.050. 1. The proposed partition complies with all statutory and ordinance requirements and regulations. The proposed partition does not violate any City statutes or ordinances. 2. There are adequate public facilities are available to serve the proposal. Existing sanitary sewer, water, electrical, and natural gas lines run along Fanno Creek and/or Grant Avenue. Grant Avenue is located within 50 feet of the property's western edge. 3. All proposed improvements meet City and applicable agency standards The only improvement proposed is the construction or a soft- or hard-surface trail along Fanno Creek through the property. The alignment and design of the trail has been approved through a separate city application (CPA 99-00001/SLR 99-00003). 4. All proposed lots conform to the specific requirements below. a. The minimum width of the building envelop area shall meet the lot requirement of the applicable zoning district. • • The zoning on the property in question is I-L. According to code provision 18.530.040, there is no minimum lot size for this district. The lot dimensions of approximately 200' x 300' of this irregularly shaped lot far exceed the minimum width requirement set in the code, 50 feet. b. The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. The lot area is 0.825. The minimum required lot area within the I-P zone is zero. c. Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement. A 30-foot wide access easement connecting on one side to a future city trail and on the other to Grant Avenue is in the process of being obtained from the owners of tax lot 2S1 02BA 02000, which surrounds the subject property on two sides. d. Setbacks shall be as required by the applicable zoning district. The only development proposed is the extension of a paved trail through the property in accordance with the conditions of approval under (CPA 99-00001/SLR 99-00003). e. When the partition lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. The partition is not a flag lot. No structures are proposed. f.
