The findings and conclusions on which the decision was based are noted below: A. FINDING OF FACT 1. Site Information and Proposal Description The site is developed with a single - family residence which faces and is accessed from SW 90th Avenue. The applicant has requested flexible setback approval to allow construction of a bedroom, and a recreation room to the south side of the single - family residence which would project three feet into the required rear yard setback thereby reducing the rear yard setback to approximately 12 ifeet. The Community Development Code requires a minimum rear yard setback of 15 feet in the R-4.5 zone. ANALYSIS AND CONCLUSION Community " Development Code Section 18 146.050 . (A) allows the NOTICE OF DECISION - VAR 92 -0016 - BAIT ,. The reduction of the setback area established by the applicable zoning district shall be necessary to allow for the enlargement or remodeling of an existing building; 2. The garage setback to the front property line satisfies the requirements of the applicable zoning district; 3. The standkrds of Chapter 18.102, Visual Clearance, shall be satisfied; 4. The resulting lot coverage shall not exceed the maximum lot coverage; 5. The proposed building or addition shall not encroach upon any existing easements; 6. When the proposed building or addition is within the rear yard, the setback adjacent to the rear property line shall be landscaped with sight obscuring plantings in accordance with the standards set forth in Section 18.100.080, Landscaping and Screening; and 7. Setback, buffering and screening requirements that apply when commercial and industrial zones abut a residential zone shall be satisfied. (Ord. 89-06; Ord. 86-08). A reduction from the required rear yard setback of 15 feet is necessary in order to construct an addition to the home to the size desired. The southern corner of the bedroom and recreation room would have a minimum twelve foot setback from the rear lot line. Since this addition is located on the rear of the lot, neither the required 20 foot minimum garage setback or vision clearance requirements for driveways will be affected. The percentage of lot coverage is not a concern for the purpose of this review as there is no maximum lot coverage requirement for the R-4.5 zone. There is no evidence of recorded easements on the rear portion of this property, therefore there is no concern with potentiai encroachment into existing easements. Landscaping or screening is required for this property because the proposed addition within the rear yard setbadk abuts an existing single family residence. NOTICE or DECISION - v 92-0016 BAXTER - WEST ONE MORTGAGE PAGE 2 Additional buffering and screening will not be required since this property does not abut a commercial or industrial zone. No detrimental off -site impacts are anticipated as a result of the requested reduction in the rear yard setback. The applicant's site plan is inaccurately drawn. It shows the addition extending to within nine feet from the rear property line. The setback to the addition will have to be no less than 12 feet. Therefore, staff finds the requested flexible setback variance meets the applicable criteria, will not compromise purposes of applicable Code requirements, and should not have a detrimental effect on the use or enjoyment of the subject parcel or the neighboring parcels. Therefor, the request is approved. C. DECISION Based on the above findings and conclusions, the Planning Director's designee APPROVES Flexible Setback Variance VAR 92- 0016 subject to the following conditions: 1.
