NOTICE OF TYPE I DECISION a LOT LINE ADJUSTMENT (LLA) 2011 -00003 • PACIFIC REALTY ASSOCIATES LOT LINE ADJUSTMENT T I GA R D 120 DAYS 11/8/2011 SECTION I. APPLICATION SUMMARY FILE NAME: PACIFIC REALTY ASSOCIATES LOT LINE ADJUSTMENT CASE NO.: Lot Line Adjustment (LLA) Ml2011 -00003 PROPOSAL: The applicant is proposing to adjust two (2) lot lines, which will reconfigure three (3) different lots. The three lots are located within the City of Tigard's Incorporated Boundary. Lot #1 (Tax Lot 4200) of .58 acres will become 3.08 acres, Lot #2 (Tax Lot 101) of 17.13 acres will become 2.57 acres, and Lot #3 (Tax Lot 1400) of .45 acres will become 12.46 acres. APPLICANT/ OWNER: Eric Sporre Pacific Realty Associates, L.P. 15350 SW Sequoia Pkwy, Suite 300 Portland, OR 97224 LOCATIONS: LOT 1: WCTM IS136CD, Tax Lot 04200 (No Address) (.58 acres) LOT 2: WCTM 2S101BA, Tax Lot 000101 (No Address) (17.13 acres) LOT 3: WCTM 2S101AB, Tax Lot 01400 (No Address) (.45 acres) The properties are located west of SW 72n Avenue and south of SW Dartmouth Street. COMPREHENSIVE PLAN AND ZONING DESIGNATIONS: General Commercial District with Planned Development Overlay; C -G (PD). The C -G zoning district is designed to accommodate a full range of retail, office and civic uses with a City -wide and even regional trade area; except where non- conforming, residential uses are limited to single - family residences which are located on the same site as a permitted use. The purposes of the planned development overlay zone are to provide means for creating planned environments through the application of flexible standards, facilitate the efficient use of land, promote an economic arrangement of land use, preserve existing landscape features, and to maximize innovative and diversified living environments. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.350, 18.390, 18.410 and 18.520. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee APPROVES the above request subject to certain conditions of approval. The findings and conclusions on which the decision is based are noted in Section IV. NOTICE OF TYPE I DECISION PAGE 1 OF 5 LLA2011 -00003 - PACIFIC REALTY ASSOCIATES, L.P LOT LINE ADJUSTMENT • CONDITION OF APPROVAL AFTER RECORDING THE LOT LINE ADJUSTMENTS, THE FOLLOWING CONDITION SHALL BE SATISFIED: The staff contact shall be Gary Pagenstecher in the planning division at 503 - 718 -2434. The applicant shall submit a copy of the recorded lot line adjustment survey map to the City within 15 days of recording and within 18 months of this decision and shall be completed prior to the issuance of any building permits on the re- configured lots. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: Tax Lots 4200, 101 and 1400 are located within the City of Tigard's Incorporated Boundary and within the Tigard Triangle, zoned C -G (PD). All subject lots are vacant land. Proposal Description: The applicant is proposing to adjust two (2) lot lines, which will reconfigure three (3) different lots. The three lots are located within the City of Tigard's Incorporated Boundary. Lot #1 (Tax Lot 4200) of .58 acres will become 3.08 acres, Lot #2 (Tax Lot 101) of 17.13 acres will become 2.57 acres, and Lot #3 (Tax Lot 1400) of .45 acres will become 12.46 acres. The proposed lot line adjustment reconfigures the existing lots to accommodate the proposed development as shown in the Preliminary Lot Line Adjustment Plan (PLL -1.0) and as approved in Final Order No. 2009 -02 PC (PDR2008- 00001). The proposed lot line adjustments were earlier approved under MIS2008 -00015 but were never recorded and have since expired. With this application the applicant seeks to reestablish the lot line adjustment permits. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: LOT LINE ADJUSTMENT - APPROVAL STANDARDS: Section 18.410.040 contains the following standards for approval of a Lot Line Adjustment request: Section 18.410.040 - Approval Criteria states that the Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; No new lots will be created as part of this adjustment; three (3) lots exist and three (3) lots will remain after the proposed lot line adjustments. There is no minimum lot size in the G -C zoning designation. Therefore, this standard is satisfied. By reducing the lot size the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; The subject property is vacant land. The applicant has obtained Planned Development Detailed Development Plan approval for the site (PDR2008 -00001 and PDR2010- 00001). Therefore, this standard is satisfied. NOTICE OF TYPE DECISION PAGE 2 OF 5 I,LA2011- 00003 - PACIFIC REALTY AL Y ASSOCIATES, LP LOT LINE ADJUSTMENT The resulting parcels are in conformity with the dimensional standards of the zoning district, including: • The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; • The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the access way may not be included in the lot area calculation; ♦ Each lot created through the partition process shall front a public right -of -way by at least 15 feet or have a legally recorded minimum 15 -foot wide access easement; and • Setbacks shall be as required by the applicable zoning district. In the General Commercial zoning district there is a minimum lot width of 50 feet and no setbacks are required. Therefore, the minimum width of the building envelope is also 50 feet. The building envelopes proposed in the Planned Development Concept Plan (PDR2008- 00001) are consistent with dimensional standards of the C -G district. In the General Commercial zoning district there is no minimum lot size and no flag lots are proposed. No new lots are created through a partition process through this lot line adjustment. Setbacks as proposed in PDR2008 -00001 are consistent with those required in the applicable zoning district. The resulting parcels are, therefore, in conformance with the dimensional standards of the C -G zoning district. With regard to flag lots: • When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. ♦ A screen shall be provided along the property line of a lot of record where the paved drive in an access way is located within ten feet of an abutting lot in accordance with Section 18.745.040. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. There are no flag lots associated with this application. Therefore, this standard does not apply. The fire district may require the installation of a fire hydrant where the length of an access way would have a detrimental effect on fire- fighting capabilities. The approved development, Final Order No. 2009 -02 PC (PDR2008- 00001) meets all fire district requirements. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. As approved in Final Order No. 2009 -02 PC (PDR2008- 00001), the proposed common drives will have a reciprocal easement recorded with the approved map to ensure access and maintenance rights for all parcels. In addition, the proposed development provides shared access to the adjacent properly to the east (TL300). A cross -over easement will be placed on permanent file with the City prior to occupancy of the site. Any access way shall comply with the standards set forth in Chapter 18.705: Access, Egress, and Circulation. As approved in Final Order No. 2009 -02 PC (PDR2008- 00001), the proposed accessways comply with the standards in Chapter 18.705. NOTICE OF TYPE I DECISION PAGE 3 OF 5 LLA2011 -00003 - PACIFIC REALTY ASSOCIATES, LP LOT LINE ADJUSTMENT NT Exemptions from dedications: A lot line adjustment is not considered a development action for purposes of determining whether floodplain, greenway, or right -of -way dedication is required. Floodplam, greenway or right -of -way dedication is not required as part of this application because the proposed lot line adjustments are not considered a development action. The proposed lot line adjustment is exempt from any dedication requirements. However, as approved in Final Order No. 2009 -02 PC (PDR2008- 00001), this project dedicates right -of -way along the Hermoso Way frontage to accommodate the construction of an eyebrow corner per Washington County Standards. Variances to development standards: An application for a variance to the standards prescribed in this chapter shall be made in accordance with Chapter 18.370, Variances and Adjustments. The applicant has not requested a variance or an adjustment with this application. FINDING: Based on the analysis above, staff finds that the proposed Lot Line Adjustments between Lots #1, #2 and #3 meet the applicable criteria. Section 18.410.050 Recording Lot Line Adjustments: A. Recording requirements. Upon the Director's approval of the proposed lot line adjustment, the applicant shall record the lot line adjustment with Washington County and submit a copy of the recorded survey map to the City, to be incorporated into the record. B. Time limit. The applicant shall submit the copy of the recorded lot line adjustment survey map to the City within 15 days of recording and shall be completed prior to the issuance of any building permits on the re- configured lots. FINDING: A condition of approval will ensure that the lot line adjustments meet the recording and time requirements of this standard. The applicant shall submit a copy of the recorded lot line adjustment survey map to the City within 15 days of recording and within 18 months of this decision and shall be completed prior to the issuance of any building permits on the re- configured lots. SECTION V. PROCEDURE AND APPEAL INFORMATION Notice was mailed to the applicant and owners Final Decision: A Lot Line Adjustment is a Type I procedure. As such, the Director's decision is final on the date it is mailed or otherwise provided to the applicant, whichever occurs first. The Director's decision may not be appealed locally and is the final decision of the City. THIS DECISION IS FINAL ON AUGUST 15, 2011, AND BECOMES EFFECTIVE ON AUGUST 16, 2011. This application seeks to reconfigure TL 4200, TL 101, and TL 1400. The lot line adjustment application incorporates the lot line ' configuration associated with the currently approved Planned Development application for this site. A Preliminary Lot Line Adjustment Plan has been included with this application which reconfigures the existing lots to accommodate the proposed development and leasing agreements. Project Site Location: ' The project site is located near the intersection of SE Dartmouth St. and SW 72n Ave. located in the northeast and northwest 1/4 of section 1, township 2 south, range 1 west, and the southeast and southwest 1/4 of section36, township 1 south, range 1 west, Willamette Meridian, City of Tigard, Washington county, Oregon State Tax Lots 4200 (map 1 S136CD), 101 (map 2S101 BA) & 1400(map 2S101AB). The site is located approximately 1/4 mile east ' of Hwy 217. Approvals Requested: The applicant seeks Lot Line Adjustment approval. The approval criteria are addressed in pp 1 Pp pp the following code response sections. 1 1 Chapter 18.410.040 LOT LINE ADJUSTMENTS APPROVAL CRITERIA A. Approval criteria. The Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: 1. An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; Response: No additional parcel is created by the lot line adjustment. All parcels will meet the minimum lot size requirements established by the underlying zoning district. 2. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; t Response: There are no existing structures on any of the three (3) tax lots. All proposed lot sizes comply with the site development and zoning district regulations. ' 3. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: Ma. The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; b. The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation; c. Each lot created through the partition process shall front a public right -of -way by at least 15 feet or have a legally recorded minimum 15 -foot wide access easement; and d. Setbacks shall be as required by the applicable zoning district. Response: The lot line adjustment complies with all applicable dimensional standards, frontage requirements and setbacks of the General Commercial Zone, the Mixed Use Employment Zone, the Tigard Triangle Design Standards and the Planned Development Overlay District. ' 4. With regard to flag lots: a. When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in ' accordance with Sections 18.745.050.
