The City of Tigard proposes to amend Community Development Code Chapter 18.780 Signs,
Sections 18.780.130 C.2.a, D.2.a, E.2.a and F.2.a to restrict the size of wall signs to a maximum of
200 square feet and to clarify that the definition of freeway- oriented sign (18.780.015 A.25) is a free
standing and not a wall sign; require that non - painted wall signs (18.780.015 A.55) must be enclosed
by a rigid frame and may not be made of fabric, vinyl or other non -rigid material except for awning
or canopy signs. The amendment also makes Section 18.780.130 D consistent with other zones by
stating building face rather than wall face. The proposed code language follows:
CHAPTER 18.780 SIGNS
18.780.015 Definitions
A. Definitions. As used in this title, unless the context requires otherwise, the following words and phrases
shall have the meanings set forth in this chapter. The definitions to be used in this chapter are in
addition to Chapter 18.110, Definitions, and are as follows:
25. "Freeway- oriented sign" means a sign primarily designed to be read by a motorist traveling on a
highway designated by the Oregon State Highway Department as a freeway or expressway;
specifically, these shall be Interstate 5 and Oregon State Highway #217, and shall not include
Highway 99W. Freeway- oriented signs are freestanding signs and are not wall signs.
55. "Wall sign" means any sign attached to, painted on, or erected against the wall of a building or
structure with the exposed face of the sign in a plane parallel to the plane of the wall. Non - painted
wall signs must be enclosed in a rigid frame and may not be made of fabric, vinyl or other
non -rigid material except for awning or canopy signs.
18.780.130 Zoning District Regulations
C. In the C -G and NM -CBD zones. No sign shall be permitted in the C -G and MU -CBD zones except for
the following:
1. Freestanding signs shall have certain limitations and conditions when permitted on properties in
commercial zones:
a. One multi- faced, freestanding sign shall be permitted subject to conditions and limitations as
stated herein,
b. A reader -board assembly may be an integral part of the freestanding sign,

c. The maximum square footage of signs shall be 70 square feet per face or a total of 140 square
feet for all sign faces. No part of any freestanding sign shall extend over a property line into
public right -of -way space,
d. The sign area may be increased one square foot for each lineal foot the sign is moved back from
the front property line to which the sign is adjacent. If the street is curbed and paved, the
measurement may be taken from a point which is 15 feet from the pavement. This increase in
sign area is limited to a maximum of 90 square feet per face or a total of 180 square feet for all
faces, and
e. Freestanding signs located next to the public right -of -way shall not exceed 20 feet in height.
Height may be increased one foot in height for each 10 feet of setback from the property line or
a point 15 feet from the edge of pavement, whichever is less, to a maximum of 22 feet in height;
2. Wall Signs.
a. Wall signs, including illuminated reader - boards, may be erected or maintained but shall not
exceed in gross area 15% of any building face or a maximum of 200 square feet, whichever is
less of any building face on which the sign is to be mounted,
b. Wall signs may not project more than 18 inches from the wall or extend above the wall to which
they are attached, and
c. If it is determined under the development review process that the wall sign's visual appeal and
overall design quality would be served, an additional 50% of the allowable sign area may be
permitted. No copy will be permitted, however, in the additional area permitted. For purposes of
this subsection, "copy" includes symbols, logos, and letters;
3. Directional signs on private property when such signs are solely designed to identify driveway
entrances and exits for motorists on adjoining public streets. One sign with an area of four square
feet per face shall be permitted per driveway. Such signs shall be consistent with Chapter 18.795,
Visual Clearance Areas;
4. Electronic message centers per Section 18.780.090.D shall be permitted;
5. The signs specified in Section 18.780.060.A shall be allowed, subject to any restrictions imposed by
this title;
6. Temporary signs in accordance with Sections 18.780.090 and 18.780.100;
7. Lawn signs in accordance with Sections 18.780.060.A.1, A.6, and B.2;
8. Special condition signs in accordance with Section 18.780.090; and
9. Additional permitted sign including awning sign(s), flush pitched "roof" sign(s), freeway- oriented
sign(s), tenant sign(s), projecting sign(s), and painted wall sign(s).
D. In the C -P zone. No sign shall be permitted in the C -P zone except for the following.
1. Freestanding signs shall have certain limitations and conditions when permitted on properties zoned
C -P including:

