APPLICATION SUMMARY • FILE NAME: LOUD PARTITION CASE NO: Minor Land Partition MLP 98-0012 PROPOSAL: A request for Minor Land Partition approval to divide one (1) parcel of approximately 2.44 acres into two (2) parcels of approximately 52,400 square feet and 51,400 square feet. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to certain conditions. The findings and conclusions on which the decision is based are noted in Section IV. NOTICE OF DECISION MLP 98-0012 - LOUD PARTITION PAGE 1 OF 13 • CONDITIONS OF APPROVAL PRIOR TO THE APPROVAL OF THE FINAL PARTITION PLAT, THE FOLLOWING CONDITIONS SHALL BE SATISFIED: (Unless otherwise noted, the staff contact shall be Brian Rager in the Engineering Department at (503) 639-4171). 1. Prior to approval of the final plat, the applicant shall submit a revised plat indicating the location of the driveway and provision of a fire tunaround. The plan shall indicate that the driveway and turnaround will be constructed to City standards and that the paved driveway will either be located at least 10 feet from both adjacent property lines or that screening will be provided to City standards along the length of the paved driveway where it is located within 10 feet of either adjacent property line. STAFF CONTACT: Mark J. Roberts (639-4171). 2. Prior to approval of the final plat, a public improvement permit and compliance agreement is required for this project to cover the main line sanitary sewer extension and any other work in the public right-of-way or public easements. Five (5) sets of detailed public improvement plans and profile construction drawings shall be submitted for preliminary review to the Engineering Department. (NOTE: these plans are in addition to any drawings required by the Building Division and should only include sheets relevant to public improvements. Public improvement plans shall conform to City of Tigard Public Improvement Design Standards, which are available at City Hall. 3. As a part of the public improvement plan submittal, the Engineering Department shall be provided with the exact legal name, address and telephone number of the individual or corporate entity who will be responsible for executing the compliance agreement (if one is required) and providing the financial assurance for the public improvements. For example, specify if the entity is a corporation, limited partnership, LLC, etc. Also, specify the state within which the entity is incorporated and provide the name of the corporate contact person. Failure to provide accurate information to the Engineering Department will delay processing of project documents. 4. The applicant shall dedicate additional right-of-way for SW Bull Mountain Road to provide 33 feet south of the.centerline. The dedication shall be shown on the face of the final plat. 5. Prior to approval of the final plat, the applicant shall enter into a Street Improvement Agreement with the City whereby, they agree to complete or participate in the improvements of SW Bull Mountain Road at some point in the future, adjacent to the subject property, when any of the following events occur: • When the improvements are part of a larger project to be financed or paid for by the formation of a Local Improvement District; NOTICE OF DECISION MLP 98-0012 - LOUD PARTITION PAGE 2 OF 13 • • • When the improvements are part of a larger project to be financed or paid for in whole or in part by the City or any other public agency; • When the improvements are part of a larger project to be constructed by a third party and,involves the sharing of design and/or construction expenses by the third party owner(s) of property in addition to the subject property; • When construction of the improvements are deemed to be appropriate by the City Engineer in conjunction with construction of improvements by others adjacent to the subject site; or • When/if either Parcel #1 or#2 is granted approval for further division of lots. 6. The applicant shall extend the 8-inch public sanitary sewer line (presently terminated at the southeast corner of the site) to the western boundary of this site. 7. Prior to approval of the final plat, the applicant shall submit a proposed storm drainage plan for Parcel 2 to the Engineering Department (Brian Rager) for review and approval. 8. The applicant shall either place the existing overhead utility lines along SW Bull Mountain Road underground as a part of this project, or they shall pay the fee in-lieu of undergrounding. The fee shall be calculated by the frontage of the site that is parallel to the utility lines and will be $27.50 per lineal foot. If the fee option is chosen, the amount will be $7,040 and it shall be paid prior to approval of the final plat. 9. Final Plat Application Submission Requirements: • Submit for City review three paper copies of the final plat prepared by a land surveyor licensed to practice in Oregon, and necessary data or narrative; • The final plat and data or narrative shall be drawn to the minimum standards set forth by the Oregon Revised Statutes (ORS 92.05), Washington County, and by the City of Tigard; • The right-of-way dedication for SW Bull Mountain Road shall be made on the final plat; and NOTE: Washington County will not begin their review of the final plat until they receive a letter from the City Engineering Department indicating: 1) that the City has reviewed the final plat and submitted comments to the applicant's surveyor,and 2) that the applicant has either completed any public improvements associated with the project, or has at least obtained the necessary public improvement permit from the City to complete the work. • Once the City and County have reviewed the final plat, submit two (2) mylar copies of the final plat for City Engineer's signature. NOTICE OF DECISION MLP 98-0012 - LOUD PARTITION PAGE 3 OF 13 • • + THE FOLLOWING CONDITIONS SHALL BE SATISFIED PRIOR TO ISSUANCE OF A BUILDING PERMIT: 10. Prior to issuance of a building permit on Parcel 2, the applicant shall provide the Engineering Department with a recorded mylar copy of the partition plat. 11. Prior to issuance of a building permit on Parcel 2, the applicant shall complete the required extension of the public sanitary sewer line and obtain approval from the City for said work. • 12. Prior to issuance of the building permit for Parcel 2, the applicant shall pay the standard water quality fee per lot (fee amount will be the latest approved by USA). . IN ADDITION THE APPLICANT SHOULD BE AWARE OF THE FOLLOWING SECTIONS OF THE COMMUNITY DEVELOPMENT CODE; THIS IS NOT AN EXCLUSIVE LIST. 18.160.170 Improvement Agreement::. Before approved construction plans are issued by . the City, the Applicant (subdivider) shall: 1. Execute and file an agreement with the City Engineer specifying the period within which all required improvements and repairs shall be completed; and 2. Include in the agreement provisions that if such work is not completed within the period specified, the City may complete the work and recover the full cost and expenses from the applicant. 