The other ownership (Gevurtz) consists of ,only one lot, Tax Lot 100, T2S -R1W, Map 12AD, The properties, along with others, were platted as Bonita Gardens. The Gevurtz property contains a total of 3.79 acres. Therefore the total area of the requested change is 5.47 acres. The properties are situated in the southeast quadrant of the intersections SW Sequoia parkway and Bonita Road. The Gevurtz property also abuts the western right -of -way of the Interstate 5 Freeway, Map 1. The City limits end at the Freeway. East of the freeway is Lake Oswego. REQUESTED ACTION This application represents a request for a Zone Change from I-L. Lioht Industrial to 'I-P, Industrial Park. The entire site area is designated for industrial use on the Comprehensive Plan. An industrial designation is the appropriate land use for the requested zoning. Therefore a Plan Amendment is not required in conjunction with this Zone Change request. CURRENT ZONING and USE The subject properties are designated for Industrial use on the Comprehensive Plan. Both properties are currently zoned I -L, Light Industrial. There are existing buildings on both properties. The Gevurtz property is developed with a retail furniture store and warehouse. The furniture store is a pre - existing non - conforming use in the I -L zone. The Smets property is developed with a manufacturing, office, warehouse building, from which certain operations of Smetco, Inc. are conducted. A building permit has also been issued, and remains active, for an additional warehouse facility. t SURROUNDING ZONING and USE The zoning to the south is I -P, Industrial Park. This area has been re- developed into Pacific Corporate Center. ' Recommended findings have been prepared addressing how the requested change complies with each of these policies. COMPLIANCE. MITE PLAN POLICIES Policy 1.1.2 The City >auxt find that the change is :consistent with the applicable plan policies, that a, change of physical circumstances ham occurred since the original designation, or there is evidence of a change in the . neighborhood or community which affects the subject parcel(s). Alternatively, the City, must find that a mistake was made in the, original designation. The provisions of this policy have been codified into Section 18.22.040. The four approval criteria established in the Code implement this policy, and are addressed in detail below.. Policy 2.2 .1 The City shall maintain an ongoing citizen involvement program and shall assure that citizens will be provided` an opportunity to be involved in all phases of the planning process. Implementation of this Policy is primarily the responsibility of the City. The City has standard practices for ensuring opportunities for continued citizen involvement. Neighborhood Associations are provided with notice of proposed land use actions. The City also provided general public notice of hearings and posts notices in the area of proposed developments. Public hearings are held with opportunities for citizen testimony. Adjacent property owners will also receive notice of the proposal. The applicant has provided the City with mailing addresses for such notice. Policy 4.2.1 All development within the Tigard Urban Planning area shall comply with applicable Federal, State and Regional water quality standards. This Policy is . already -.partially satisfied as_both _properties' have existing buildings on -site. Development of both sites were approved under applicable zoning at the time of development, and was found to be consistent with Federal, State, and Regional standards at the time of development. Subsequent development, consistent with the proposed rezoning, will also be required to demonstrate compliance with current regulations. Compliance will be confirmed at the time of Site Development Review and Building Permits. Compliance with water quality standards is one of the approval criteria for Site Development Review. Policy 5.1.4 The City shall ensure that new commercial and industrial development shall not encroach into residential areas that have not been designated for commercial ` uses. The subject sites are surrounded by industrial uses. The zoning pattern was established consistent with Policy 5.1.4 and the present proposal remains consistent with the established zoning Pattern. The closest residentially designated areas are either east of the Freeway in Lake Oswego, or west of the railroad tracks and Fenno Creek, which is over 2,000 feet away. Fenno Creek provides a physical barrier to industrial encroachment into residential areas, see Map 2. Policy 9.1, 2 As a pre- condition to development: A) Development shall coincide with the availability of adequate service capacity for public water, sewer, and storm drainage; 5) The facilities are capable of serving intervening properties and the proposed development and are designed to City standards; and C) A; ; new development utilities are placed underground. PUBLIC FACILITIES and SERVICES The subject properties are fully served by urban services, including water, sanitary sewer, and storm drainage. Services have been