SUMMARY OF THE REQUEST The applicant requests approval of a Sensitive Lands Review to improve an existing public park and boat ramp along the Tualatin River within Cook Park The work will occur within the 100-year flood plain of the Tualatin River and will involve landform alterations including new paved roadway access, additional parking, grading of about 3500 cubic yards of earth, about 600 feet of new asphalt trail along the river, riverbank stabilization and erosion control measures, and handicapped access to the riverbank. The site is partially within the zero foot use floodway. City staff recommended conditional approval of the request. The applicant accepted all conditions of approval. Site size and shape The site is a irregularly shaped area as much as 1200400t long and 250-foot deep on the north bank of the Tualatin River and includes about 4 acres. 13. C. Existing uses and structures 1. The site is currently used as public access to the Tualatin River, A boat ramp and dock already exists. The river access drive ends in the vicinity of the boat ramp, but has been extended as a dirt path beyond and along the road, evidencing greater demand for improved facilities. Access to the area beyond the boat ramp is unimproved. The boat dock is located about 180 feet east of the boat ramp. Other than these boating facilities, the majority of the site is unimproved. See demolition/salvage plan. 2. The northeast portion of the park contains the playground and picnic area. The western portion of the park contains two soccer fields and two baseball fields. An access road from SW 92nd Avenue and parking facilities wind through the center and east portions of the park. About 14.5 acres of the park, along the Tualatin River and in the southwest corner of the ark, are undeveloped red and remain in their natural heavily wooded state. Proposed uses and structures The applicant proposes to maky e several improvements to the area. These include the following (see staking and layout plan and irgation system plan): 1. The existing roadway would be extended about 250 lineal feet to the east, and new automobile and boat trailer parking would be provided along it. 2. The existing dock would be relocated about 180 feet west to the vicinity of the existing boat ramp. 3. A concrete slab fishing plaza would be built on the riverbank about 220 feet east of the relocated dock. Trail improvements would be constructed linking the fishing plaza with parking area 4. Riv erbank stabilization and erosion control which would include placement of about 3,100 square feet of structural fin material along the river's edge. 5. Construction of a concrete block screen to provide an enclosure for portable restrooms. 6 Grading of abut 3,500 cubic yards of earth to develop a picnic area adjacent to the river. No fill would be added. 7. Landscaping; turf seeding, and irrigation improvements. 8, About 600 feet of new asphalt trail along the Tualatin Rive'. 9. Hiandcapped access to the Tualatin River, L. The applicant proposes to remove several trees within the development site which have been damaged by uncontrolled use The applicant also proposes to plant several hundred native trees and shrubs (see landscape plan). The applicant also poses substantial plantings of wetland plants within low lying areas and along the tnver's edge. The applicant further proposes to plant about an acre of lawn noreast of the boat ramp to provide a usable picnic area. F Topography and drainage : The site slopes generally to the Tualatin River. The elevation at water's edge is about 101 feet above mean sea level (msl) at the site's highest point, the elevation is about 115 feet msl. All of the site is within the 100 floodplain and a portion is within the zero -foot rise floodway, although the exact location of the zero -rise floodway is not located with certainty. G. Plan designation and zoning The site is designated Low Density Residential and is zoned R -4.5 (Residential). H. Public services and utilities : The site can be served by public sanitary sewer and water and by power and communication utilities, Utility changes axe not proposed as part of the project. I. Streets and access 1. The site in Cook Park which is served by S.W. 92nd Avenue. A paved roadway leads to the site and terminates in the vicinity of the boat ramp The applicant proposes to extend this paved access road and to provide a paved turnaround at its terminus. See staking/layout plan. 2. S. w. 92nd Avenue is a minor collector street on the City's Transportation Plan Map. It extends from Durham Road to the entrance of Cook Park, although south of Kneeland Estates and Tigard High School, it serves largely as a dedicated park road. The street has a 24 -foot wide pavement within a 50 -foot right of wa.. with streetlights but not curbs, sidewalks or storm drains, right g J. Chapter 18.84 (Sensitive Lands Review). 1 Chapter 18.84 contains the regulations for land subject to sensitive lands review. Sensitive lands review is intended to implement flood plain protection measures and to protect rivers, streams, and creeks by minimizing erosion, promoting bank stability, maintaining and enhancing water quality and fish and wildlife habitat, and preserving scenic quality and recreational potential. Section 18.84.0150) allows community recreation uses such as parks in areas subject to sensitive lands review. Section 18.84.015() requires Hearings Officer approval of landform alterations or development in the 100 -year floodplain. 2. Section 18:84.026 requires use of designs, materials, and practices that minimize flood damage and the potential for damage. 3. Section 18.84.040 provides landfonn alterations subject to sensitive lands review must comply with the following criteria: a. Applicable Comprehensive Plan Policies. 1. Policy 2.1.1 provides the City will assure citizens will be provided an opportunity to be involved in all phases of the planning process. 2. Policy 3.2.1 provides that the City will prohibit any development within the 100- year flood plain that would result in any rise in elevation of the 100-year floodplain. 3. Policy 3.2.2 provides that the City prohibit development in the floodway but may allow development in the floodway if the alteration preserves or enhances the function and maintenance of th e zero-foot rise floodway; Policy 3.2.1 also provides that the City may allow limited specified development in the floodplain outside the zero-foot rise floodway. 4. Policy 3.2.3 provides that development is within the 1(X)-year floodplain outside the zero-foot rise floodway is conditioned upon specified requirements. 5. Policy 3.5.3 provides that the City has designated 100-year flood plain of the Tualatin River as greenway and that development within the 100-year floodplain shall be conditioned upon the dedication of sufficient open land area for greenway within the floodplain. 