3. The agreement shall stipulate improvement fees and deposits as may be required to be paid and may also provide for the construction of the improvements in stages and for the extension of time under specific conditions therein stated in the contract. 18.160.180 Bond: 1. As required by Section 18.160.170, the applicant shall file with the agreement an assurance of performance supported by one (1) of the following: • An irrevocable letter of credit executed by a financial institution authorized to transact business in the State of Oregon; • A surety bond executed by a surety company authorized to transact business in the State of Oregon which remains in force until the surety company is notified by the City in writing that ft may be terminated; or • Cash. The applicant shall furnish to the City Engineer an itemized improvement estimate, certified by a registered civil engineer, to assist the City Engineer in calculating the • amount of the performance assurance. 3. The applicant shall not cause termination of nor allow expiration of said guarantee without having first secured written authorization from the City. 18.164.150 Installations Prerequisite/Permit Fee: No land division improvements, including sanitary sewers, storm sewers, streets, sidewalks, curbs, lighting or other requirements shall be undertaken except after the plans have been approved by the City, the permit fee paid and permit issued. 18.164.180 Notice to City Required: 1. Work shall not begin until the City has been notified in advance. 2. If work is discontinued for any reason, it shall not be resumed until the City is notified. 18.164.200 Engineer's Certification Required: 1. The applicant's engineer shall provide written certification of a form provided by the City, that all improvements, workmanship and materials are in accordance with current and standard engineering and construction practices, and are of high grade, prior to City acceptance of the public works improvements, or any portion thereof for operation and maintenance. THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN (18) MONTHS OF THE FINAL DECISION DATE NOTED UNDER THE PROCESS AND APPEAL SECTION OF THIS REPORT. SECTION III. BACKGROUND INFORMATION Property History: The subject parcel is located within the City of Tigard. The property is designated Medium Density Residential on the Tigard Comprehensive Plan and zoned R-7. No previous land use actions for this parcel appear in_ the City land use records... A pre-application conference regarding this proposal was previously held on September 22, 1998. Site Information and Proposal Descriptions The subject property is approximately 2.44 acres in size according to the County Tax Assessor's map. The site has approximately 260 feet of frontage on SW Bull Mountain Road and is adjacent to the Aspen Ridge Subdivision which lies immediately to the east. The property is currently developed with a single-family residence. NOTICE OF DECISION MLP 98-0012-LOUD PARTITION PAGE 5 OF 13 • • a The owner is proposing a two-parcel partition as indicated on the proposed partition plat. Parcel #1 (52,400 square feet) would retain the existing dwelling, and Parcel #2 (51,400 square feet) would be a flag lot with a 32-foot-wide access to SW Bull Mountain Road. NOTE: This application was submitted on November 4, 1998, before the 11/26/98 effective date of the revised Community Development Code. In conformance with ORS 227.178(3), the proposal has been reviewed for compliance with the applicable code standards in effect at the time of submittal. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS GENERAL APPROVAL CRITERIA: Section 18.162.040 requires that a request to partition land shall meet all of the following criteria: The proposal conforms with the City's Comprehensive Plan. The City of Tigard Comprehensive Plan Map designates the subject property for Medium Density Residential use. The proposal conforms with the City's Comprehensive Plan in that, the newly created parcels will allow for residential development and not preclude future opportunities for development at or near the intended density of 7 units per net acre. Therefore, this criterion is met. The proposed partition complies with.all statutory and ordinance requirements and regulations. This proposed partition complies with all statutory and ordinance requirements and regulations as demonstrated both by the analysis presented within this administrative decision and by this application and review process through compliance with the conditions of approval. Therefore, this criterion is met. Adequate public facilities are available to serve the proposal. Public facilities are discussed in detail later in this report. Based on the analysis provided therein, it is found that adequate public facilities are, or will be conditioned to be, available to serve the proposal and will be constructed to meet City standards. Therefore, this criterion is met. All proposed lots conform to the size and dimensional requirements of this title. The specific dimensional requirements of the underlying zone are discussed in detail later in this report. Based on the analysis provided therein, it is found that all proposed lots conform, or will be conditioned to conform, with the applicable dimensional standards. Therefore, this criterion is met. All proposed improvements meet City and applicable agency standards. The public facilities and proposed improvements are discussed and conditioned later in this report. Improvements will be reviewed as part of permit process and during construction, at which time, the appropriate review authority will insure that City and applicable agency standards are met. Based on the analysis in this report, it is found that this criteria is met, or will be met as conditioned. NOTICE OF DECISION MLP 98-0012 - LOUD PARTITION PAGE 6 OF 13 • • SPECIAL PROVISIONS: Section 18.162.050 contains the following special provisions for lots created through the Partition Process: Lot Width: The minimum width of the building, envelope area shall meet the lot requirement of the applicable zoning district. The minimum lot width requirement of the R-7 zoning district is 50 feet. The preliminary plat indicates that Parcel 1 will have a building envelope width of approximately 212 feet and that the building envelope of Parcel 2 (a flag lot) will also have a minimum width of approximately 212 feet. Building envelope width is the minimum lot width minus the applicable side yard setbacks (5 feet in the R-7 zone). Both proposed parcels, therefore, exceed the minimum lot width requirements of the underlying zoning district and this criterion is met. