Prior to approval of the final plat, a Street Opening Permit will be required for this project to cover the storm drainage outfall into the ditch in SW Murdock Street as well as the driveway approach onto SW Murdock Street. The applicant will need to submit five (5) copies of a proposed public improvement plan for review and approval. NOTE: these plans are in addition to any drawings required by the • Building Division and should only include information relevant to the public improvements. 2. As a part of the public improvement plan submittal, the Engineering Department shall be provided with the name, address and telephone number of the individual or corporate entity who will be responsible for executing the compliance agreement and providing the financial assurance for the public improvements. 3. The final plat shall show on its face a right-of-way (ROW) dedication adjacent to SW 103rd Avenue to provide a total of 25 feet east of centerline. 4. Prior to approval of the final plat, the applicant shall obtain a Site Permit from the Building Department to cover all grading for the lot(s), all on-site private utility installation (water, sewer, storm, etc.) and all driveway construction. NOTE: this permit is separate from any permit issued by the Engineering Department for work in the public right-of-way. 5. An agreement shall be executed by the applicant, on forms provided by the City, which waives the property owner's right to oppose or remonstrate against a future Local Improvement District formed to improve SW 103rd Avenue. 6. The applicant shall either place the existing overhead utility lines along SW 103rd Avenue underground as a part of this project, or they shall pay the fee in-lieu of undergrounding. The fee shall be calculated by the frontage of the site that is parallel to the utility lines and will be $27.50 per lineal foot. If the fee option is chosen, the amount will be $3,025 and it shall be paid prior to approval of the final plat. 7. Final Plat Application Submission Requirements: A. Submit for City review, three (3) paper copies of the partition plat prepared by a land surveyor licensed to practice in Oregon, and necessary data or narrative. The location of the proposed residence in order to determine if a fire apparatus turnaround shall be required in accordance with Section 18.107.070 and the Uniform Fire Code. 9. PRIOR TO THE ISSUANCE OF BUILDING PERMITS, THE FOLLOWING CONDITIONS SHALL BE SATISFIED: 10. Prior to issuance of a building permit on Parcel 2, the applicant shall provide the Engineering Department with a recorded mylar copy of the partition plat. 11. Prior to issuance of the building permit for Parcel 2, the applicant shall pay the standard water quality fee per lot (fee amount will be the latest approved by USA). THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN(18)MONTHS OF THE FINAL DECISION DATE NOTED UNDER THE PROCESS AND APPEAL SECTION BELOW. III. BACKGROUND INFORMATION Property History: No development applications were found to have previously been filed with the City. Site Information and Proposal Description: The property is currently developed with a single-family residence. The applicant is proposing to divide one (1) parcel of approximately 43,560 square feet into two (2) parcels of approximately 20,000 square feet and 23,560 square feet. IV. APPLICABLE REVIEW CRITERIA AND FINDINGS - MINOR LAND PARTITION Section 18.162.040 contains the following general approval criteria for a Minor Land Partition: 1. The proposal conforms with the City's Comprehensive Plan; NOTICE OF DECISION GOTTER/MILROY PARTITION-MLP 98-0004 PAGE 3 OF 10 • • 2. The proposed partition complies with all statutory and ordinance requirements and regulations; 3. Adequate public facilities are available to serve the proposal; 4. All proposed lots conform to the size and dimensional requirements of this title; and 5. All proposed improvements meet City and applicable agency standards (Ord. 89-06; Ord. 83-52). The proposal conforms with the City's Comprehensive Plan in that, the newly created lot will continue to allow for residential development. This proposal, therefore, is not in conflict with the Low Density Plan designation. This proposed partition complies with all statutory and ordinance requirements and regulations as demonstrated both by the - analysis presented within this administrative decision, and by this application and review process. Adequate public facilities are or will be conditioned to be available to serve the proposal. Section 18.162.050 contains the following special provisions for lots created through the Partition Process: 1. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. 2. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. 3. Lot Frontage: Each lot created through the partition process shall front a public right-of-way by at least 15 feet, or have a legally recorded minimum 15 foot wide access easement. 4. Setbacks: Setbacks shall be as required by the applicable zoning district. 5. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. 6. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. 7. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. 