Existing uses and structures The area on both sides of the existing bridge is used for parks and a greenway. The land to the west of the creek south of the bridge is in the City of Tigard's Englewood. Park. Tax lot 3601 on the north side of the creek is sub - leased by the City of Tigard for park use. The area on the north side of the road is the City of Beaverton's Greenway Park. Except for the existing bridge and highway, there are no structures located within the area. D. Proposed uses and structures : 1. The applicant proposes to widen Scholls Ferry Road between Murray Boulevard and the Fanno Creek bridge, including the widening of the highway to four travel lanes and a 14 -foot median, the addition of three traffic signals, and the construction of a 6- foot sidewalk and bicycle path. The total length of the project is about 1.84 miles. 2. The applicant proposes to reconstruct the Fanno Creek Bridge to provide a structure for the widening of the proposes and to afford adequate clearance beneath the structure for a bicycle path connecting existing bicycle paths in the Tigard and Beaverton greenways. To provide support for the structure, the applicant will add fill north and south of the bridge, thereby extending the toe of the slope of the highway embankment plain creek. Chapter 18.84 contains the regulations for land subject to sensitive lands review. Sensitive lands review is intended to implement flood plain protection measures and to protect rivers, streams, and creeks by minimizing erosion, promoting bank stability, .. wildlife habitat, and preserving maintaining and enhancing water quality and fish and wil q ty potential. Section 18.84.015(A) allows public uses such as roads in areas s recreational subject to sensitive lands review. Section 18.84.015(C) requires Hearings Officer approval of landforen alterations in the 100 -year flood plain. 2. Section 18.84.026 requires use of designs, materials, and practices that minimize flood damage and the potential for damage, 3, Section 18.84•,040 provides landfonm alterations subject to sensitive lands review must comply with the following criteria: a. Land form alterations shall eserve or enhance the flood plain storage function and maintenance of the zero -foot rise floodway shall not result in any narrowing of the floodway boundary; b. Land form alterations or developments within the 100 -year flood plain shall be allowed only . in areas designated as commercial or industrial on the comprehensive plan land use map, except that alterations or developments associated with public support facilities as defined in Chapter 18.42 of the Community Development Code are allowed in residential and industrial areas subject to applicable zoning standards; c. Applicable comprehensive Plan Policies. .-44,000 1. Policy 2.1.1 provides the City will assure citizens will be provided an opportunity to be involved in all phases of the planning process. 2. Policy 3.2.1 provides that the City will prohibit any development within the 100- year flood plain that would result in any rise in elevation of the 100-year flood plain. 3. Policy 3.2.2 provides that the City prohibit development in the floodway but may allow development in the floodway if the alteration preserves or enhances the function and maintenance of the zero-foot rise floodway; Policy 3.2.1 also provides that the City may allow limited specified development in the flood plain outside the zero-foot rise floodway. 4. Policy 3.2.3 provides that development is within the 100-year flood plain outside the zero-foot rise floodway is conditioned upon specified requirements. 5. Policy 3.5.3 provides that the City has designated the 100-year flood plain of the Tualatin River as greenway and that development within the 100-year flood plain shall be conditioned upon the dedication of sufficient open land area for greenway within the flood plain. 6. Policy 4.2.1 provides that all development within the Tigard Urban Planning Area shall comply with applicable federal, state and regional water quality standards. IV, HEARING, TESTIMONY, AND NPO & AGENCY COMMENTS A. Hearing. The examiner received testimony at the public hearing about this application on August 28, 1990. A record of that tosthriony is included herein as Exhibit A (Parties of Record), Exhibit B (Taped Proceedings), and Exhibit C (Written Testimony). These exhibits are filed at the Tigard City Hall. B. Summary of Testimony. 1. Jerry Offer testified on behalf of the City of Tigard Planning Department and summarized the staff report and recommendation. 2, Kirk Ha.mpson appeared on behalf of the Oregon State Highway Division and accepted the proposed conditions of approval, C. NPO & Agency Comments 1. The Engineering Department recomiriends approval of the sensitive land review, because the proposed fill is entirely outside the zero foot rise floodway and will not increase the 100-year flood elevation , 2, The Building Inspection Division indicated that an erosion control plan should be included as part of the project. The City of Tigard Park Board commented that the bike path should be well designed so as to be safe and present no obstacles to use by pedestrians or bicyclists. The Park Board also noted that it was pleased with the connection of the City cif Tigard and City of Beaverton bike paths and greenways. 