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. The minimum single-family lot area in the R-7 zoning district is 5,000 square feet. The applicant's preliminary plat indicates that Parcel 1 will have an area of approximately 52,400 square feet and Parcel 2 will have an area of approximately 51,400 square feet. Both proposed parcels, therefore, exceed the minimum lot area requirements of the underlying zoning district and this criterion is met. Lot Frontage: Each lot created through the partition process shall front a public right-of-way by at least 15 feet, or have a legally recorded minimum 15-foot-wide access easement. The subject property abuts SW Bull Mountain Road, which is a public street. The applicant's preliminary plat indicates that Parcel 1 and Parcel 2 will have 223 feet and 32 feet respectively of frontage on SW Bull Mountain Road. Both proposed parcels , therefore, exceed the minimum standard and this criterion is met. Setbacks: Setbacks shall be as required by the applicable zoning district. The front, side and rear yard setbacks for single-family units in the R=7 zoning district are 15 feet, 5 feet, and 15 feet respectively. The existing dwelling will remain on Parcel 1 where the smallest setbacks provided will be approximately 25 feet (rear yard) as indicated on the preliminary plat. No building plans are proposed at this time for Parcel 2 but since the building envelope is approximately 210 feet by 125 feet, the applicable setbacks can be easily met on this parcel. Compliance with setbacks for Parcel 2 will be required at the time of building permit. Staff finds that proposed Parcels 1 and 2 meet the applicable setback standards outright or will meet them at the time construction of a dwelling is proposed, therefore, this criterion is satisfied. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. Proposed Parcel 2 is .a flag lot, however, no dwelling construction is proposed at this time. As noted above, compliance with applicable setback standards will be ensured at the time of building permit and, based on the building envelope dimensions of Parcel 2, the setbacks can be met. Staff finds that the applicable setback standards must be met at the time of building permit, therefore, this criterion is satisfied. NOTICE OF DECISION MLP 98-0012-LOUD PARTITION PAGE 7 OF 13 Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. Parcel 2 is a flag lot, the paved driveway for which will be located within the 32-foot-wide 'flag pole' portion of the parcel. Due to the width of the `flag pole'; the 10-15 foot paved driveway may or may not be located within 10 feet of either abutting property (Parcel #1 and/or Tax Lot 1300). Condition of Approval #1 requires that, if the applicant proposes to place the required paved driveway within 10 feet of either abutting property, a revised plat shall indicate that sight-obscuring screening will be installed to City standards along one (1) or both sides of the 'flag pole' portion of Parcel 2 as appropriate. Therefore, this criterion will be-met as conditioned. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. The Fire District and Building Division have reviewed the proposal and comments are included later in this report. A condition of Building Permit approval will • require fire hydrants per the Unified Building Code. Therefore, compliance with the Building Permit conditions will ensure that this criterion is met. Reciprocal Easements: Where a common drive is to be provided to serve more than one (1) lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. As indicated on the Preliminary Plat, each proposed• parcel will have separate access to SW Bull Mountain Road. Therefore, this criterion does not apply. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108; Access, Egress, and Circulation. This chapter requires that single-family dwellings have access to a public or private street. As noted earlier in this report, both proposed parcels will have access to SW Bull Mountain Road in conformance with City standards. Chapter 18.108 further requires that a driveway serving one (1) lot be at least 15 feet wide with a 10-foot paved width. Section 18.108.070.0 requires that access drives in excess of 150 feet in length be provided with approved provisions for the turnaround of emergency fire apparatus. As noted later in this report, the Building Division will require a 15-foot-wide all-weather surface for emergency fire access. The preliminary plat indicates that adequate width for a conforming driveway is provided although the length of the driveway is not shown. Condition of Approval #1 requires that the revised plat indicate the location and width of the driveway and indicate provision of a fire truck turnaround. Therefore, compliance with the condition of approval will ensure that this criterion is met. Floodplain: Where landfill and/or development is allowed within or adjacent to the one-hundred-year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. According to adopted FEMA floodplain maps, this site is not within a 100-year floodplain. Therefore, this standard does not apply. NOTICE OF DECISION MLP 98-0012 - LOUD PARTITION PAGE 8 OF 13 • • STREET AND UTILITY IMPROVEMENT STANDARDS: Sections 18.164.030 (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drainage) are addressed below: Streets: This site lies adjacent to SW Bull Mountain Road, which is classified as a major collector street on the City and Washington County Transportation Plan Maps. The roadway is still a County roadway, but due to an intergovernmental agreement between the County and the City, the City has planning and engineering authority. The existing right-of-way (ROW) width is approximately 20 feet from the centerline. The major collector standard requires a minimum of 33 feet from centerline. In accordance with TMC 18.164.030(E)(1)(a), the applicant will be required to dedicate additional ROW on the final plat to provide 33 feet from centerline. This roadway is paved, but not fully widened adjacent to this site to meet the major collector standard. The roadway has been fully widened immediately east of this site adjacent to the Aspen Ridge Subdivision. Tigard Municipal Code (TMC) Chapter 18.164.030(A)(1)(a) states that streets within a development and streets adjacent shall be improved in accordance with City standards. However, TMC 18.164.030(A)(1)(c)(iii) states that the City may accept a future improvement guarantee in-lieu of street improvements if the improvement