8. Reciprocal Easements: Where a common drive is to be provided to serve more than one (1) lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. 9. Accesswav: Any accessway shall comply with the standards set forth in Chapter 18.108; Access, Egress, and Circulation. NOTICE OF DECISION GOTTER/MILROY PARTITION-MLP 98-0004 PAGE 4 OF 10 • • 10. Floodplain: Where landfill and/or development is allowed within or adjacent to the one-hundred-year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. Criteria 1 is satisfied as the proposed lot widths are approximately 110 and 124 feet respectively, exceeding the minimum 50-foot lot width requirement in the R-4.5 zone. Criteria 2 is satisfied as this partition would create lots of approximately 23,560 and 20,000 square feet, exceeding the 7,500 square foot minimum lot size requirement. Criteria 3 is satisfied as Parcel 1 has 110 feet of frontage on SW 103rd Avenue and Parcel 2 has 25 feet of frontage on SW Murdock Street via a 50-foot access easement. The required setbacks in the R-4.5 zone are as follows: front yard-20 feet; side yard-5 feet; rear yard-15 feet; and garage-20 feet. Accessory structures are required to maintain a minimum side and rear yard setback of five (5) feet. As indicated on the site plan, the existing single-family home and accessory structure on Parcel 1 complies with • the applicable setbacks, satisfying Criteria 4. Compliance with flag lot setbacks on the newly created Parcel 2 will be reviewed when it is built upon. Criteria 5 shall be satisfied as the front yard determination for the new Parcel 2 shall be reviewed during the building permit process when the property is built upon. Front yard determination for Parcel 1 is not applicable as this lot is not a flag lot. Criteria 6 is satisfied as the driveway for Parcel 2 is screened by an existing hedge. Fire hydrants shall be consistent with Uniform Fire Code standards, thereby, satisfying Criteria 7. Criteria 8 is satisfied as the proposed partition will not create the need for a common driveway between the two (2) parcels. The proposed Parcel 2 will be using a driveway within an access easement on the adjoining property to the east. The applicant has provided a copy of the access easement. Criteria 9 shall be satisfied as Parcel 1 will continue to use the existing driveway and the proposed Parcel 2 will be served by a minimum 10-foot-wide paved driveway. A revised plan shall be submitted that shows the location of the proposed residence in order to determine if a fire apparatus turnaround shall be required in accordance with Section 18.107.070 and the Uniform Fire Code. Criteria 10 is not applicable as neither of the parcels are within the floodplain. NOTICE OF DECISION GOTTER/MILROY PARTITION-MLP 98-0004 PAGE 5 OF 10 • • Section 18.88.010 (Solar Access) states that all newly created lots within the City of Tigard shall promote the use of renewable energy sources by providing for improved access to sunlight for residential dwellings. A lot meets the basic requirement if it has a north-south dimension of 90 feet or more and has a front lot line that is oriented within 30 degrees of a true east-west axis. The proposed lot complies with this section as the north-south dimension is 125 feet and the flag lot, front lot line will be oriented within 30 degrees of a true east-west axis. Impact Study: Section 18.32.050 states that the applicant shall provide an impact study to quantify the effect of development on public facilities and services. For each public facility system and type of impact, the study shall propose . improvements necessary to meet City standard, and to minimize the impact of the development on the public at large, public facilities systems, and affected private property users. In situations where the Community Development Code requires • the dedication of real property interests, the applicant shall either specifically concur with a requirement for public right-of-way dedication, or provide evidence that supports that the real property dedication requirement is not roughly proportional to the projected impacts of the development. Section 18.32.250 states that when a condition of approval requires the transfer to the public of an interest in real property, the approval authority shall adopt findings which support the conclusion that the interest in real property to be transferred is roughly proportional to the impact the proposed development will have on the public. Any required street improvements to certain collector or higher volume streets and the Washington County Traffic Impact Fee (TIF) are mitigation measures that are required at the time of development. Based on a transportation impact study prepared by Mr. David Larson for the A-Boy Expansion/Dolan II/Resolution 95-61 , TIF's are expected to recapture 32% of the traffic impact of new development on the Collector and Arterial Street system. Presently, the TIF for each trip that is generated is $179. The total TIF for an attached, single-family dwelling is $1,790. The applicant has been conditioned to dedicate five (5) feet in order to provide sufficient right-of-way (ROW) on SW 103rd Avenue. Based on past City purchases of residential