placed underground along SW Sequoia Parkway, which abuts the site. There are no known system deficiencies that would affect adequate services being provided to the subject properties for current or future development. In addition, Service Providers will have the opportunity to comment on the requested zone change. They will also have the opportunity to comment of any subsequent development through the Site Development Review process. Policy 9. d.1 They City shall require as a pre - condition to development that: the development be served by a water ayste hgving adequate water pressure • for fire protection purposes; shall not reduce the water pressure in the area below a level adequate for fire protection purposes; and the applicable fire district review all applications. The requested zone change does not by itself affect the water supply system. However, the entire industrial area including the subject properties is fully served by a public water system operated by the Tigard Water District. Lines are sized in accordance with the District's System Master Plan, and no system deficiencies have been identified. There are fire hydrants on and adjacent to the subject properties. The statewide planning goals adopted under Oregon Revised Statutes Chapter 197, until acknowledgement of the coazprehansivad plaza and ordinances; The City's Comprehensive Plan has been Acknowledged by the LCDC. This application does not involve a plan amendment so there is no direct effect of the requested change on the acknowledged status of the Plan. Since the Plan is acknowledged, there is no need to specifically address the statewide goals; they are now implemented through the City's Plan Policies and Development Code. CRITERIA 3. The applicable standards of any provisions of this code or other applicable implementing ordinances; With the requested change, the zoning will be suhject to the standards and provisions of Chapter 18.68,. I -P, Industrial Park District. Subsequent development or redevelopment will be subject to Site Development Review, under Chapter 18.120, for compliance with the I -P standards. The subject properties meet the dimensional requirements for the I -P District as set forth in Section 18.68.050. There is no specified minimum lot size, and the lot widths are greater than 50 feet. The existing buildings also meet the minimum setback and lot coverage standards for the new zoning district. CRITERIA 4. Evidence of change in the neighborhood or community or a mistake or inconsistency in the comprehensive plan or zoning as it relates to the property which in the subject of the development application. Over the past several years, since 1983, the area surrounding the subject properties has undergone a major transition in land use and development pattern. Up to the early 1980's much of this area was used for land intensive industrial uses including auto storage and distribution. Prior industrial uses south of the subject site included the Ford Predelivery Service Co.; and a Southern Pacific Industrial Development Company (SPIDCO) auto distribution facility, operated by the Convoy Company. In the mid- 1980's this area began to transition from the land intensive general industrial uses into the current industrial park development pattern. These changes are reflected on Map 2 identified in the red numbered circles as follows: l) In 1985 SPIDCO processed a zone change to I -P, Industrial Park; and 2) In 1886 Ford Motor Land Development Co. processed a zone change to I P, Industrial Park. However, should this application' be successful, one ' of the applicants intends to follow immediately with a development proposal for a brew pub totalling approximately 3,800 square feet on the Smetco Inc. property. Mr. Hartvickson asked about parking facilities for the proposed project. He also expressed concern that, based on his company's observations of traffic flow at the Sequoia Parkway/Bonita Road intersection, a traffic signal may be required or desirable there. I had a second telephone conversation with Dick Bewersdorff on October 31, 1994 to follow up on another point. Both Will and Dick confirmed that a brewpub would be a per- mitted use on the property assuming that a zone change from IL to IP was approved. They also confirmed the following: 1) For the purpose of determining the maximum allowable area of the proposed building, "the entire square footage within the development complex" means the total floor area of any ex- isting buildings on the Smets property plus the floor area of the proposed brewpub building. 2) No variances are allowed for use criteria. 