This expansion will project one half foot into the 5 foot side yard setback which is required for detached accessory structures, thereby reducing the actual setback to approximately 4.5 feet. ZONE: R -4.5 (Residential, 4.5 units per acre) LOCATION: 10390 SW Meadow Street (WCTM 1S1 35CC, 2100). DECISION: Notice is hereby given that the Planning Director's designee for the City of Tigard has APPROVED the above request subject to certain conditions. The findings and conclusions on which the decision was based are noted below: A. FINDING OF FACT 1. Site Information and Proposal Description The site is developed with a single - family residence which faces and gains access from SW Meadow Street. A pool house and swimming pool are located on the rear of this fully landscaped lot. The existing pool house is approximately 80 square feet in size and maintains a two foot side and rear yard setback. The applicant has requested flexible setback ap ?roval to allow for an expansion of an existing pool house. The new 180 square foot pool house will be moved away from the side lot line and therefore increase this setback to approximately 4.5 feet. The rear yard will remain the same as currently exists. Therefore, although the side 'ward setback will be increasing its' conformity, this /ariance has been requested for the setback infringement which will occur due to the linear expansion of the pool house. 2. Agency Comments The City of Tigard Building Division and the Engineering Department have reviewed the proposal and have offered no comments or objections. Utility providers will be provided with a copy of this notice of decision and will be able to request that the decision be amended or set aside if the requested flexible setback allowance would conflict with the provision of necessary services or with existing utilities. NOTICE OF DECISION - VAR 92 -0012 - EDWARDS PAGE 1 • B. ANALYSIS AND CONCLUSION Community Development Code Section 18.146.050 (A) allows the Director to approve a flexible setback variance to front, rear, side, and corner side yards of up to 20 percent provided the following standards are satisfied: 1. The reduction of the setback area established by the applicable zoning district shall be necessary to allow for the enlargement or remodeling of an exiting building; 2, The garage setback to the front property line satisfies the requirements of the applicable zoning district; 3. The standards of Chapter 18.102, Visual Clearance, shall be satisfiedr 4. The resulting lot coverage shall not exceed the maximum lot coverage; 5. The proposed building or addition 3110_1 not encroach upon any existing easements; 6. When the proposed building or addition is within the rear yard, the setback adjacent to the rear property line shall be landscaped with sight obscuring plantings in accordance with the standards eat forth in Section 18.100.000, Landscaping and Screening; and 7. Setback, buffering and screening requirements that apply when commercial and industrial zones abut a residential zone shall be satisfied. (Ord. 89 -06; Ord. 86-08). A reduction from the required side and rear yard setbacks of 5 feet is necessary in order to replace the existing pool house structure. Since this addition is located in a back corner of the lot, neither the required 20 foot minimum garage setback or vision clearance requirements for driveways will be affected. The at percentage of lot coverage is not a concern for the purpose of 0 this review because there is no maximum lot coverage specified for properties within the R -4.5 zoning district. There are no easements recorded on this site. 0 Additional buffering and screening will not be required au since this residential property is surrounded by other properties which are also zoned R -4.5.
