' 4 1, CITY OF TIGARD NOTICE OF DECISION VAR 91 -0018 - COUNTRYMAN APPLICATION: A request by Larry Countryman for flexible setback approval to allow an addition to an existing single family residence to project 3 feet into the normally required 15 foot rear yard setback, thereby reducing the actual setback to approximately 12 feet. ZONE: R -3.5 (Residential, 3.5 units /acre). LOCATION: 13360 SW 76th Avenue (WCTM 2S1 1DB, Tax Lot 617). DECISION: Notice is hereby given that the Planning Director's designee for the City of Tigard has APPROVED the above request subject to certain conditions. The findings and conclusions on which the decision was based are roted below: A. FINDING OF FACT 1. Site Information and Proposal Description The site is developed with a single-family residence which faces and is accessed from SW 76th Avenue. The applicant has requested flexible setback approval to allow construction of a workshop and storage area addition to the single - family residence to project into the required rear yard setback, thereby reducing the rear yard setback to approximately 12 feet. The Community Development Code requires a minimum rear yard setback of 15 feet in the R -3.5 zone applied to the property. The addition would be setback approximately 8 feet from the northern or side lot line. A minimum five foot side yard setback is required. 2. Agency and NPO Comments The City of Tigard Building Division and the Engineering Department have reviewed the proposal and have offered no comments or objections. A building permit has already been applied for. B. ANALYSIS AND CbNCLUSION Community Development Code Section 18.1.46.050 (A) allows the Director to approve a flexible setback variance to front, rear, side, and corner side yards of up to 20 percent provided the following standards are satisfied: 1. The reduction of the setback area established by the applicable zoning district shall be necessary to allow NOTICE OF DECISION - VAR 91 -00 ** - ** PAGE 1 for the enlargement or remodeling of an existing building; 2. The garage setback to the front property line satisfies the requirements of the applicable zoning district; 3. The standards of Chapter 18.102, Visual Clearance, shall be satisfied; 4. The resulting lot coverage shall not exceed the maximum lot coverage; 5. The proposed building or addition shall not encroach upon any existing easements; 6. When the proposed building or addition is within the rear yard, the setback adjacent to the rear property line shall be landscaped with sight obscuring plantings in accordance with the standards set forth in Section 18.100.080, Landscaping and Screening; and 7. Setback, buffering and screening requirements that apply when commercial and industrial zones abut a residential zone shall be satisfied. (Ord. 89-06; Ord. 86 -08). A reduction from the required rear yard setback of 15 feet is necessary in order to construct the desired addition to this home. The proposed location of the addition would have less of an impact on the existing residence's private outdoor spaces (patio and gardens) than a wider, less deep addition. Also, the proposed addition's location would not result in a reduction in light to existing windows in the residence as a similar sized addition without the benefit of a flexible setback allowance might have. Since this addition is located on the rear of the lot, neither the required 20 foot minimum garage setback or vision clearance requirements will be affected. The percentage of lot coverage is not a concern for the purpose of this review as there is no maximum lot coverage percentage for the R -3.5 zone applied to this parcel. There are no recorded easements on the rear portion of this property and therefore there is no concern with potential encroachment into existing easements. Additional buffering and screening will not be required since this property does not abut a commercial or industrial zone. Since the rear property line of this site abuts a well landscaped multi- family residential development with living units located a substantial distance from the proposed addition, no detrimental off -site impacts are anticipated as a result of the requested reduction in the rear yard setback. NOTICE OF DECISION - VAR 91 -00 ** - ** PAGE 2 • Therefore, staff finds that the requested flexible setback variance meets the applicable criteria will not compromise purposes of the applicable Code requirements, and should not have a detrimental effect on the use or enjoyment of the subject parcel or it neighboring parcels.