associated with the project does not, by itself, provide a significant improvement to the street safety or capacity. Although this development will incrementally increase the amount of traffic on the roadway, the increase will not substantially degrade the level of service on the street. A street improvement adjacent to this site, therefore, will not significantly improve the safety or capacity of the street. In addition, .TMC 18.164.030(A)(1)(c)(v) states that a guarantee in-lieu of street improvements is acceptable if the proposal is a land partition on property zoned residential and the partition does not create any new streets. This partition will not create a new street. Staff is concerned about the significant frontage of this site, which is approximately 256 feet, where 224 feet would abut Parcel 1 and only 32 feet would abut Parcel 2. The size of Parcel 2 lends itself to further division in the future, which could result in a significant traffic impact on the roadway, but would only tie that parcel to the 32 feet of ROW on Bull Mountain Road. Staff recommends that if either parcel is further divided, that the owners of Parcels 1 and 2 be required to construct the street improvements adjacent to both parcels at that time. In order to ensure the future improvements of SW Bull Mountain Road adjacent to this site, Staff recommends the applicant be required to enter into a Street Improvement Agreement, which will obligate the owners of Parcels 1 and 2 to participate in the future improvements of Bull Mountain Road if a Local Improvement District (LID) is formed, or if either parcel is further divided. The agreement would also require the improvements to be constructed if a larger project is proposed, either funded in whole or in part by the City, other agency, or a third party, that encompasses adjacent street frontages as well as the frontage adjacent to the subject site. NOTICE OF DECISION MLP 98-0012- LOUD PARTITION PAGE 9 OF 13 • • Water: Water service is provided by the City of Tigard. Any new service(s) needed for Parcel 2 will need to be coordinated with the City as a part of building permit application. Sanitary Sewer: An 8-inch public sanitary sewer line was stubbed to the southeast corner of this site as a part of the Aspen Ridge Subdivision. The applicant will be required to serve Parcel 2 from an extension of that public line. The applicant shall also extend the 8-inch public main line to western boundary of this site to allow for further service to unsewered parcels to the west. Storm Drainage: This site slopes toward the southeast. It appears that there were no public storm lines stubbed to this site from Aspen Ridge. There is a public storm line in SW Bull Mountain Road adjacent to the south side of the roadway that will need to be further extended west when SW Bull Mountain is improved in the future. The applicant did not provide a proposed storm drainage plan for Parcel 2, so Staff was not able to determine if downstream facilities are adequate. Staff recommends that the applicant submit a proposed storm drainage plan for Parcel 2, for review and approval by the City prior to recording of the final plat. Storm Water Quality: The City has agreed to enforce Surface Water Management (SWM) regulations established by the Unified Sewerage Agency (USA) Design and Construction Standards (adopted by Resolution and Order No. 96-44) which require the construction of on-site water quality facilities. However, the USA standards include a provision that would exclude small projects such as residential land partitions. It would be impractical to require an on- site water quality facility to accommodate treatment of the storm water from Parcel 2. Rather, the USA standards provide that applicants should pay a fee in-lieu of constructing a facility if deemed appropriate. Staff recommends payment of the fee in-lieu on this application. It should be noted that if Parcel 2 is further divided in the future, a water quality facility may then be required. If the fee in-lieu is proposed, it is equal to $27.50 per lineal foot of street frontage that contains the overhead lines. The site is located at 12040 SW Bull Mountain Road, west of SW Aspen Ridge Drive (WCTM 2S1 10BC, Tax Lot 1400). Findings: 1. Streets: This site lies adjacent to SW Bull Mountain Road, which is classified as a major collector street on the City and Washington County Transportation Plan Maps. The roadway is still a County roadway, but due to an intergovernmental agreement between the County and the City, the City has planning and engineering authority. The existing right-of-way (ROW) width is approximately 20 feet from the centerline. The major collector standard requires a minimum of 33 feet from centerline. In accordance with TDC 18.,164.030(E)(1)(a), the applicant will be required to dedicate • additional ROW on the final plat to provide 33 feet from centerline. This roadway is paved, but not fully widened adjacent to this site to meet the major collector standard. The roadway has been fully widened immediately east of this site adjacent to the Aspen Ridge Subdivision. TMC 18.164.030(A)(1)(a) states that streets within a development and streets adjacent shall be improved in accordance with City standards. However, 18.164.030(A)(1)(c)(iii) states that the City may accept a future improvement guarantee in lieu of street improvements if the improvement associated with the project does not, by itself, provide a significant improvement to the street safety or capacity. Although this development will incrementally increase the amount of traffic on the roadway, the increase will not substantially degrade the level of service on the street. In addition, . 18.164.030(A)(1)(c)(v) states that a guarantee in lieu of street improvements is acceptable if the proposal is a land partition on property zoned residential and the partition does not create any new streets. This partition will not create a new street. Staff is concerned about the significant frontage of this site, which is approximately 256 feet, where 224 feet would abut Parcel 1 and only 32 feet would abut Parcel 2. The size of Parcel 2 lends itself to further division in the future, which could result in a significant traffic impact on the roadway, but would only tie that parcel to the 32 feet of ROW on Bull Mountain Road. Staff recommends that if Parcel 2 is further divided, that the owners of Parcels 1 and 2 be required to construct the street improvements adjacent to both parcels at that time. In order to ensure the future improvements of Bull Mountain Road adjacent to this site, Staff recommends the applicant be required to enter into a Street Improvement Agreement, which will obligate the owners of Parcels 1 and 2 to participate in the future improvements of Bull Mountain Road if a Local Improvement District (LID) is formed, or if Parcel 2 is further divided. The agreement would also require the improvements to be constructed if a larger project is proposed, either funded in whole or in part by the City, other agency, or a third party, that encompasses adjacent street frontages as well as the frontage adjacent to the subject site. 2. Water: Water service is provided by the City of Tigard. Any new service(s) needed for Parcel 2 will need to be coordinated with the City as a part of building permit application. 