property for street ROW, residential property is assessed at $2 per square foot. The applicant is being required to dedicate an additional 550 square feet of right-of-way along SW Walnut Street. Assuming a cost of $2 per square foot, it is estimated that the total cost of the dedication is $1,100 (550 sq. ft. x $2). Upon completion of this development, the future builders of the residence will be required to pay TIF's of approximately $1,790.00 ($1,790 x 1 dwelling unit). Based on the estimate that total TIF fees cover 32% of the impact on major street improvements citywide, a fee that would cover 100% of this projects traffic impact is $5,593.00 ($1,790 divided by .32). The difference between the TIF paid and the full impact, is considered an unmitigated impact. Since the TIF paid is $1 ,790.00, the unmitigated impact can be valued at $3,803. The estimated costs (in this case, the street dedication) required of the applicant, is less in estimated value than the value of the unmitigated impact. The City finds that the conditions meet the rough proportionality test. • NOTICE OF DECISION GOTTER/MILROY PARTITION-MLP 98-0004 PAGE 6 OF 10 • • Sections 18.164.030 (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drains) have been addressed and are satisfied as specified below: STREETS: This site lies adjacent to SW 103rd Avenue, which is classified as a local residential street which requires a 50-foot right-of-way (ROW). At present, there is 40 feet of ROW • adjacent to this site. The applicant proposes to dedicate additional ROW to provide 25 feet from centerline; this dedication will meet City standards. The roadway is paved but not fully improved to City standards. The Tigard Municipal Code (TMC) Chapter 18.164.030(A)(1)(a) states that streets within a development and streets adjacent shall be improved in accordance with City standards. However, 18.164.030(A)(1)(c) states that the City may accept a future improvement guarantee in-lieu of street improvements if the improvement associated with the project does not, by itself, provide a significant improvement to the street safety or capacity. Although this development will incrementally increase the amount of traffic on the roadway, the increase will not substantially degrade the level of service on the street. A street improvement adjacent to this site, therefore, will not significantly improve the safety or capacity of the street. Staff therefore recommends that the applicant be required to enter into a non-remonstrance agreement with the City whereby the owner agrees to participate in any future widening project for the street carried out through a local improvement district. This agreement must be executed prior to approval of the final plat. Access The applicant is proposing to access Parcel 2 from SW Murdock Street via an existing access easement across the adjacent property to the east (Tax Lot 2503). Parcel 1 has access onto SW 103rd Avenue. WATER: This property lies within the City's water service area. There is an existing public water line in SW Murdock Street that is able to serve Parcel 2; Parcel 1 is presently served by the water system. The applicant's plan indicates that a new water service will be extended in the driveway for Parcel 2. SANITARY SEWER: The closest public sanitary sewer line to this site is over 300 feet to the north. The City's sanitary sewer service regulations indicate that a property owner may not be required to connect to a public sewer if the main line is over 300 feet away. The applicant has proposed to install a new septic system and drain field to serve Parcel 2; Parcel 1 is presently served from an on-site septic system. The Washington County Health Department will approve the installation of the new septic system and the continued use of the existing system for Parcel 1 due to the distance between the site and the nearest public sewer line and because each parcel is over 20,000 square feet in size. NOTICE OF DECISION GOTTER/MILROY PARTITION-MLP 98-0004 PAGE 7 OF 10 • • Therefore, Staff recommends approval of this partition with the use of on-site private septic systems and drainfields. STORM DRAINAGE: The topography of this site falls to the southeast. The applicant's plan indicates that they will route the rain drains from the new house on Parcel 2 to the existing roadside ditch adjacent to SW Murdock Street. The ditch flows to the east. This concept is acceptable to Staff. STORM WATER QUALITY: The City has agreed to enforce Surface Water Management (SWM) regulations established by the Unified Sewerage Agency (USA) Design and Construction Standards (adopted by Resolution and Order No. 96-44) which require the construction of on-site water quality facilities. However, the USA standards include a provision that would exclude small projects such as residential land partitions. It would be impractical to require an on-site water quality facility to accommodate treatment of the storm water from Parcel 2. Rather, the USA standards provide that applicants should pay a fee in- lieu of constructing a facility if deemed appropriate. Staff recommends payment of the fee in-lieu on this application. GRADING AND EROSION CONTROL: USA Design and Construction Standards also regulates erosion control to reduce the amount of sediment and other pollutants reaching the public storm and surface water system resulting from development, construction, grading, excavating, clearing, and any other activity which accelerates erosion. Per USA regulations, the applicant is required to submit an erosion control plan for City review and approval prior to issuance of City permits. SITE PERMIT REQUIRED: The applicant is required to obtain a Site Permit from the Building Division to cover all on-site private utility installations (water, sewer, storm, etc.) and driveway construction. This permit shall be obtained prior to approval of the final plat. EXISTING OVERHEAD UTILITY LINES: There are existing overhead utility lines adjacent to SW 103rd Avenue. Section 18.164.120 of the TMC requires all overhead utility lines adjacent to a development to be placed underground or, at the election of the developer, a fee in-lieu of undergrounding can be paid. If the fee in-lieu is proposed, it is equal to $27.50 per lineal foot of street frontage that contains the overhead lines. The frontage along this site is 110 lineal feet; therefore, the fee would be $ 3,025. V. STAFF COMMENTS The City of Tigard Building Division states that review of the following items shall be required prior to the recording of the partition plat. County approval will be required for a proposed drainfield; 2. most remote exterior wall of home cannot be more than 300 feet from SW Murdock Street or provide fire truck turnaround; 3. not less than 15-foot-wide all weather access road; 4. fire hydrant within 500 feet of most remote exterior walls; and 5. connection to public sanitary sewer is required, contact U.S.A. for exception. The City of Tigard Water Department states that due to the distance from SW Murdock, a one (1)-inch meter will be required. Also all portions of the proposed new home must be within 500 feet of a fire hydrant as measured along accessible roadways. Depending on the location of the home, it appears that a fire hydrant will be required. The City of Tigard Police Department and City of Tigard Maintenance Services Division have reviewed the proposal and have offered no comments or objections. VI. AGENCY COMMENTS Unified Sewerage Agency has the following comments: Sanitary Sewer: Each lot within the development shall be provided with a means of disposal for sanitary sewer. The means of disposal should be in accordance with R&O 96-44 (Unified Sewerage Agency's Construction Design Standards, July 1996 edition). Engineer should verify public sanitary sewer is available to up-hill adjacent properties or extend service as required by R&O 96-44. Storm Sewer: Each lot within the development should have access to public storm sewer. Engineer should verify that public storm sewer is available to up-hill adjacent properties, or extend storm service as required by R&O 96-44. Hydraulic and hydrological analysis of storm conveyance system is necessary. If downstream storm conveyance does not have the capacity to convey the volume during a 25-year, 24-hour storm event, the applicant is responsible for mitigating the flow. Water Quality: Developer should provide a water quality facility to treat the new impervious surface being constructed as part of this development. Fee in-lieu is acceptable for this partition. GTE states that Parcel 2 will be required to place their own service drop out to SW Murdock Street in conduit or an open trench. BACKGROUND INFORMATION Property History: No development applications were found to have previously been filed with the City. Site Information and Proposal Description: The property is currently developed with a single-family residence. The applicant is proposing to divide one (1) parcel of approximately 43,560 square feet into two (2) parcels of approximately 20,000 square feet and 23,560 square feet. IV. APPLICABLE REVIEW CRITERIA AND FINDINGS - MINOR LAND PARTITION Section 18.162.040 contains the following general approval criteria for a Minor Land Partition: 1. The proposal conforms with the City's Comprehensive Plan; NOTICE OF DECISION GOTTER/MILROY PARTITION-MLP 98-0004 PAGE 3 OF 10 • • • 2. The proposed partition complies with all statutory and ordinance requirements and regulations; 3. Adequate public facilities are available to serve the proposal; 4. All proposed lots conform to the size and dimensional requirements of this title; and 5. All proposed improvements meet City and applicable agency standards (Ord. 89-06; Ord. 83-52). The proposal conforms with the City's Comprehensive Plan in that, the newly created lot will continue to allow for residential development. This proposal, therefore, is not in conflict with the Low Density Plan designation. This proposed partition complies with all statutory and ordinance requirements and regulations as demonstrated both by the analysis presented within this administrative decision, and by this application and review process. Adequate public facilities are or will be conditioned to be available to serve the proposal. Section 18.162.050 contains the following special provisions for lots created through the Partition Process: 1. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. 2. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. 3. Lot Frontage: Each lot created through the partition process shall front a public right-of-way by at least 15 feet, or have a legally recorded minimum 15 foot wide access easement. 4. Setbacks: Setbacks shall be as required by the applicable zoning district. 5. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. 6. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. 7. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. 8. Reciprocal Easements: Where a common drive is to be provided to serve more than one (1) lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. 9. Accesswav: Any accessway shall comply with the standards set forth in Chapter 18.108; Access, Egress, and Circulation. NOTICE OF DECISION GOTTER/MILROY PARTITION-MLP 98-0004 PAGE 4 OF 10 • • 10. Floodplain: Where landfill and/or development is allowed within or adjacent to the one-hundred-year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. Criteria 1 is satisfied as the proposed lot widths are approximately 110 and 124 feet respectively, exceeding the minimum 50-foot lot width requirement in the R-4.5 zone. Criteria 2 is satisfied as this partition would create lots of approximately 23,560 and 20,000 square feet, exceeding the 7,500 square foot minimum lot size requirement. Criteria 3 is satisfied as Parcel 1 has 110 feet of frontage on SW 103rd Avenue and Parcel 2 has 25 feet of frontage on SW Murdock Street via a 50-foot access easement. The required setbacks in the R-4.5 zone are as follows: front yard-20 feet; side yard-5 feet; rear yard-15 feet; and garage-20 feet. Accessory structures are required to maintain a minimum side and rear yard setback of five (5) feet. As indicated on the site plan, the existing single-family home and accessory structure on Parcel 1 complies with, the applicable setbacks, satisfying Criteria 4. Compliance with flag lot setbacks on the, newly created Parcel 2 will be reviewed when it is built upon. Criteria 5 shall be satisfied as the front yard determination for the new Parcel 2 shall be reviewed during the building permit process when the property is built upon. Front yard determination for Parcel 1 is not applicable as this lot is not a flag lot. Criteria 6 is satisfied as the driveway for Parcel 2 is screened by an existing hedge. Fire hydrants shall be consistent with Uniform Fire Code standards, thereby, satisfying Criteria 7. Criteria 8 is satisfied as the proposed partition will not create the need for a common driveway between the two (2) parcels. The proposed Parcel 2 will be using a driveway within an access easement on the adjoining property to the east. The applicant has provided a copy of the access easement. Criteria 9 shall be satisfied as Parcel 1 will continue to use the existing driveway and the proposed Parcel 2 will be served by a minimum 10-foot-wide paved driveway. A revised plan shall be submitted that shows the location of the proposed residence in order to determine if a fire apparatus turnaround shall be required in accordance with Section 18.107.070 and the Uniform Fire Code. Criteria 10 is not applicable as neither of the parcels are within the floodplain. NOTICE OF DECISION GOTTER/MILROY PARTITION-MLP 98-0004 PAGE 5 OF 10 • • Section 18.88.010 (Solar Access) states that all newly created lots within the City of Tigard shall promote the use of renewable energy sources by providing for improved access to sunlight for residential dwellings. A lot meets the basic requirement if it has a north-south dimension of 90 feet or more and has a front lot line that is oriented within 30 degrees of a true east-west axis. The proposed lot complies with this section as the north-south dimension is 125 feet and the flag lot, front lot line will be oriented within 30 degrees of a true east-west axis. Impact Study: Section 18.32.050 states that the applicant shall provide an impact study to quantify the effect of development on public facilities and services. For each public facility system and type of impact, the study shall propose improvements necessary to meet City standard, and to minimize the impact of the development on the public at large, public facilities systems, and affected private property users. In situations where the Community Development Code requires the dedication of real property interests, the applicant shall either specifically concur with a requirement for public right-of-way dedication, or provide evidence that supports that the real property dedication requirement is not roughly proportional to the projected impacts of the development. Section 18.32.250 states that when a condition of approval requires the transfer to the public of an interest in real property, the approval authority shall adopt findings which support the conclusion that the interest in real property to be transferred is roughly proportional to the impact the proposed development will have on the public. Any required street improvements to certain collector or higher volume streets and the Washington County Traffic Impact Fee (TIF) are mitigation measures that are