3) A brewery is a permitted use outright in the IP zone (i.e. independent of the 20% rule), but the pub portion of the pro- posed brewpub would be considered as an "eating and drinking establishment" under Section 18.68.030 A. o. of the code. At that time, the zone was, changed °from Washington County M -1 (Industrial) to Tigard M -4 (Industrial Park) Adoption of the Comprehensive Plan and Zoning Map gave these parcels an I -L zoning designation in 1983. The Gevurtz property received Conditional Use and Site Development approval for a furniture in the 1970's (CU 6--75) ,' (CU 14 -78) , (SDR 23 -75) , (SDR 17 -76) , (SDR 41 -78) . The Smets property received a Site Development Review approval (SDR -90 15) ` for a warehouse building . and office. No other land use applications have been filed with the City. Site Information and Proposal Descritation This site contains 5.47 acres. The subject site' is located on the east side of SW Sequoia Parkway, south of SW Bonita Road . and west of Interstate 5. Two separate ownerships comprise the site. Smets Family Trust I is the owner of tax Lots 200,300 and 400, containing 1.68 acres. Burton Gevurtz owns tax lot 100, containing 3.79 acres. The Smets site is developed with a manufacturing, office and warehouse building. These buildings would remain after the Zone Change. The Gevurtz property contains an existing furniture store. The proposal is for an approval of a Zone Change from I -L (Light Industrial) to I -P (Industrial Park). 4 . Fis{encyC_omment s The City of Tigard Engineering Division has reviewed this proposal and has offered the following comments: Confirm that a traffic study may be necessary as part of the Site Development Review application and determination of specific use. Otherwise, there are no objections. The City of Tigard Police Department has reviewed this proposal and has offered the following comments: At this point the only concern is whether there will be an increase to traffic volumes and if so, how do the property owners anticipate relieving the potential hazards of increased . traffic exiting the property onto SW Bonita road from the existing driveway. City of Tigard Building Division, General Telephone and Electric, Portland General Electric, Tualatin Valley Fire and Rescue, have reviewed the application, and have offered no comments or objections. Community Development CONCLU IONS criteria in this case are Comprehensive Plan 1, 5.1.4 ", 7.1.2, 7.6.1, 8.1.1, 8.;1.3 and Code Sections 18.22.040 .(A) , and 18.68 . Section 18.22.040 sets forth the standards and amendments to the Zoning Map as follows: A. The application's relationship to the applicable criteria is reviewed below each policy: Plan Policy 2.1.1 states that the City shall maintain an ongoing citizen involvement program and shall assure that citizens will be provided an opportunity to be involved in all phases of the planning process. This policy is satisfied as the applicant conducted , a neighborhood meeting on December 29, 1994. The East Citizen Involvement Team (CIT) Representative was also notified of this meeting. Notice of Public Hearings have been advertised in a paper of local circulation and notice of a land use action has been posted on the property. Notice of the hearing has been mailed to property owners within 250 feet of the subject site. plan Policy 4.2.1 states that all development within the Tigard Urban Planning area shall comply with applicable Federal, State and Regional water quality standards. This policy is satisfied as the site is already developed. Building and site improvements' were reviewed for compliance with applicable federal, state and regional water quality standards in effect at the time of development. The proposed redesignation would not, by itself, affect compliance with this plan policy. However, the proposed redesignation of the site for Industrial Park use will likely result in building and site modifications. The applicant is proposing to construct a 3,960 square foot building,,for use as a procedures f FINAL ORDER - ON 94 -0012 - SMETS / GEVURTZ Page microbrewery and pub. The applicant s proposal shall require a Site Development Review approval: . Compliance with water quality standards is one of the approval criteria. Therefore, any proposed development shall comply with Federal, State and Pegional water quality standards. Plan Policy 5.1.4 states that the City shall ensure that new commercial and industrial development shall not encroach into residential aroas that have not been designated for commercial uses. This Plan policy is satisfied because the subject property is not located within or adjacent to a designated residential area. Plan Policy 7.1.2 states that as a pre - condition to development that: .) Development eoinoide with the availability of adequate service capacity for public water, 'sewer and ,storm drainage; B) The facilities are capable of serving intervening properties and the proposed development and are designed to City standards; and C) All new development utilities be placed underground. This policy has been satisfied because the subject property is currently served with urban services, water, sanitary and storm sewer. This site is . already developed and is not within the boundaries of the 100 -year floodplain or a designated area of ground instability. Additionally, all service providers have had the opportunity to comment on this application and have offered no comments or objections. The requested amendment will likely result in the construction of a new building. Service providers will have a further