In addition to the three freestanding signs, each driveway has a directional sign. Directional signs may be up to four square feet in area. These directional signs appear to be about half the allowable size in area. • They are placed high on light poles located at both driveway entrances. In addition to the existing freestanding signs, there are wall signs on the east side of the building intended to provide identification to customers looking for the parts and service departments and body shop. Another 91 square foot wall sign located on the north facing wall identifies the auto dealership to off-site traffic on Pacific Highway and Hall Boulevard. The applicant proposes to 1) increase the height of the sign located on pacific Highway to 25 feet, 2) move the "GEO° sign south along Hall Boulevard to the present location of the Russ Chevrolet Service sign with orientation to with orientation to Hall Blvd., and 3) remove the Russ Chevrolet Service sign on Hall Blvd.. This ameAded application does not require a variance approval. The applicant has submitted a revised narrative discussing what is intended and several photographs to illustrate the need for increased sign height for the sign on pacific Highway. 5. agginALS1.4 NPO Comments The State Highway Division has reviewed the proposal and has no objections to it. The Division notes, however, that future improvements, to Pacific Highway between Pfaf fie Street and Commercial Street will impact the Russ Chevrolet site because up to an additional 30 feet of right-of-way on the south side of Pacific Highway may be required to Complete these improvements. The Engineering Department and Building Division have reViewed the proposal and have no objections to it. No other comments have been receiVed. B. On November 11, 1989 a Sign Permit (SP 89-153) was issued allowing replacement of the Hall Boulevard earvice sign with the "GEO" sign. Instead of replacing the existing sign as agreed, the sign was installed approximately 100 feet north of the existing sign with an orientation to Pacific Highway and the existing sign was not removed. On May 23, 1990 the applicant was sent a notice that the third freestanding sign was in violation of the Community Development Code. The applicant was advised that the sign would have to be removed or he would have to apply for • Sign Code Exception and Variance. Properties to the west are zoned and developed as CBD (Central Business District). 4. site Information and erogaffilLamerietlen There are currently three freestanding signs on the site, two on Hall Boulevard and one on Pacific Highway. The Pacific Highway frontage sign is 20 feet high and 81 square feet in area. The RUss.Chevrolet Service sign located at the present Hall Boulevard entrance is 14 feet high and 24 square feet in area The recently erected "GEO" sign is 20 feat high and 36 square feet in area In addition to the three freestanding signs; each driveway has a directional sign. Directional signs may be up to four square feet in area. These directional signs appear to be about half the allowable size in area They are placed high on light poles located at both driveway entrances. In addition to the existing freestanding signs, there are wall signs on the east side of the building intended to provide identification to customers looking for the parts and service departmento and body shop. Another 91 square foot wall sign located on the north facing wall identifies the auto dealership to off-site traffic on Pacific Highway and Hall Boulevard. The applidant proposes to 1) increase the height Of the Bien located on Pacific Highway to 30 feet, 2) move the Rube Chevrolet service Olen on Hall Boulevard to a point about 105 feet south of its present location where a new driveway has recently been constructed, and 3) leave the "GEO" sign in its present location on Hall BouleVard with orientation to Pacific Highway. The applicant has submitted a diagram (Exhibit A) showing what is intended; a narrative (Exhibit B), and three photographs (Exhibits Co Do and E). Criterion (1) may be coneidered satisfied becausse an existing State Highway sign limits the view to eastbound traffic of the main product sign located on the Pacific Highway frontage. However, the dealership .sign was erected after the State Highway sign was in place. Criteria (2) and (5) do not apply because the applicant seeks a third freestanding sign. The previously approved Sign Code Exception (SCE 87- 01) allowed the installation of a second freestanding sign on the site's Hall Boulevard frontage. The request for a third freestanding sign must satisfy the variance criteria below. Criterion (3) does not apply because the applicant requests a AlLmositt increase in the sign height for the main product ,sign located on Pacific Highway; this request must also satisfy the Variance criteria. According to subsection (4) the proposal Must be consistent with the criteria set forth in Subsection 18.114:130(G). This Code section allows an additional 50% sign area (excluding lettering, logos, etc.) and a 25% height increase when "...the sign's visual appeal and overall design quality would b;, served while maintaining the intent and purpose of this chapter...". No evidence has been submitted to illustrate how this proposal is consistent with this standard. Variance Reemet An application for a Variance must satisfy the criteria of Section 18.134.050 listed below: The proposed Variance Will not be Materially detrimental to the purposes of thia title, be in conflict with the policies of the Comprehensive Plan, to any other applicable policies and standards, and to other properties in the same zoning district or vicinity, 2. There are special circumstanced that exist which are peculiar to the lot gaze or shape, topography or other circumstances over Which the applicant has no control, and which are not applicable to other properties in the same zoning diettict; 3. The hardship is not self-imposed and the variance requested is the minimum variance which would alleviate the hardship. The proposal does not satisfy criterion (1) because the request for a third freestanding sign and a 50 perc.nt increase in sign height is detrimental to the purpose of Title 18 and to other property owners in the vicinity. If approved, the request would set a precedent in conflict with the purpose of the Sign Code and the