required at the time of development. Based on a transportation impact study prepared by Mr. David Larson for the A-Boy Expansion/Dolan II/Resolution 95-61 , TIF's are expected to recapture 32% of the traffic impact of new development on the Collector and Arterial Street system. Presently, the TIF for each trip that is generated is $179. The total TIF for an attached, single-family dwelling is $1,790. The applicant has been conditioned to dedicate five (5) feet in order to provide sufficient right-of-way (ROW) on SW 103rd Avenue. Based on past City purchases of residential property for street ROW, residential property is assessed at $2 per square foot. The applicant is being required to dedicate an additional 550 square feet of right-of-way along SW Walnut Street. Assuming a cost of $2 per square foot, it is estimated that the total cost of the dedication is $1,100 (550 sq. ft. x $2). • Upon completion of this development, the future builders of the residence will be required to pay TIF's of approximately $1,790.00 ($1,790 x 1 dwelling unit). Based on the estimate that total TIF fees cover 32% of the impact on major street improvements citywide, a fee that would cover 100% of this projects traffic impact is $5,593.00 ($1,790 divided by .32). The difference between the TIF paid and the full impact, is considered an unmitigated impact. Since the TIF paid is $1 ,790.00, the unmitigated impact can be valued at $3,803. The estimated costs (in this case, the street dedication) required of the applicant, is less in estimated value than the value of the unmitigated impact. The City finds that the conditions meet the rough proportionality test. NOTICE OF DECISION GOTTER/MILROY PARTITION-MLP 98-0004 PAGE 6 OF 10 • 1 Sections 18.164.030 (Streets), 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drains) have been addressed and are satisfied as specified below: STREETS: This site lies adjacent to SW 103rd Avenue, which is classified as a local residential street which requires a 50-foot right-of-way (ROW). At present, there is 40 feet of ROW adjacent to this site. The applicant proposes to dedicate additional ROW to provide 25 feet from centerline; this dedication will meet City standards. The roadway is paved but not fully improved to City standards. The Tigard Municipal Code (TMC) Chapter 18.164.030(A)(1)(a) states that streets within a development and streets adjacent shall be improved in accordance with City standards. However, 18.164.030(A)(1)(c) states that the City may accept a future improvement guarantee in-lieu of street improvements if the improvement associated with the project does not, by itself, provide a significant improvement to the street safety or capacity. Although this development will incrementally increase the amount of traffic on the roadway, the increase will not substantially degrade the level of service on the street. A street improvement adjacent to this site, therefore, will not significantly improve the safety or capacity of the street. Staff therefore recommends that the applicant be required to enter into a non-remonstrance agreement with the City whereby the owner agrees to participate in any future widening project for the street carried out through a local improvement district. This agreement must be executed prior to approval of the final plat. Access The applicant is proposing to access Parcel 2 from SW Murdock Street via an existing access easement across the adjacent property to the east (Tax Lot 2503). Parcel 1 has access onto SW 103rd Avenue. WATER: This property lies within the City's water service area. There is an existing public water line in SW Murdock Street that is able to serve Parcel 2; Parcel 1 is presently served by the water system. The applicant's plan indicates that a new water service will be extended in the driveway for Parcel 2. SANITARY SEWER: The closest public sanitary sewer line to this site is over 300 feet to the north. The City's sanitary sewer service regulations indicate that a property owner may not be required to connect to a public sewer if the main line is over 300 feet away. The applicant has proposed to install a new septic system and drain field to serve Parcel 2; Parcel 1 is presently served from an on-site septic system. The Washington County Health Department will approve the installation of the new septic system and the continued use of the existing system for Parcel 1 due to the distance between the site and the nearest public sewer line and because each parcel is over 20,000 square feet in size. NOTICE OF DECISION GOTTERJMILROY PARTITION-MLP 98-0004 PAGE 7 OF 10 • • Therefore, Staff recommends approval of this partition with the use of on-site private septic systems and drainfields. STORM DRAINAGE: The topography of this site falls to the southeast. The applicant's plan indicates that they will route the rain drains from the new house on Parcel 2 to the existing roadside ditch adjacent to SW Murdock Street. The ditch flows to the east. This concept is acceptable to Staff. STORM WATER QUALITY: The City has agreed to enforce Surface Water Management (SWM) regulations established by the Unified Sewerage Agency (USA) Design and Construction