opportunity for review as part of the Site Development Review application. Plan Policy 7.6.1 states that the City shall require as a pre- condition to development that: the development be served by a water system having adequate water: pressure for fire protection purposes; shall not educe the water Pressure in the area below a level adequate for fire protection purposes: and the applicable fire district review all applications. The proposed redesignation would not, by itself, affect compliance with this plan policy. The Tualatin Valley Fire District and Tualatin Valley Water District have reviewed this propoeal and have offered no comments or objections. Proposed future construction shall be reviewed by these agencies for compliance with these requirements. Plan Policy 8.1.1 states that the city shall plan for a safe and efficient street and roadway system that meets current needs and anticipated suture growth and FINAL ORDER - ZON 94 -0012 - S!2ETS / GEVURTZ Page 4 t� LIU development. This policy is satisfied because this property fronts SW` Sequoia Parkway, which "'abuts SW Bonita Road, a major collector. Both streets are fully improved. Construction of a new building may require a traffic study to determine potential impacts and mitigation of those impacts . Plan policy 8.1.3 states that as a Precondition of development that,: development abut a publicly- dedicated street; street right of way be dedicated where the street is substandard in width; developer commit to construction of street improvements to City standards to the extent of the development's impacts; perking spaces be set aside and marked for cars operated by disabled Persons. This policy will be satisfied as a condition of approval of any future development or redevelopment on the site. Completion. of any necessary street :improvements along the site's frontages and /or parking lot modifications would be ;required to be installed by the developer at the time of such development or redevelopment. The Engineering Division and affected reviewing agencies will review any future development proposals for the site. • The statewide planning goals adopted under Oregon Revised. Statues Chapter 197, until acknowledgement of the comprehensive plan and ordinances. The City Comprehensive Plan has been acknowledged. 3 ▪ The applicable standards of any provision of this code or other applicable implementing ordinance. Code Section 18.68 (Industrial Park) contains the standards for the Industrial .Park' zone. The subject site meets these requirements in that the minimum lot widths are greater than 50 feet and the existing structures do not exceed 45 feet in height. Additionally, the proposed development will require a site development review and will be reviewed for compliance, with I -P standards. 4. Evidence of change in the neighborhood or community or a mistake or inconsistency in the comprehensive plan or zoning map as it relates to the property which is the subject of the development application. (Ord. 89-06 Ord. 83 -52) The applicant's submittal presents evidence of a change in the neighborhood. This evidence includes the following: past land use decisions which have allowed the rezoning of the majority of the area south of the subject site from I-L to I -P and the change of the character of the uses from land intensive industrial to a mix of office, commercial and industrial uses. Page 5 The area south of SW Bonita Road, east of SW 72nd Avenue, north of SW Upper Boones Ferry Road and west of Interstate 5 has:been in transition since the mid- 1980's In 1983, this area was zoned 1 - L (Light industrial) and Was used for land intensive industrial uses including auto storage and distribution. In 1985, an approval was granted (CPA 11 -85, ZC 7-85) on 38 acres for °a Comprehensive. Plan . Map Amendment from Medium Density Residential to Light Industrial and for a Zone Change from R- 12 (Residential, 12 units per acre) and I -L (Light Industrial) to I -P (Industrial Park). In 19€6, a another Zone. Change was approved (ZC 19 -86) to rezone: approximately 23 acres from I -L (Light Industrial) to I -P (Industrial Park). Approval of this application would provide for uniform I -P zoning along the east side of SW Sequoia Parkway between SW Bonita Road and 3W' Upper Boones Ferry Road. Map 2 of the applicants staternt i t shows the current zoning and the relationship to the subject property. The Comprehensive Plan designation for this entire area is I -L (Light Industrial). Since the 1985 zone changes, Pacific Realty Trust (PacTrust) purchased the property and has redeveloped this area with a mix of office, commercial and industrial, uses. OTHER CONSIDEWTIONS. The Smets property is currently developed with a manufacturing,` office and warehousing building. These uses would continue to be permitted uses in the I -P zone The applicant has discussed the possibility of constructing an approximately 3,900 square foot micro- brewery and pub, in addition to the existing buildings. The processing and distribution of a micro- brewery would be a permitted use under the current I -L