4. The Tigard Water District and the Tualatin Valley Fire and Rescue District reviewed the request and made no objections or comments. V. EVALUATION OF REQUEST B. Compliance with Chapter 18.84 (Sensitive Lands Review). The proposed use complies with Chapter 18.84, because: a. Roadway development is a permitted use in areas subject to sensitive lands review. b. A landform alteration in the 100-year flood plain is permitted in both residential and industrial zones if the modification is related to and necessary for public support facilities such as public roadways. c. The proposed bridge and road improvements are designed to be cvnstructed with material's and construction techniques intended to be resistant to flood damage. Other Community Development Code requirements relative to floodproof construction are not applicable to the type of development proposed. d, The proposed development is outside the zero-foot rise floodway and therefore will not result in any increase in the water surface elevation of a 100-year flood. In addition, the proposed alteration is small relative to the size of the flood plain, and will not jisplace a significant amount of water. e. Currently pedestrians and bicyclists must cross Scholls Ferry Road, a busy arterial, to move from the Beaverton to the Tigard portions of the bicycle path. The proposal would place a bikeway underneath the proposed reconstructed bridge eliminating the need fair highway crossings. E Approval of the US Corps of Engineers and Oregon Division of State Lands is not required, because the proposed work is not within a wetland or river channel. g. Dedication of open space is not necessary because Englewood Park is already owned by the City of Tigard, except for the portion within tax lot 3601 which the city controls through a longterm lease. In order to comply with Policy 4.2.1, a condition is warranted to require the applicant to submit an erosion control plan ensuring compliance with interim erosion control measures for the Tualatin River Basin as part of the grading permit application. VI. SI'T 'E VISIT BY HEARINGS OFFICER The Hearings Officer visited the site without the company of others. VII. CONCLt SION . AND DECISION The examiner concludes that the proposed use and associated Iandfarm alterations comply with the applicable approval criteria for a sensitive lands review permit. FINDINGS ABOUT SITE AND SURROUNDINGS A. Site locations The area of proposed work is approximately 700 feet southwest of the intersection of SW Scholls Ferry Road and SW Nimbus Drive. The proposed work is on the south side of SW Scholia Ferry Road within the Scholia Ferry Road right -of -way and Englewood Park, adjacent to Fanno Creek. B. Existing uses and structures: The area on either side of the existing bridge over Scholia Ferry Road is used for parks and greenway uses. The lands to the east are within the City of Tigard's Englewood Park. Tax lot 3601 on the north side of the creek is sub - leased by theity of Tigard for park use through an agreement with the %toll Company and the property's owner, Mr. Robinson. The area on the north side of the road is the City of Beaverton's Greenway Park,( The area to be affected by the proposed highway widening and bridge replacement is mostly grass covered and contains one deciduous tree on the south side of the creek. No structures are located in the area with the exception of the existing bridge and highway. The project involves the widening of the present highway to include four travel lanes and a 14 -foot wide median, the addition of three traffic signals and the construction of a 6-foot sidewalk among other improvements. The total length of the project is approximately 1.4 miles. In order to construct the proposed highway improvements, the Highway Division is proposing to reconstruct the Fanno Creek Bridge in order to provide for the widening of the highway and to afford adequate clearance underneath the structure for a bicycle path connecting the two cities' greenways, it will be necessary to both widen and raise the bridge. In order to accommodate this, it will be necessary to extend the toe of the slope of the highway embankment into the Fanno Creek floodplain on both sides of the creek, as well as on both sides of Scholls Ferry Road. Any fill approvals necessary on the north side of the highway are the responsibility of the City of Beaverton. The applicants request Sensitive Lands Review approval for the he filling to occur on the South side of the highway within the City of Tigard. D. Plan Designation and Zoning: The Comprehensive Plan and toiling designations for this area are divided along Fanno Creek. Properties on the north aid=s of Fenno Creek carry a Plan designation of Light Industrial and are zoned I -P (Industrial Park). Properties on the south side of Fenno Creek near the bridge carry a Plan designation of Medium Density Residential, and are Zoned R .42 (Residential, 12 units /acre). III. APPLICABLE APPROVAL CRITERIA AND DEVELOPMENT STANDARDS A. Cha ter 18.84 Sensitive Lands Review: 1. Chapter 18.84 contains regulations for lands within 100 year floodplains that are subject to Sensitive Lands Review. Sensitive Lands Review of proposed developments in these areas is intended to implement floodplain protection measures and to protect rivers, streams, and creeks by minimizing erosion, promoting bank stability, maintaining and enhancing water quality and fish and wildlife habit t, and preserving scenic quality and recreational potential. Section 18.84.015(A) allows community recreation uses such as bicycle and pedestrian pathways and parks in areas subject to Sensitive Lands Review. Section 18.84.015(B) allows roadway improvements and utilit installation in sensitive land areas. This information was then combined with the Stage vs Outflow relationship provided by ODOT to produce the Storage volume vs. Outflow relationship requl&'ed by HEC -1. This same method was used for both the Nexistin' and "proposed" bridge configurations. This is considered a refinement, because the complex terrain cannot be accurately represented by cross- sections