6. Policy 4.2.1 provides that all development within the Tigard Urban Planning Area shall comply with applicable federal, state and regional water quality standards. IV. HEARING, TESTIMONY, AND NPO & AGENCY COMMENTS A. Hearing. The examiner received testimony at the public hearing about this application on August 28, 1990. A record of that testimony is included herein as Exhibit A (Parties of Record), Exhibit B (Taped Proceedings), and Exhibit C (Written Testimony). These exhibits are filed at the Tigard City Hall. B. Summary of Testimony. Ron Bunch summarized the staff report and recommendation. He discussed the Fire p o the a recommendation of the De artment t increase e radius o the turn-around t the end of the proposed drive, and agreed on the part of the City to comply. No other testimony was offered. C. NPO, City Department & Agency Comments 1. NPO 6 submitted comments enthusiastically supporting the proposal. 2. The Tigard Parks Board stated that the project IS part of the Tigard Five Year Parks Irnpmmnent Levy and approvals need to be received as soon as possible. 3, The Tigard Water District reviewed the proposal and has no objection 4, The Tigard Valley Fire and Rescue and Beaverton Fir' State that 'Tor rescue and emergency medical response, please provide outside turning radii of not less than 45 feet." The Tigard Building Department reviewed the proposal and submitted no comments. 6. A Section 404 permit to allow construction activity to occur within a designated waterway has been submitted to the Oregon Division of State Lands. No response has been received. V. EVALUATION OF REQUEST A. Compliance with Chapter 18.50 (R -4.5 zone). The proposed use complies with Chapter 18.54, because it is listed as a permitted conditional use in the R-4.5 zone, and because it complies with the requirements of the zone concerning setback, parking and landscaping. Since this is a minor modification of an existing conditional use, pursuant to Section 18.130.060, a Conditional Use application is not required and the proposed minor modification can be approved by the Planning Director. B. Compliance with Chapter 18.84 (Sensitive Lards Review). The proposed use complies with Chapter 18.84, because: a, The use is listed as a permitted use in areas subject to sensitive lands review. b A landform alteration in the 100 -year flood plain is permitted in a residential zone for a community recreation use. c. No adverse comments were received. 2 The proposal complies with Policies 3.2.1, 3.2.2, and 3.2.3, because the proposed landform modification will not result in an increase in the base flood level and will enhance the function and maintenance of the zero -foot rise ffloodway by providing riverbank stabilization and erosion control. 3. The proposal complies with Polk) 3.5.3, because the City owns Cook Park. 4. In order to comply with Policy 42.1, a condition is warranted to require the applicant to submit an erosion control plan ensuring compliance with interim erosion control measures for the Tualatin River Basin as part of the grading permit application. The grading and erosion control plan submitted with the application complies or substantially complies with those requirements. Final plan approval can be required before development is permitted. Topography and drain ge: The site slopes generally to the Tualatin River. The elevation at water's edge is approximately 101 feet and 115 feet at the project's highest point. All of the site is within the 100 year floodplain and a portion is within the floodway. G. Plan Designation and zoning: The site is Plan designated Low Density Residenti 1 and is zon.d R-4.5 (Residential, 4,5 units/acre). H. Public services and utilities: Changes to any utilities are not a part of this project. It is possible to serve the site with sewer, water and power. However, theet, services are not necessary. I. Streets and Access The site is within Cook Park which is served by S.W. 92nd Avenue. A paved roadway leads to th site and terminates in the general vicinity of the boat ramp. An unimproved, dirt lane leads from the road to the remainder of the development site and dead ends. SW 92nd Avenue is a minor collector on the city's Transportation Plan Map. It extends from Durham Road to the entrance of Cook Park. South of Kneeland Estates and Tigard High School it serves largely as a dedicated park road. The pavement width is 24 feet within a 50 foot right-of-way. There are streetlights along the roadway but no curbs, sidewalks or storm drains. J. Surrounding Land Uses: Tigard High School and Kneeland Estates Subdivision are north of Cook Park. A dairy farm is immediately east of the park. The Tualatin Country Club is directly south, across the river, from the development site. III. APPLICABLE APPROVAL CRITERIA & DEVELOPMENT STANDARDS A. Chapter 18.50 (R-4.5 zone) Chapter 18.50 of the Community Development Code pertains to development standards that apply to the above zone. A community recreational use is a conditional use within zone. Chapter 18.130 oUbjedte enlargement or alteration of an wasting conditional use to Conditional Use and Site Development Review peoeedures. However, per 18.130.060, this is a minor modification and does not modify the existing use and therefore is subject only to the Planning Director's approval. Sensitive lands review is intended to implement flood plain protection measures and to protect rivers, streams, creeks, steep slopes, by minimizing erosion, protecting bank stability, maintaining and enhancing water quality, fish and wildlife habitat, and preserving scenic quality and recreational potential. Section 18.84.015(A) allows community recreation uses such as parks in areas subject to sensitive lands review. Section 18.84.015(C) requires Hearing Officer approval of land form alterations or development in the 100 year floodplain, 2) Section 18.84.026 requires use of designs, materials, and practices that minimize flood damage and the potential for damage. 3) Sectioa 18.84.040 provides landform alterations subject to sensitive lands review must comply the following criteria. a. Furthermore, work within the river channel and floodway will enhance the function and maintenance of the zero-foot rifle floodway by providing riverbank stabilization and erosion control. 4. Policy 3.5.3 states that where filling and/or development are allowed within or adjacent to the 100 year flood plain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the flood plain. Area within the 100 year flood plain of the Tualatin River involved in this application is already in public ownership for open space and recreational purposes. Therefore, this policy does not apply to the current application. 5. Policy 4.2.1 require e that all development comply with applicable federal, state and regional water quality standards.