zoning. The applicant is interested in also accommodating a portion of the building for a restaurant type use. This portion is classified as eating and . drinking and is not permitted under the current I -L zone. The I-P zone :would allow 20% of the development complex to be used as eating and drinking' and therefore the proposed use would be allowed. A proposed Micro - brewery would be supportive of and in character with the mix of uses which have been developed since the area has been resoned to I-P. The Gevurtz property is developed with a retail furniture store and warehouse. A furniture store is classified as general retail sales, a use that is not permitted in the current I -L zone. The store has been classified as a legal non - conforming use since the building and use was approved and constructed prior to 1983. A zone change to I -P would reduce the nonconformity of this property as the I -l? zone permits 20% of the development complex to be used as creneral retail. Dick Bewersdorff informed the Commissioners that the Plying Commission makes the final decision on this proposal. He said this 5.47 acre site was on the east side of Sequoia Parkway south of Bonita Road adjacent to and west of Interstate 5. Dick Bewersdoriitalked about the properties being zoned Light Industrial and that the proposal would change the properties to Industrial Park and would then be consistent to the zone changes ;made to the south. In conclusion, Mr. Bewersdorff said the applicant was applying for the zone change to possibly construct a micro- brewery and pub to the existing buildings and also, in the future, possibly add a restaurant facility. LLI Dick Bewersdorff said staff recommended approval of the requested zone change. STAFF REPORT Ray Valone, Assistant Planner, informed the Planning Commission that this Proposal was to amend the Comprehensive Plan Map to designate 47.04 acres as medium density residential. He said the four parcels were located near Fern Street south of Scholls Ferry Road. He said Sierra Pacific requested the amendment in light of the recent annexing of the land into the City and Sierra Pacific had applied for and received conditional approval from the Planning Commission for subdivision on parcels A, B and C. Ray Valone continued and said that development couldn't occur until the land was assigned a Comprehensive Plan designation and assignment of the medium density residential designation was required by the Urban Planning Area Agreement with Washington County. Mr. Valone then explained to the Planning Commissioners the Urban Planning Area Agreement. He said R -7 was considered medium density residential in Tigard's Comprehensive Plan and staff finds relevant criteria were met. In conclusion, Ray Valone said it was staffs recommendation that the Planning Commission forward a recommendation to the City Council for approval of CPA 94 -0006 without any condition. He explained that the written staff report did include a condition however staff had since modified the recommendation as a result of tall ng to the City's legal counsel. He said since construction of the road agreement was a condition of the developer, the applicant didn't need to be a part of this action. Adjacent properties to the south are zoned i -P (Industrial Park). SW Bonita Road is classified as a major collector street on , the Comprehensive Plan Transportation map. SW Sequoia Parkway is developed with 'a mix of commercial, industrial and office type uses. 3. Background Information The subject site and the majority of the Cascade Boulevard Area ' was annexed into the City in June 1981. At that• time, the zone was changed from Washington County M -1 (Industrial) to Tigard M -4 (Industrial Park)_ Adoption of the Comprehensive Plan and Zoning Map gave these parcels an I- L zoning designation in 1983.. The Gevurtz property recieved Conditional Use and Site Development approval for a furniture in the 1970's (CU 6 -75), (CU 14-79), (SDR 23-79), (SDR 17 -76) , (SDR 41 -73) . The Smets property recieved a Site Development Review approval (SDR- 90 -15) for a warehouse building and office. No other land use applications have been filed with the City. 4. Site Information and Proposal Degcr' iption This site contains 5.47 acres. The subject site is located on the east side of SW Sequoia Parkway, south of SW Bonita Road and west of Interstate 5. Two seperate ownerships comprise the site. Smets Family Trust I is STAPF REPORT - ZON 94 -0012 - ''mats / Gevurtz PAGE 1 m w the owner of tax Lots 200, 300 and 400, containing 1.68 acres. ` Burton Gevurtz owns tax lot 100, containing 3.79 acres. The Smets 'site is developed with a manufacturing, office and warehouse building. These buildings would remain after the Zone Change. The Gevurtz property contains an existing furniture store. The proposal is for an approval of a Zone Change from 1`L (Light Industrial) to Y -P (Industrial Park). 