designee for the City of Tigard has APPROVED the above request.
THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN MONTHS OF
THE FINAL DECISION DATE NOTED BELOW.
The findings and concLusions on which the decision was based are
noted below:
A. FINDING OF FACT
1. Site Information and Proposal Description
The site is presently undeveloped. The applicant
proposes to construct a single - family residence which has
access from 11644 SW Tallwood Drive. The applicant has
requested a variance to allow approval to encroach into
the required five foot side yard setback.
2. Other Staff Comments
The Building Department reviewed the proposal and stated
that pursuant to Uniform Building Code requirements that
the eaves shall be located no closer than 30" to the
property line.
The Engineering Department reviewed the proposal and has
offered no comments or objections.
3. Agency Comments
Utility providers will be provided with a copy of this
notice of decision and will be able to request that the
decision be amended or set aside if the requested setback
variance would conflict with the provision of necessary
services or with existing utilities.

C. ANALYSIS AND CONCLUSION
Community Development Code Chapter 18.140.070(C) provides
the following criteria for temporary use approval for a
temporary building:
1. The temporary trailer shall be located within the
boundaries of the parcel of land;
2. The property to be used for a temporary trailer shall
be developed;
3. There exists adequate and safe ingress and egress when
combined with other uses of the property;
4. There exists adequate parking for the customers of the
temporary use;
5. The use will not result in congestion;
6. The use will pose no hazard to pedestrians;
7. The use can be adequately served by sewer or septic
system and water, if applicable;
8. The use will not create adverse off -site impacts
including noise, odors, vibrations, glare, or lights
which will affect adjoining use, in a manner which
other uses allowed outright in the zone, would not
affect adjoining uses.
As indicated on the site plan, the proposed trailer is within the
boundaries of the parcel. The property is currently developed with
office and maintenance buildings. Since the shed shall be located
in the rear of the property there exists adequate and safe access
and egress when combined with the other uses of the property, and
the use will not result in congestion nor will the use pose hazards
to pedestrians. The shed will not generate any demand for parking.
The proposed use will not have a need to be served by sewer and
water. The temporary shed will not create adverse off -site impacts
which will effect the adjoining uses.

The Community Development Code Section 18.134.050 allows the
Director to approve, or approve with conditions, a request for
a variance based on the following findings:
1. The proposed variance will not be materially detrimental
to the purposes of this title, to be in conflict with the
policies of the comprehensive plan, to any other
applicable policies and standards, and to other
properties in the same zoning ditrict or vicinity;
2. There are special circumstances that exist which are
peculiar to the lot size or shape, topography or other
circumstances over which the applicant has no control,
and which are not applicable to other properties in the
same zoning district;
3. The use proposed will be the same as permitted under this
title and City standards will be maintained to the
greatest extent that is reasonably possible while
permitting some economic use of the land;
4. Existing physical and natural systems, such as but not
limited to traffic, drainage, dramatic land forms, or
parks will not be adversely affected any more than would
occur if the development were located as specified in the
title; and
5. The hardship is not self-imposed and the variance
requested is the minimum variance which would alleviate
the hardship.
The applicant has proposed two encroachments into the side yard
setback of three and eight inches. Because the side yard which
would be encroached upon, abuts an open space buffer this intrusion
is not expected to affect future neighboring residences.
The property i8 a five sided parcel with a lot depth of 5/ feet
along the affected side. The home will maintain the required
setbacks from the front, oppoSing side and rear property lines.
The size and configuration of the lot i8 further impacted by' the 25
foot open space buffer between the lot and areas delineated as
wetlands.
The variance will allow the property owner to realize economic use
of the property in a similar manner as other adjoining properties
within this subdivision and the zoning district,
Due to its limited nature of the development standard variance and
the propertied location, the variance will not impact drainage,
utilities, traffic circulation, land forms or park areas,
The hardship is due to the property configuration which is dictated

by the adjoining wetlands area and street improvements. The
variance is the minimum necessary to alleviate the hardship due to
property constraints which impact the site.
Based on the preceeding findings staff finds that the variance
meets the applicable Development Code criteria and therefore
approves the variance.