as done previously. The result of this refinement is that at the 100 -year discharge, the newly determined volume is 27% lower than that used in the Tigard Drainage Master Plan. This may partly explain the minimal impact of the proposed bridge. Model Calibration After producing the basic model with input data matching that of the earlier HMO model, it was necessary to calibrate it to produce discharges as close as possible to those of the published Flood Insurance Study (FIS). The new HIEC -1 model was calibrated to the FIS values rather than the HYMO values, because the FIS contains the official published discharges. Adverse impacts to these wetlands will be minimized by keeping the project on the existing highway alignment. This area in the fork between Scholls and Old Scholls appears to be declining as a wetland because of changes in drainage and ditching associated with nearby development. The highway widening will fill the north edge of this area. At the Summer Creek crossing, the highway widening Will remove the vegetation and fill approximately 4000 square feet of Wooded wetland habitat along the south side of Old Scholis Highway between the Davies and Murray intersections. Relatively undisturbed for several years, this area has developed an oVerstory of Oregon white ash, a rnidstory of river dogWood, and a heavily shaded groundcover with of sWordfern, eqUisetUrn and spaghnum moss. The presence of impermeable subsoils and a , constant supply of water from seepage maintains saturated surface soils year-aroUnd. The following table summarizes the wetland Impacts of the project. They also support Wildlife habitat and fisheries and provide a scenic and educational backdrop to soften the urban environment. Existing wetlands should be preserved whenever possible. When filling cannot be avoided, it is important to replace wetlands so these important values are not permanently lost. 4.2.2 Existing Conditions at Mitigation Site Part of an existing 4.5 -acre Wetland along Hiteon Creek (Figure 6) will be enlarged and enhanced as mitigation for the unavoidable Wetland impactsof this project The area has the water supply, soil types, Vegetation, and slope aspects Which with proper restoration and protection can support a high - quality Wetland habitat. Over the past decade, this Wetland has been declining as a result of surrounding urban development: a underground sanitary sewer has been installed down the middle of the wetland; the creek has been channelized and deepened' tillage has gradually shifted upland soils onto the northerly wetland margins; the fill for a major apartment development has encroached on the south side: two new sewer connections from the apartments again recently disrupted parts of the Wetland, Hiteon Creek is noW a straight, steep- sided ditch which tends to drain rather than feed Much of the Wetland, Nevertheless it persists, attesting to the basic conditions which created it The existing wetland is now bounded on the south by the toe of the fill created during the construction of Scholls Terrace Apartments, The West boundary is 125th Avenue, and the east boundary is Booties Bend Drive (121st Avenue), The existing northerly boundary has been determined, as shown in Figure ei using hydrology, vegetation and soil characteristics as Indicators. This is a PalUstrii a Persistent Emergent wetland containing areas of standing water and saturated soil which support wetland vegetation including rushes, cattails, sedges, skunk cabbage, willow and ash trees, horsetail, scouring rush and marsh grasses (meadow foxtail and tall fescue). 4.2.3 Description of Mitigation A two -acre permanent wetland easement will be acquired for the proposed mitigation (Figure 7). Approximately 1.4 acres of this will be existing wetland in which the wetland habitat will be restored and enhanced. The remaining 0,6 acre is currently non - wetland which will be excavated and graded to enlarge the wetland area and improve its boundary conditions. The total mitigation area must be larger than the amounts of wetland directly impacted by the project: Construction on the highway and the wetland mitigation site will cause temporary reductions in total wetland area Time will be required to fully establish the new Wetland. The wetland improvement will also replace some of the water quality functions affected by the project This is particularly important in the Tualatin River Basin, where development Is water quality - limited. The excavations, low earthfill dikes and wiers will be constructed to create ponds and raise the local Water table. In the existing wetland areas to be regraded, the topsoils will be removed, stored, and protected for later redistribution in the mitigation area once the new grades are established. Filling, materials storage or disposal, equipment storage, washing, or operationai use of any kind Will be specifically prohibited by the contract. Contractors will be required to provide a separate performance bond to ensure compliance with these provisions, o Shrubs and trees, such as Pacific willow, will be planted at the toe of fills bordering the wetland basins to reestablish existing structural diversity as rapidly as possible. o Accessible boundaries of the Wetland will be planted with trees and shrubs which discourage intrusion. 4.2.5 Monitoring and Coordination The final design and construction stages of the wetland mitigation will be monitored by the ODOT Regional Environmentalist and reviewed by the Oregon Fish and Wildlife Department before approval, During construction, the Construction Project Manager will notify the Regional Environmentalist at the beginnings and at the completions of major project activities at wetland sites.
