PROPOSAL: The applicant requests an adjustment to the side yard setback to reduce the
setback from five feet to four feet, a reduction of 20 %, to accommodate

APPROVED the above request subject to certain conditions. The findings and conclusions on

CONDITIONS OF APPROVAL
1) Applicant shall request final inspection of the addition by the Planning Division to close this
case (VAR2011- 00018) and the code enforcement case (DCC2011- 00006) within the time
frame allowed by the current voluntary compliance agreement dated June 1, 2011.
THIS APPROVAL SHALL BE VALID FOR 18 MONTHS
FROM THE EFFECTIVE DATE OF THIS DECISION
SECTION III. BACKGROUND INFORMATION
Site Information:
The site is in the Englewood Subdivision near the intersection of Ironwood Loop and Springwood
Drive. The lot is approximately 8,800 square feet in area.
Site History:
The subject property was approved through review of a subdivision in 1975. This lot is in the interior of
the subdivision with normal setbacks for Residential Zone R -4.5 and is regular in shape.
Proposal Description:
The applicant requests an adjustment to the side yard setback to reduce the setback from five feet to
four feet, a reduction of 20 %, to accommodate construction of an open sided, roofed addition. No
trees will be removed.
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS:

DEVELOPMENT ADJUSTMENT — APPROVAL STANDARDS:
Section 18.370.020.B.1.b provides that up to a 20% reduction of the dimensional standards for the
side and rear yard setbacks required in the base zone may be approved as a Type I Development
Adjustment. Section 18.370.020.B.2, Approval Criteria, provides that a development adjustment
shall be granted if there is a demonstration of compliance with all of the applicable standards:
a. A demonstration that the adjustment requested is the least required to achieve the
desired effect;
The applicant has requested a 20% reduction in the required side yard setback of 5 feet. This
would reduce the side yard setback to 4 feet. All other setbacks will be adhered to. The
adjustment is requested to be able to construct the addition in a manner to maximize use of
the property.
b. The Adjustment will result in the preservation of trees, if trees are present in the
development area;
No trees will be removed as part of this addition.
c. The Adjustment will not impede adequate emergency access to the site;
The Adjustment will not impede emergency access.
d. There is not a reasonable alternative to the Adjustment which achieves the desired
effect.
The placement of the addition is the most reasonable and least intrusive into setbacks. The
addition as it is planned will not intrude into a rear yard. There is no other reasonable
alternative to reach the desired effect.
FINDING: Based on the analysis above, the adjustment criteria have been satisfied.
SECTION V. PROCEDURE AND APPEAL INFORMATION
Notice:
Notice was mailed to the applicant and owners.
Final Decision:
The decision of the Director on Type I Procedure is final on the date it is mailed or otherwise
provided to the applicant, whichever occurs first. The Director's decision may not be appealed
locally and is the final decision of the City.
THE DECISION IS FINAL ON JULY 28, 2011 AND
BECOMES EFFECTIVE ON JULY 29, 2011.

The Company, recognizing the current effect of inflation on real property valuation and intending to provide additional
monetary protection to the Insured Owner named in said Policy, hereby modifies said Policy, as follows:
1. Notwithstanding anything contained in said Policy to the contrary, the amount of insurance provided by
said Policy, as stated in Schedule A thereof, is subject to cumulative annual upward adjustments in the
manner and to the extent hereinafter specified.
2. "Adjustment Date" is defined, for the purpose of this Indorsement, to be 12:01 a.m. on the first January 1
which occurs more than six months after the Date of Policy, as shown in Schedule A of the Policy to which
this Indorsement is attached and on each succeeding January 1.
3. An upward adjustment will be made on each of the Adjustment Dates, as defined above, by increasing the
maximum of insurance provided by said Policy (as said amount may have been increased theretofore
under the terms of this Indorsement) by the same percentage, if any, by which the United States De-
partment of Commerce Composite Construction Cost Index (base period 1967) for the month of Septem-
ber immediately preceding exceeds such Index based upon the preceding year or any previous year;
provided, however, that the maximum amount of insurance in force shall never exceed 175% of the
amount of insurance stated in Schedule A of said Policy, less the amount of any claim paid under said
Policy which, under the terms of the Conditions and Stipulations, reduces the amount of insurance in
force. There shall be no annual adjustment in the amount of insurance for years in which there is no
increase in said Construction Cost Index.
4. In the settlement of any claim against the Company under said Policy, the amount of insurance in force
shall be deemed to be the amount which is in force as of the date on which the insured claimant first learned
of the assertion or possible assertion of such claim, or as of the date of receipt by the Company of the first
notice of such claim, whichever shall first occur
Nothing herein contained shall be construed as extending or changing the effective date of said Policy.
This indorsement is made a part of said Policy and is subject to the schedules, conditions and stipulations therein,
except as modified by the provisions hereof