Standards (adopted by Resolution and Order No. 96-44) which require the construction of on-site water quality facilities. However, the USA standards include a provision that would exclude small projects such as residential land partitions. It would be impractical to require an on-site water quality facility to accommodate treatment of the storm water from Parcel 2. Rather, the USA standards provide that applicants should pay a fee in- lieu of constructing a facility if deemed appropriate. Staff recommends payment of the fee in-lieu on this application. GRADING AND EROSION CONTROL: USA Design and Construction Standards also regulates erosion control to reduce the amount of sediment and other pollutants reaching the public storm and surface water system resulting from development, construction, grading, excavating, clearing, and any other activity which accelerates erosion. Per USA regulations, the applicant is required to submit an erosion control plan for City review and approval prior to issuance of City permits. SITE PERMIT REQUIRED: The applicant is required to obtain a Site Permit from the Building Division to cover all on-site private utility installations (water, sewer, storm, etc.) and driveway construction. This permit shall be obtained prior to approval of the final plat. EXISTING OVERHEAD UTILITY LINES: There are existing overhead utility lines adjacent to SW 103rd Avenue. Section 18.164.120 of the TMC requires all overhead utility lines adjacent to a development to be placed underground or, at the election of the developer, a fee in-lieu of undergrounding can be paid. If the fee in-lieu is proposed, it is equal to $27.50 per lineal foot of street frontage that contains the overhead lines. The frontage along this site is 110 lineal feet; therefore, the fee would be $ 3,025. V. STAFF COMMENTS The City of Tigard Building Division states that review of the following items shall be required prior to the recording of the partition plat. County approval will be required for a proposed drainfield; 2. most remote exterior wall of home cannot be more than 300 feet from SW Murdock Street or provide fire truck turnaround; 3. not less than 15-foot-wide all weather access road; 4. fire hydrant within 500 feet of most remote exterior walls; and 5. connection to public sanitary sewer is required, contact U.S.A. for exception. The City of Tigard Water Department states that due to the distance from SW Murdock, a one (1)-inch meter will be required. Also all portions of the proposed new home must be within 500 feet of a fire hydrant as measured along accessible roadways. Depending on the location of the home, it appears that a fire hydrant will be required. The City of Tigard Police Department and City of Tigard Maintenance Services Division have reviewed the proposal and have offered no comments or objections. VI. AGENCY COMMENTS Unified Sewerage Agency has the following comments: Sanitary Sewer: Each lot within the development shall be provided with a means of disposal for sanitary sewer. The site is located at 14700 SW 103rd Avenue ( WCTM 2S1 11 BC, Tax Lot 2400). Findings: 1. Streets: This site lies adjacent to SW 103rd Avenue, which is classified as a local residential street which requires a 50-foot right-of-way (ROW). At present, there is 40 feet of ROW adjacent to this site. The applicant proposes to dedicate additional ROW to provide 25 feet from centerline; this dedication will meet City standards. The roadway is paved but not fully improved to City standards. TMC 18.164.030(A)(1)(a) states that streets within a development and streets adjacent shall be improved in accordance with City standards. However, 18.164.030(A)(1)(c) states that the City may accept a future improvement guarantee in lieu of street improvements if the improvement associated with the project does not, by itself, provide a significant improvement to the street safety or capacity. Although this development will incrementally increase the amount of traffic on the roadway, the increase will not substantially degrade the level of service on the street. A street improvement adjacent to this site, therefore, will not significantly improve the safety or capacity of the street. Staff therefore recommends that the applicant be required to enter into a non-remonstrance agreement with the City whereby the owner agrees to participate in any future widening project for the street carried out through a local improvement district. This agreement must be executed prior to approval of the final plat. ENGINEERING COMMENTS MLP 98-0004 Gotter/Milroy Partition PAGE 1 • • Access The applicant is proposing to access Parcel 2 from SW Murdock Street via an existing access easement across the adjacent property to the east (Tax Lot 2503). Parcel 1 has access onto SW 103rd Avenue. 2. Water: This property lies within the City's water service area. There is an existing public water line in SW Murdock Street that is able to serve Parcel 2; Parcel 1 is presently served by the water system. The applicant's plan indicates that a new water service will be extended in the driveway for Parcel 2. 