3. Sanitary Sewer: An 8-inch public sanitary sewer line was stubbed to the southeast corner of this site as a part of the Aspen Ridge subdivision. The applicant will be required to serve Parcel 2 from an extension of that public line. The applicant shall also extend the 8-inch public main line to western boundary of this site to allow for further service to unsewered parcels to the west. 4. Storm Drainage: This site slopes toward the southeast. It appears that there were no public storm lines stubbed to this site from Aspen Ridge. There is a public storm line in Bull Mountain Road adjacent to the south side of the ENGINEERING COMMENTS MLP 98-0012 Loud Partition PAGE 2 • • roadway that will need to be further extended west when Bull Mountain is improved in the future. The applicant did not provide a proposed storm drainage plan for Parcel 2, so Staff was not able to determine if downstream facilities are adequate. Staff recommends that the applicant submit a proposed storm drainage plan for Parcel 2, for review and approval by the City prior to recording of the final plat. 5. Storm Water Quality: The City has agreed to enforce Surface Water Management (SWM) regulations established by the Unified Sewerage Agency (USA) Design and Construction Standards (adopted by Resolution and Order No. 96-44) which require the construction of on-site water quality facilities. However, the USA standards include a provision that would exclude small projects such as residential land partitions. It would be impractical to require an on-site water quality facility to accommodate treatment of the storm water from Parcel 2. Rather, the USA standards provide that applicants should pay a fee in-lieu of constructing a facility if deemed appropriate. Staff recommends payment of the fee in-lieu on this application. It should be noted that if Parcel 2 is further divided in the future, a water quality facility may then be required. 6. Grading and Erosion Control: • USA Design and Construction Standards also regulates erosion control to reduce the amount of sediment and other pollutants reaching the public storm and surface water system resulting from development, construction, grading, excavating, clearing, and any other activity which accelerates erosion. Per USA regulations, the applicant is required to submit an erosion control plan for City review and approval prior to issuance of City permits. 7. The fee shall be calculated by the frontage of the site that is • parallel to the utility lines and will be $27.50 per lineal foot. If the fee option is chosen, the amount will be $7,040 and it shall be paid prior to approval of the final plat. 9. Final Plat Application Submission Requirements: • Submit for City review three paper copies of the final plat prepared by a land surveyor licensed to practice in Oregon, and necessary data or narrative; • The final plat and data or narrative shall be drawn to the minimum standards set forth by the Oregon Revised Statutes (ORS 92.05), Washington County, and by the City of Tigard; • The right-of-way dedication for SW Bull Mountain Road shall be made on the • final plat; and NOTE: Washington County will not begin their review of the final plat until they receive a letter from the City Engineering Department indicating: 1) that the City has reviewed the final plat and submitted comments to the applicant's surveyor,and 2) that the applicant has either completed any public improvements associated with the project,or has at least obtained the necessary public improvement permit from the City to complete the work. • Once the City and County have-reviewed the final plat, submit two (2) mylar copies of the final plat for City Engineer's signature. NOTICE OF DECISION MLP 98-0012 - LOUD PARTITION PAGE 3 OF 13 • THE FOLLOWING CONDITIONS SHALL BE SATISFIED PRIOR TO ISSUANCE OF A BUILDING PERMIT: 10. Prior to issuance of a building permit on Parcel 2, the applicant shall provide the Engineering Department with a recorded mylar copy of the partition plat. 11. Prior to issuance of a building permit on Parcel 2, the applicant shall complete the required extension of the public sanitary sewer line and obtain approval from the City for said work. 12. Prior to issuance of the building permit for Parcel 2, the applicant shall pay the standard water quality fee per lot (fee amount will be the latest approved by USA). IN ADDITION THE APPLICANT SHOULD BE AWARE OF THE FOLLOWING SECTIONS OF THE COMMUNITY DEVELOPMENT CODE; THIS IS NOT AN EXCLUSIVE LIST. 18.160.170 Improvement Agreement:: Before approved construction plans are issued by the City, the Applicant (subdivider) shall: 1. Execute and file an agreement with the City Engineer specifying the period within which all required improvements and repairs shall be completed; and 2. Include in the agreement provisions that if such work is not completed within the period specified, the City may complete the work and recover the full cost and expenses from the applicant. 3. The agreement shall stipulate improvement fees and deposits as may be required to be paid and may also provide for the construction of the improvements in stages and for the extension of time under specific conditions therein stated in the contract. 18.160.180 Bond: 1. As required by Section 18.160.170, the applicant shall file with the agreement an assurance of performance supported by one (1) of the following: • An irrevocable letter of credit executed by a financial institution authorized to transact business in the State of Oregon; • A surety bond executed by a surety company authorized to transact business in the State of Oregon which remains in force until the surety company is notified by the City in writing that ft may be terminated; or • Cash. The applicant shall furnish to the City Engineer an itemized improvement estimate, certified by a registered civil engineer, to assist the City Engineer in calculating the amount of the performance assurance. 