5 Agency Comments The City of Tigard Engineering Division has reviewed this proposal and has offered the following comments: Confirm that a traffic study may be necessary as part of the Site Development Review : application and determination : of specific use. Otherwise, there are no objections. The City of Tigard Police Department has reviewed this proposal and has offered the following Comments At this point the only concern is whether there will be an increase to traffic volumes and if so, hots do the property owners anticipate relieving the potential hazards of increased traffic exiting the property onto SW Bonita road from the ek.isting driveway. City of Tigard Building Division, General Telephone and Electric, Portland eeneraa. Electric, Tualatin Valley Fire and Rescue, have reviewed the application, and have offered no comments or ob7ections. No other comments have been received. FINDINGS AN CONCLUSIONS The relevant approval criteria in this case are Comprehensive Plan Policies 2.1.1, 4.2.1, 5.1.4, 7.1.2, 7.6.1, 8.1.1, 8.1 3 and Community Development Code Sections 18.22.040 (A), and 18.68. Section 18.22.040 sets forth the standards and procedures for amendments to the Zoning Map as follows: A. A recommendation or a decision to approve, approve with conditions or to deny an application for a quasi - judicial amendment shall be based on all of the following standards: 1. The applicable cemprehensive plan policies and map designation ands the change will not adversely affect the health, safety and' welfare of the community; The following are the applicable Comprehensive Plan Policies related to this request. The application's relationship to the applicable criteria is reviewed below each policy: Plan Policy 2.1.1 states that the City shall maintain an ongoing citizen involvement program and shall assure that citizens, will be, provided an opportunity to be involved in all phases of the planning process. This policy is satisfied as the applicant conducted a neighborhood meeting on December 29, 1994. The East Citizen Involvement Team (CIT) Representative was also notified of this meeting. This policy will be satisfied as a condition of approval of any future development or rede'►elopment on the site. Caampletion of any necessary street improvements along the site's frontages and /or parking lot modifications would be required to be installed by the developer at the time of such development- or redevelopment. The Engineering Division and affected reviewing agencies will review any future development proposals for the site. 2 The statewide planning goals ;-adopted under Oregon Revised Statues Chapter 197, until acknowledgement of the comprehensive plan and ordinances. The City Comprehensive Plan has been acknowledged. 3 , The applicable standards of any prevision of this code or other applicable implementing ordinance. Code Section 18.68 (Industrial Park) contains the standards for the Industrial Park zone. The subject site meets these requirements in that the minimum lot widths are greater than 50 feet and the existing structures do' not exceed 45 feet in height. Additionally, the proposed development will require a site development review and will be reviewed for compliance with I -P standards. Evidence of change in the neighborhood or community or a mistake or inconsistency in the comprehensive plan or zoning map as it relates to the property which is the subject of the development application. (Ord. 89^06; Ord. 83 -52) The applicant °s submittal presents evidence of a change in the neighborhood. This evidence includes the following: past land use decisions which have allowed the rezoning of the majority of the area south of the subject site from,I -L to I -P and the change of the character of the uses from land intensive industrial to a mix of office, commercial and industrial uses. The area south of SW Bonita Road, east of SW 72nd Avenue, north of SW Upper Boones Ferry Road and west of Interstate 5 has been in transition since the mid- 1980's. In 1983, this area was zoned I -L (Light Industrial) and was used for land intensive industrial uses including auto storage and distribution. In 1985, an approval•was granted (CPA 11 -85, ZC 7 -85) on 38 acres for a Comprehensive Plan Map Amendment from Medium Density Residential to Light Industrial and for a Zone Change from R -12 (Residential, 12 units per acre)' and I-L (Light Industrial) to I -P (Industrial Park). In 1986, a another Zone Change was approved (ZC 19 -86) to rezone approximately 23 acres, from I -L (Light Industrial) to I -P (Industrial Park). Approval of this application would provide for a uniform I -P zoning along the east side of SW Sequoia Parkway between SW Bonita Road and SW Upper Boones Ferry Road. Map 2 of the applicants statement shows the current zoning and the relationship to the subject property. The Comprehensive Plan designation for this entire area is I -L' (Light Industrial). Since the 1986 zone changes, Pacific Realty Trust (PacTrust) purchased the property and has redeveloped this area with a mix of office, commercial and industrial uses. OTHER CONSIDERATIONS. The Smets property is currently developed with a manufacturing, office and warehousing building. These uses would continue to be permitted uses in the I -P zone.