a. One multifaced, freestanding sign per premises shall be permitted, subject to conditions and
limitations as stated herein,
b. A reader -board assembly may be an integral part of the freestanding sign,
c. The maximum square footage of freestanding signs shall be 32 square feet per face or a total of
64 square feet for all sign faces. No part of any freestanding sign shall extend over a property line
into public right -of -way space,
d. The sign area may be increased one square foot for each lineal foot the sign is moved back from
the front property line to which the sign is adjacent. If the street is curbed and paved the
measurement may be taken from a point which is 15 feet from the pavement. This increase in
sign area is limited to a maximum of 52 square feet per face or a total of 104 square feet for all
faces, and
e. Freestanding signs located next to the public right -of -way shall not exceed eight feet in height.
Height may be increased one foot in height for each 10 feet of setback from the property line or
a point 15 feet from the edge of pavement whichever is less to a maximum of 10 feet in height;
2. Wall signs shall have certain limitations and conditions when permitted on properties zoned C -P
including:
a. Wall signs, including illuminated reader - boards, may be erected or maintained but shall not
exceed five percent in gross area of any building face or a maximum of 200 square
feet, whichever is less of any building face on which the sign is to be mounted,
b. Wall signs shall be parallel to the face of the building upon which the sign is located, and
c. If it is determined under the development review process that the wall sign's visual appeal and
overall design quality would be served, an additional 50% of the allowable sign area may be
permitted. No copy will be permitted, however, in the additional area permitted. For purposes of
this subsection, "copy" includes symbols, logos and letters;
3. Directional signs on private property when such signs are solely designed to identify driveway
entrances and exits for motorists on adjoining public streets. One sign with an area of four square
feet per face shall be permitted per driveway. Such signs shall be consistent with Chapter 18.795,
Visual Clearance Areas;
4. Temporary signs in accordance with Sections 18.780.090 and 18.780.100;
5. Lawn signs in accordance with Sections 18.780.060.A.1, A.6, and B.2;

was originally scheduled to be in front of the City Council today. I have a client who has an interest in this
amendment so i just wanted to confirm in writing what we discussed about this amendment yesterday. You
informed me that there was no meeting today as it is the 5Th Tuesday of the month, and that in fact the next
council meeting is on July 12Th. You also informed me that this particular DCA was tabled for the time being

This form must be received by DLCD at least 45 days prior to the first evidentiary hearing
per ORS 197.610 and OAR Chapter 660, Division 18

must include the text of the amendment and any other information the local government believes is
necessary to advise DLCD of the effect of the proposal. "Text" means the specific language being
added to or deleted from the acknowledged plan or land use regulations. A general description of the
proposal is not adequate. Do Not Submit Form 1 Without Supporting Documentation.
4. Maps: Submittal of a proposed map amendment must also include a map of the affected area
showing existing and proposed plan and zone designations. The map should be legible and on 8'/2 x
11 inch paper. Please provide the specific location of property, such as an address and tax lot
number. Include text regarding background, justification for the change, and the application if there
was one accepted by the local government.
5. Exceptions: Submittal of proposed amendments that involve a goal exception must include the
proposed language of the exception.
6. Unless exempt by ORS 197.610(2), proposed amendments must be received at the DLCD's Salem
office at least 45 -days before the first evidentiary hearing on the proposal. (The clock begins on the
day DLCD Receives your proposal in the Salem Office.) The first evidentiary hearing is usually the

I received the Request for Comments on this proposed amendment to the City of
Tigard's sign code.
The state of Oregon regulates signs people erect on private property where visible to a
state highway. The laws and administrative rules are called the Oregon Motorist
Information Act, or OMIA (ORS 377.700- 377.840 & 377.992; OAR Division 734
chapters 59 through 65). The Oregon Department of Transportation (ODOT)
implements those regulations for the state. ODOT's Outdoor Advertising Sign Program
administers the OMIA, and in my position as manager of that program I am providing
the following comments.
Under state law, the definition of "sign" includes any sign or display intended to attract
motorists' attention, regardless of its construction. Any sign visible to state highway,
whether freestanding, on a wall, or other, falls under the requirements of the OMIA. The
way in which your proposed code change may impact administration of the state's laws
is that your section 18.780.090(E)(1) references the OMIA in relation to freeway
oriented signs and the proposal may exclude wall signs from that requirement.
State law does not allow my office to issue a sign permit unless an official of the local
jurisdiction has signed the affidavit on our application form confirming that the sign
meets local requirements. That signature must be obtained by applicant before we
consider that application complete. My office encourages contact from local
jurisdictions when they receive a local application for a sign that will fall under the
requirements of the OMIA, so the local and the applicant can be made aware of any
issues or concerns before getting too far in the process.