City's sign amortization program. Briefly, this program represents a decade long effort to bring nonconforming signs, particularly along Pacific Highway, into compliance with the Code after March 20, 1988. As a result of the sign amortization effort, only a few signs remain which are not in conformity with the Code, and these are in the process of being resolved. Special circumstances may exist‘ with respect to the visibility of the main product sign on Pacific Highway. A State Highway Division sign located on the southeast corner of the Pacific Highway - Hall Boulevard interfereo wit ii the view of the sign to eastbound traffic. However, there appear to be other locations on the Pacific Highway frontage that would provide suitable visibility of the freestanding sign from both directions. Criterion (3) is satisfied because the use of the site will, remain the same and (4) id not satisf ied because the addition of a third freestanding sign would ,increase sign clutter along Pacific Highway. The limited visibility of the Pacific Highway sign is in part due to the location bf the previously MentiOned State Highway Division sign but it is a self-imposed hardship because the Pacific Highway. (main product) sign Could be lOcated to allow for better visibility. The hardship is also Self-imposed because the applicant pUrpOsefUlly installed an the "GB04 sign in conflict with a specified condition of the sign permit issued, to allow replacement of an existing Sign iodated on Hall boulevArds Furthermore, the Variance requested is not the minimum Variance whidh would alleviate the hardship. The applicant has demonstrated that by raising the existing sign by five feet, visibility of the sign will improve. Because of the minimal increase in height, the staff finds the proposal to be consistent with the sign code exception criteria and the intent of the sign code. As noted above by the State Highway Division, it is likely that a certain amount of the property frontage will be acquired by the State for street improvements. This action will probably require the Pacific Highway sign to be moved. Because the visibility along Pacific Highway shall be modified as a result of this work, the sign code exception approval for the additional five feet of height should oylly be valid as long as this sign remains in its current location. The previously approved Sign Code Exception (SCE 87-01) allowed the installation of a second freestanding sign on the site's Hall Boulevard frontage. The staff finds that Criteria (2) above remains as a valid justification for the second sign on Hall Blvd.. The relocation of the Hall Boulevard service sign does not require sign code exception approval. It does, however, require approval of a sign permit by the Planning Division. C. RECOMMENDATION Staff recommends approval of Sign Code Exception SCE 90- 0004 subject to the following conditions: 1. There was discussion regarding this private driveway. Mrs. Adamski also asked about access to Summerfield, which would be blocked by option 1. There was further discussion about difficulty enforcing the EMERGENCY VEHICLES ONLY aspect. The previously approved Sign Code Exception (SCE 87- 01) allowed the installation of a second freestanding sign on the site's Hall Boulevard frontage. The request for a third freestanding sign must satisfy the variance criteria below. Criterion (3) does not apply because the applicant requests a Ad.percent increase in the sign height for the main product sign located on Pacific Highway; this request must also satisfy the Variance criteria. According to subsection (4) the proposal must be consistent with the criteria set forth in Subsection 18.114.130(G). This Code section allows an additional 50% sign area (excluding lettering, logos, etc.) and a 25% height increase when "...the sign's visual appeal and overall design quality would be served while maintaining the intent and purpose of this chapter...h. The hardship is not self - imposed and the variance requested is the minimum variance which would alleviate the hardship. The propooal does not satisfy criterion (1) becauao the request for a third fr= estanding sign and a 50 percent increase in sign height is detrimental to the purpose of Title 18 and to other property owner in the vicinity. If approved, the request would set a precedent in conflict with the purpose of the Sign Code and the City's sign amortization program. Briefly, this program repreeente a decade long effort to bring nonconforming signs, particularly along Pacific Highway, into compliance with the Code after March 20, 1988. As a result of the sign amortization effort, only a few signs remain which are not in conformity with the Cod:, and these are in the process of being resolved. Special circumstances may exist with respect to the visibility of the main product Sign on Pacific Highway. A State Highway Division sign .located on the southeast corner of the Pacific Highway - Hall Boulevard interferes with the view. of the sign to eastbound traffic. However, there appear to be other locations on the Pacific Highway frontage that would provide suitable visibility of the freestanding sign from both directions. Criterion (3) is satisfied because the uoe of the site will remain the same and (4) is not satisfied because the addition of a third freestanding deign would increase sign clutter along Pacific Highway. The limited visibility of the Pacific Highway sign is in part due to the location of the previously mentioned State Highway Division sign but it 3.s a Self- imposed hardship because the Pacific Highway (main product) sign could be located to allow for better visibility. The hardship is also self- imposed because the applicant purposefully installed an the "GEO" sign in conflict with a specified condition of the sign permit issued to allow replacement of an existing sign located on Hall Boulevard. We at Russ Chevrolet have been given the opportunity to sell and service this new line of small cars. One of the requirements of the GEO franchise is that a Dealer must maintain proper product ident- ification. Therefore it is necessary to install another sign to identify this new product properly. Also our main product 'sign on Pacific Highway was restricted to a height that is just perfectly blocked out by a building to the east and by a direction sign (Metzger-Durham) to the west.