3. The applicant shall not cause termination of nor allow expiration of said guarantee without having first secured written authorization from the City. 18.164.150 Installations Prerequisite/Permit Fee: No land division improvements, including sanitary sewers, storm sewers, streets, sidewalks, curbs, lighting or other requirements shall be undertaken except after the plans have been approved by the City, the permit fee paid and permit issued. 18.164.180 Notice to City Required: 1. Work shall not begin until the City has been notified in advance. 2. If work is discontinued for any reason, it shall not be resumed until the City is notified. 18.164.200 Engineer's Certification Required: 1. The applicant's engineer shall provide written certification of a form provided by the City, that all improvements, workmanship and materials are in accordance with current and standard engineering and construction practices, and are of high grade, prior to City acceptance of the public works improvements, or any portion thereof for operation and maintenance. THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN (18) MONTHS OF THE FINAL DECISION DATE NOTED UNDER THE PROCESS AND APPEAL SECTION OF THIS REPORT. SECTION III. BACKGROUND INFORMATION Property History: The subject parcel is located within the City of Tigard. The property is designated Medium Density Residential on the Tigard Comprehensive Plan and zoned R-7. No previous land use actions for this parcel appear in. the City land use records. A pre-application conference regarding this proposal was previously held on September 22, 1998. Site Information and Proposal Descriptions The subject property is approximately 2.44 acres in size according to the County Tax Assessor's map. The site has approximately 260 feet of frontage on SW Bull Mountain Road and is adjacent to the Aspen Ridge Subdivision which lies immediately to the east. The property is currently developed with a single-family residence. NOTICE OF DECISION MLP 98-0012 - LOUD PARTITION PAGE 5 OF 13 The owner is proposing a two-parcel partition as indicated on the proposed partition plat. Parcel #1 (52,400 square feet) would retain the existing dwelling, and Parcel #2 (51,400 square feet)would be a flag lot with a 32-foot-wide access to SW Bull Mountain Road. NOTE: This application was submitted on November 4, 1998, before the 11/26/98 effective date of the revised Community Development Code. In conformance with ORS 227.178(3), the proposal has been reviewed for compliance with the applicable code standards in effect at the time of submittal. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS GENERAL APPROVAL CRITERIA: Section 18.162.040 requires that a request to partition land shall meet all of the following criteria: The proposal conforms with the City's Comprehensive Plan. The City of Tigard Comprehensive Plan Map designates the subject property for Medium Density Residential use. The proposal conforms with the City's Comprehensive Plan in that, the newly created parcels will allow for residential development and not preclude future opportunities for development at or near the intended density of 7 units per net acre. Therefore, this criterion is met. The proposed partition complies with all statutory and ordinance requirements and regulations. This proposed partition complies with all statutory and ordinance requirements and regulations as demonstrated both by the analysis presented within this administrative decision and by this application and review process through compliance with the conditions of approval. Therefore, this criterion is met. Adequate public facilities are available to serve the proposal. Public facilities are discussed in detail later in this report. Based on the analysis provided therein, it is found that adequate public facilities are, or will be conditioned to be, available to serve the proposal and will be constructed to meet City standards. Therefore, this criterion is met. All proposed lots conform to the size and dimensional requirements of this title. The specific dimensional requirements of the underlying zone are discussed in detail later in this report. Based on the analysis provided therein, it is found that all proposed lots conform, or will be conditioned to conform, with the applicable dimensional standards. Therefore, this criterion is met. All proposed improvements meet City and applicable agency standards. The public facilities and proposed improvements are discussed and conditioned later in this report. Improvements will be reviewed as part of permit.process and during construction, at which time, the appropriate review authority will insure that City and applicable agency standards are met. Based on the analysis in this report, it is found that this criteria is met, or will be met as conditioned. NOTICE OF DECISION MLP 98-0012- LOUD PARTITION PAGE 6 OF 13 • SPECIAL PROVISIONS: Section 18.162.050 contains the following special provisions for lots created through the Partition Process: Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. The minimum lot width requirement of the R-7 zoning district is 50 feet. The preliminary plat indicates that Parcel 1 will have a building envelope width of approximately 212 feet and that the building envelope of Parcel 2 (a flag lot) will also have a minimum width of approximately 212 feet. Building envelope width is the minimum lot width minus the applicable side yard setbacks (5 feet in the R-7 zone). Both proposed parcels, therefore, exceed the minimum lot width requirements of the underlying zoning district and this criterion is met. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. The minimum single-family lot area in the R-7 zoning district is 5,000 square feet. The applicant's preliminary plat indicates that Parcel 1 will have an area of approximately 52,400 square feet and Parcel 2 will have an area of approximately 51,400 square feet. Both proposed parcels, therefore, exceed the minimum lot area requirements of the underlying zoning district and this criterion is met. Lot Frontage: Each lot created through the partition process shall front a public right-of-way by at least 15 feet, or have a legally recorded minimum 15-foot-wide access easement. The subject property abuts SW Bull Mountain Road, which is a public street. The applicant's preliminary plat indicates that Parcel 1 and Parcel 2 will have 223 feet and 32 feet respectively of frontage on SW Bull Mountain Road. Both proposed parcels , therefore, exceed the minimum standard and this criterion is met. Setbacks: Setbacks shall be as required by the applicable zoning district. The front, side and rear yard setbacks for single-family units in the R-7 zoning district are 15 feet, 5 feet, and 15 feet respectively. The existing dwelling will remain on Parcel 1 where the smallest setbacks provided will be approximately 25 feet (rear yard) as indicated on the preliminary plat. No building plans are proposed at this time for Parcel 2 but since the building envelope is approximately 210 feet by 125 feet, the applicable setbacks can be easily met on this parcel. Compliance with setbacks for Parcel 2 will be required at the time of building permit. Staff finds that proposed Parcels 1 and 2 meet the applicable setback standards outright or will meet them at the time construction of a dwelling is proposed, therefore, this criterion is satisfied. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. Proposed Parcel 2 is a flag lot, however, no dwelling construction is proposed at this time. As noted above, compliance with applicable setback standards will be ensured at the time of building permit and, based on the building envelope dimensions of Parcel 2, the setbacks can be met. Staff finds that the applicable setback standards must be met at the time of building permit, therefore, this criterion is satisfied. NOTICE OF DECISION MLP 98-0012- LOUD PARTITION PAGE 7 OF 13 • Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. Parcel 2 is a flag lot, the paved driveway for which will be located within the 32-foot-wide `flag pole' portion of the parcel. Due to the width of the `flag pole'; the 10-15 foot paved driveway may or may not be located within 10 feet of either abutting property (Parcel #1 and/or Tax Lot 1300). Condition of Approval #1 requires that, if the applicant proposes to place the required paved driveway within 10 feet of either abutting property, a revised plat shall indicate that sight-obscuring screening will be installed to City standards along one (1) or both sides of the 'flag pole' portion of Parcel 2 as appropriate. Therefore, this criterion will be met as conditioned. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. The Fire District and Building Division have reviewed the proposal and comments are included later in this report. A condition of Building Permit approval will require fire hydrants per the Unified Building Code. Therefore, compliance with the Building Permit conditions will ensure that this criterion is met. Reciprocal Easements: Where a common drive is to be provided to serve more than one (1) lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. As indicated on the Preliminary Plat, each proposed parcel will have separate access to SW Bull Mountain Road. Therefore, this criterion does not apply. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108; Access, Egress, and Circulation. This chapter requires that single-family dwellings have access to a public or private street. As noted earlier in this report, both proposed parcels will have access to SW Bull Mountain Road in conformance with City standards. Chapter 18.108 further requires that a driveway serving one (1) lot be at least 15 feet wide with a 10-foot paved width. Section 18.108.070.0 requires that access drives in excess of 150 feet in length be provided with approved provisions for the turnaround of emergency fire apparatus. As noted later in this report, the Building Division will require a 15-foot-wide all-weather surface for emergency fire access. The preliminary.plat indicates that adequate width for a conforming driveway is provided although the length of the driveway is not shown. Condition of Approval '#1 requires that the revised plat indicate the location and width of the driveway and indicate provision of a fire truck turnaround. Therefore, compliance with the condition of approval will ensure that this criterion is met. Floodplain: Where landfill and/or development is allowed within or adjacent to the one-hundred-year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain: This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. According to adopted FEMA floodplain maps, this site is not within a 100-year floodplain. Therefore, this standard does not apply. NOTICE OF DECISION MLP 98-0012- LOUD PARTITION PAGE 8 OF 13 • • STREET AND UTILITY IMPROVEMENT STANDARDS: Sections 18.164.030 (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drainage) are addressed below: Streets: This site lies adjacent to SW Bull Mountain Road, which is classified as a major collector street on the City and Washington County Transportation Plan Maps. The roadway is still a County roadway, but due to an intergovernmental agreement between the County and the City, the City has planning and engineering authority. The existing right-of-way (ROW) width is approximately 20 feet from the centerline. The major collector standard requires a minimum of 33 feet from centerline. In accordance with TMC 18.164.030(E)(1)(a), the applicant will be required to dedicate additional ROW on the final plat to provide 33 feet from centerline. This roadway is paved, but not fully widened adjacent to this site to meet the major collector standard. The roadway has been fully widened immediately east of this site adjacent to the Aspen Ridge Subdivision. Tigard Municipal Code (TMC) Chapter 18.164.030(A)(1)(a) states that streets within a development and streets adjacent shall be improved in accordance with City standards. However, TMC 18.164.030(A)(1)(c)(iii) states that the City may accept a future improvement guarantee in-lieu of street improvements if the improvement associated with the project does not, by itself, provide a significant improvement to the street safety or capacity. Although this development will incrementally increase the amount of traffic on the roadway, the increase will not substantially degrade the level of service on the street. A street improvement adjacent to this site, therefore, will not significantly improve the safety or capacity of the street. In addition, TMC 18.164.030(A)(1)(c)(v) states that a guarantee in-lieu of street improvements is acceptable if the proposal is a land partition on property zoned residential and the partition does not create any new streets. This partition will not create a new street. Staff is concerned about the significant frontage of this site, which is approximately 256 feet, where 224 feet would abut Parcel 1 and only 32 feet would abut Parcel 2. The size of Parcel 2 lends itself to further division in the future, which could result in a significant traffic impact on the roadway, but would only tie that parcel to the 32 feet of ROW on Bull Mountain Road. Staff recommends that if either parcel is further divided, that the owners of Parcels 1 and 2 be required to construct the street improvements adjacent to both parcels at that time. In order to ensure the future improvements of SW Bull Mountain Road adjacent to this site, Staff recommends the applicant be required to enter into a Street Improvement Agreement, which will obligate the owners of Parcels 1 and 2 to participate in the