3. Sanitary Sewer: The closest public sanitary sewer line to this site is over 300 feet to the north. The City's sanitary sewer service regulations indicate that a property owner may not be required to connect to a public sewer if the main line is over 300 feet away. The applicant has proposed to install a new septic system and drain field to serve Parcel 2; Parcel 1 is presently served from an on-site septic system. The Washington County Health Department will approve the installation of the new septic system and the continued use of the existing system for Parcel 1 due to the distance between the site and the nearest public sewer line and because each parcel is over 20,000 square feet in size. Therefore, Staff recommends approval of this partition with the use of on- site private septic systems and drainfields. 4. Storm Drainage: The topography of this site falls to the southeast. The applicant's plan indicates that they will route the rain drains from the new house on Parcel 2 to the existing roadside ditch adjacent to SW Murdock Street. The ditch flows to the east. This concept is acceptable to Staff. 5. Storm Water Quality: The City has agreed to enforce Surface Water Management (SWM) regulations established by the Unified Sewerage Agency (USA) Design and Construction Standards (adopted by Resolution and Order No. 96-44) which require the construction of on-site water quality facilities. However, the USA standards include a provision that would exclude small projects such as residential land partitions. It would be impractical to require an on-site water quality facility to accommodate treatment of the storm water ENGINEERING COMMENTS MLP 98-0004 Gotter/Milroy Partition PAGE 2 • . from Parcel 2. Rather, the USA standards provide that applicants should pay a fee in-lieu of constructing a facility if deemed appropriate. Staff recommends payment of the fee in-lieu on this application. 6. Grading and Erosion Control: USA Design and Construction Standards also regulates erosion control to reduce the amount of sediment and other pollutants reaching the public storm and surface water system resulting from development, construction, grading, excavating, clearing, and any other activity which accelerates erosion. Per USA regulations, the applicant is required to submit an erosion control plan for City review and approval prior to issuance of City permits. 7. Existing Overhead Utility Lines: There are existing overhead utility lines adjacent to SW 103rd Avenue. Section 18.164.120 of the TMC requires all overhead utility lines adjacent to a development to be placed underground or, at the election of the developer, a fee in-lieu of undergrounding can be paid. If the fee in-lieu is proposed, it is equal to $ 27.50 per lineal foot of street frontage that contains the overhead lines. The frontage along this site is 110 lineal feet; therefore the fee would be $ 3,025.00. 8. Site Permit Required: The applicant is required to obtain a Site Permit from the Building Division to cover all on-site private utility installations (water, sewer, storm, etc.) and driveway construction. This permit shall be obtained prior to approval of the final plat. Recommendations: THE FOLLOWING CONDITIONS SHALL BE SATISFIED PRIOR TO APPROVAL OF THE FINAL PLAT: Note: Unless otherwise noted, the staff contact for the following conditions will be Brian Rager, Engineering Department (639-4171). 1. Prior to approval of the final plat, a Street Opening Permit will be required for this project to cover the storm drainage outfall into the ditch in Murdock Street as well as the driveway approach onto Murdock Street. . The applicant will need to submit five (5) copies of a proposed public improvement plan for review and approval. As a part of the public improvement plan submittal, the Engineering Department shall be provided with the name, address and telephone number of the individual or corporate entity who will be responsible for executing the compliance agreement and providing the financial assurance for the public improvements. 3. The final plat shall show on its face a right-of-way dedication adjacent to SW 103rd Avenue to provide a total of 25 feet east of centerline. 4. Prior to approval of the final plat, the applicant shall obtain a Site Permit from the Building Department to cover all grading for the lot(s), all on-site private utility installation (water, sewer, storm, etc.) and all driveway construction. NOTE: this permit is separate from any permit issued by the Engineering Department for work in the public right-of-way. 5. An agreement shall be executed by the applicant, on forms provided by the City, which waives the property owner's right to oppose or remonstrate against a future Local Improvement District formed to improve SW 103rd Avenue. 6. The applicant shall either place the existing overhead utility lines along SW 103rd Avenue underground as a part of this project, or they shall pay the fee in-lieu of undergrounding. The fee shall be calculated by the frontage of the site that is parallel to the utility lines and will be $ 27.50 per lineal foot. If the fee option is chosen, the amount will be $ 3,025.00 and it shall be paid prior to approval of the final plat. 7. Final Plat Application Submission Requirements: A.