future improvements of Bull Mountain Road if a Local Improvement District (LID) is formed, or if either parcel is further divided. The agreement would also require the improvements to be constructed if a larger project is proposed, either funded in whole or in part by the City, other agency, or a third party, that encompasses adjacent street frontages as well as the frontage adjacent to the subject site. NOTICE OF DECISION MLP 98-0012 - LOUD PARTITION PAGE 9 OF 13 • • Water: Water service is provided by the City of Tigard. Any new service(s) needed for Parcel 2 will need to be coordinated with the City as a part of building permit application. Sanitary Sewer: An 8-inch public sanitary sewer line was stubbed to the southeast corner of this site as a part of the Aspen Ridge Subdivision. The applicant will be required to serve Parcel 2 from an extension of that public line. The applicant shall also extend the 8-inch public main line to western boundary of this site to allow for further service to unsewered parcels to the west. Storm Drainage: This site slopes toward the southeast. It appears that there were no public storm lines stubbed to this site from Aspen Ridge. There is a public storm line in SW Bull Mountain Road adjacent to the south side of the roadway that will need to be further extended west " when SW Bull Mountain is improved in the future. • The applicant did not provide a proposed storm drainage plan for Parcel 2, so Staff was not able to determine if downstream facilities are adequate. Staff recommends that the applicant submit a proposed storm drainage plan for Parcel 2, for review and approval by the City prior to recording of the final plat. Storm Water Quality: The City has agreed to enforce Surface Water Management (SWM) regulations established by the Unified Sewerage Agency (USA) Design and Construction Standards (adopted by Resolution and Order No. 96-44) which require the construction of on-site water quality facilities. However, the USA standards include a provision that would exclude small projects such as residential land partitions. It would be impractical to require an on- site water quality facility to accommodate treatment of the storm water from Parcel 2. Rather, the USA standards provide that applicants should pay a fee in-lieu of constructing a facility if deemed appropriate. Staff recommends payment of the fee in-lieu on this application. It should be noted that if Parcel 2 is further divided in the future, a water quality facility may then be required. Grading and Erosion Control: USA Design and Construction Standards also regulates erosion control to reduce the amount of sediment and other pollutants reaching the public storm and surface water system resulting from development, construction, grading, excavating, clearing, and any other activity which accelerates erosion. Per USA regulations, the applicant is required to submit an erosion control plan for City review and approval prior to issuance of City permits. • NOTICE OF DECISION MLP 98-0012 - LOUD PARTITION PAGE 10 OF 13 • Existing Overhead Utility Lines: There are existing overhead utility lines along SW Bull Mountain Road.. Section 18.164.120 of the TMC requires all overhead utility lines adjacent to a development to be placed underground or, at the election of the developer, a fee in-lieu of undergrounding can be paid. If the fee in-lieu is proposed, it is equal to $27.50 per lineal foot of street frontage that contains the overhead lines. The frontage along this site is 256 lineal feet; therefore, the fee would be $7,040. SECTION V. OTHER STAFF COMMENTS The City of Tigard Engineering Department has reviewed this proposal. Comments have been incorporated into this report under the "Street and Utility Improvement Standards" section above. The City of Tigard Water Department has reviewed the proposal and offered the following comments: • When a new building is constructed on proposed Parcel #2 they shall be required to install a fire hydrant so that all portions of the building are within 500 feet of a fire hydrant. • Water meter for Parcel 2 will be installed within the public right-of-way along SW Bull Mountain Road and because of distances, the water meter shall be a minimum of 1-inch. The City of Tigard Building Division has reviewed the proposal and offered the following. comments: • Provide a fire hydrant to within 500 feet of all exterior walls of all structures to be placed on site. • Provide a 15-foot-wide all-weather surface road capable of supporting 50,000 lbs GVW. • Provide a fire truck turnaround. • Roof, perimeter and floor drains must be tight piped to an approved storm drainage system. • Turning radius from Bull Mountain Road to driveway shall meet turning radius requirements of Tualatin Valley Fire District and UFC 902.2.2.3. • An erosion control plan is required. The City of Tigard Police Department has reviewed this proposal and has offered the following comments: • A type of addressing shall be provided at the foot of the driveway for Parcel #2 to assist emergency responders in locating property. . NOTICE OF DECISION MLP 98-0012 - LOUD PARTITION PAGE 11 OF 13 • • The City of Tigard Operations Department has had the opportunity to review the proposal and has offered no comments or objections. SECTION VI. AGENCY COMMENTS Unified Sewerage Agency has reviewed the proposal and offered the following comments with regard to Sanitary Sewer, Storm Sewer and Storm Water Quality which have been addressed by the Engineering Department in this decision: Sanitary Sewer Each lot shall be provided with a means of disposal for sanitary sewer in accordance with R&O 96-44 (USA's Construction Design Standards, July 1996 edition). Engineer should verify that public sanitary sewer is available to uphill adjacent properties, or extend service as required by R&O 96-44. Storm Sewer Each lot should have access to public storm sewer. Engineer should verify that public storm sewer is available to uphill adjacent properties, or extend service as required by R&O 96-44. Hydraulic and hydrological analysis of stormwater conveyance system is necessary. If downstream storm conveyance does not have the capacity to convey the volume during a 25-year, 24-hour event, the applicant is responsible for mitigating the flow. Water Quality Fee in lieu would be acceptable if requested by the applicant. GTE has reviewed this proposal and offered the following comments: • Owner/developer will be required to place service drop-out to SW Bull Mountain Road. Portland General Electric, TCI Cablevision and the Washington County Department of Land Use and Transportation have had the opportunity to review the proposal and have offered no comments or objections. • SECTION VII.
