L SUMMARY OF THE REQUEST
The applicant requests approval of a Sensitive Lands Review to redevelop an existing
playground within Cook Park. The work would occur within the 100-year flood plain of
the Tualatin River and would involve landform alterations including addition of 470 cubic
yards of imported sand. The site is outside the zero foot rise floodway. City staff
recommended conditional approval of the request The applicant accepted the condition of
approval. No other person testified.

The site is roughly an oval area about 175 feet by 100 feet

The Site is currently a playground, The eastern portion of the park contains the
playground and picnic area The western portion of the park contains two soccer fields
and two baseball fields, .An access road from SW 92nd Avenue and parking facilities
wind through the center and eastern portions of the park. Approximately 14,5 acres of
the park, along the Tualatin River anclin the southwest corner of the park, are
undeveloped and reniain in their natural heavily wooded state.

D. Proposed uses and structures
The applicant proposes to redevelop the existing play area adjacent to the picnic area.
The City proposes to remove the existing playground equipment from the site to permit
excavation, filling and regrading of the site After excavating, ding and regrading, the
City proposes to encircle the area with about 59O feet of concrete curbing and install
playground equipment. About 770 cubic yards of material will be removed from the
playground area and will be sculpted to form a 2 to 3 foot berm surrounding the play
area. About 470 cubic yards of sand will be imported to provide a soft surface for the
play area. The City also proposes to construct about 225 linear feet of sidewalk from
the west side of the play area to the access road.
E. Existing and proposed vegetation
Scattered trees are located throughout the picnic and play areas of the park. About 14.5
acres of the park, along the Tualatin River and in the southwest corner of the park, are
undeveloped and remain in their natural heavily wooded state. The western portion of
the park has been cleared and developed into soccer and baseball fields. The site plan
calls for preserving and protecting all existing trees and shrubs, with the exception of
one tree which will be removed and another which will be relocated. The applicant will
install an irrigation system and reestablish the lawn surrounding the site.

The site is flat and is in the 100 -year floodplain of the Tualatin River. The floodplain

the adopted pedestrian/bicycle pathway plan.
C. Applicable Comprehensive Plan Policies.
1. Polley 2.1.1 provides the City will assure citizens will be provided an opportunity
to be involved in all phases of the planning process.
2. Policy 3.2.1 provides that the City will prohibit any development within the 100-
year flood plain that would result in any rise in elevation of the 100-year floodplain.
3. Policy 3.2.2 provides that the City prohibit development in the floodway but may
allow development in the floodway if the alteration preserves or enhances the function
and maintenance of the zero-foot rise floodway; Policy 3.2.1 also provides that the
City may allow limited specified development in the floodplain outside the zero-foot
rise floodway.
4. Policy 3.2.3 provides that development is within the 100-year floodplain outside the
zero-foot rise floodway is conditioned upon specified requirements.
5. Policy 3.5.3 provides that the City has designated 100-year flood plains of the
Tualatin River as greenway and that development within the 100-year floodplain shall
be conditioned upon the dedication of sufficient open land area for greenway within the
floodplaim
6. Policy 4.2.1 provides that all development within' the Tigard Urban Planning Area
shall comply with applicolale federal, state and regional water quality standards.

A. Hearing.
The examiner received testimony at the public hearing about this application on July 31,

B. Summary of Testimony.

C. NPO & Agency Comments
2. Ron Bunch represented the City as applicant He said that the proposal was the
first step in a multi-year parks improvement plan. He emphasized that the importation
of the 470 cubic yards to the site was necessary to provide a 12-inch deep soft surface
for the playground area. He said that the zero-foot rise flood ele.vatimpould not be
erosion control plan. He stressed that the City was working within a tight time-frame
and said that site preparation needed to be complete before the scheduled installation
affected by the development. He accepted the condition requiring snErhission of an
date of September 17, 1990.

PART I'- SENSITIVE LANDS APPROVAL PROCESS
A. Sensitive Lands are lands potentially unsuitable for development
because of their location within the 100- year floodplain, within a
natural drainageway, on steep slopes (over 25 %) or on unstable
ground.
B. Except as provided by subsections I. C. and D. below, the following
uses shall be outright permitted uses within sensitive land areas:
1. Accessory uses such as lawns, gardens or play areas;
2. Agricultural uses conducted without locating a structure within
the sensitive land area;
3. Community recreation uses such as bicycle and pedestrian paths
or athletic fields or parks, excluding structures;
4. Public and private conservation areas ±'or water, soil, open
space, forest and wildlife resources;
5. Removal of poison oak, tansy ragwort, blackberry or other
noxious vegetation;
6. Maintenance of floodway, excluding rechanneling; and
7. Fences, except in the floodplain area.
C. The following uses and activities are allowed only by a Sensitive
Lands permit granted by the Hearings Officer:
1. A land for alteration or development within the 100 -year
floodplain;
2. A land form alteration or development on slopes of 25% or

3. The structures are appropriately sited and designed to ensure
structural stability and proper drainage of foundation and
crawl space areas for development; ■-with any of the following
soil conditions „get/high water table; high shrink-swell
capability; compressible/organic; and shallow depth-to-bedrock;
and
4. Where natural vegetation has been removed due to land form
alteration or development, the areas not covered by structures
or impervious surfaces Will be replanted to prevent erosion in
accordance with Section 18.100 (LANDSCAPING AND SCREENING).
C. Drainageways
The Hearings Officer shall make findings that all of the following
criteria are satisfied when approving, approving with conditions or
denying an application request for a Sensitive Lands permit within
drainageways (as described in Section I. C. above):
1. The extent and nature of the proposed land form alteration or
development will not create site disturbances to the extent
greater than that required for the uses;
2. The proposed land form alteration or development will not-
result in erosion, stream sedimentation, ground stability or
other adverse on-site and off-site effects or hazards to life
or PrOPertY;
3. The water floW capacity of the drainageway is not decreased; and
4. Where natural vegetation has been removed due to land form
alteration or the development, , the areas not covered by
stilictdres or impervious surfaces will be replanted to prevent
erosion in accordance With Section 18.100 (LANDSCAPING AND

REQUEST: A request for Sensitive Lands Review approval to allow site
work and equipment installation necessary to redevelop an existing
children's playground at Cook Park. The work would occur within the
100 year flood plain of the Tualatin River and would involve landform
alterations including deposition of approximately 470 cubic Yards of
sand imported to the site to provide the "soft surface" under the play
equipment.
COMPREHENSIVE PLAN DESIGNATION: Low Density Residential
ZONING DESIGNATION: R-4.5 (Residential, 4.6 units/acre).

2. Background Information
The original 36 acres of Cook Park were donated to the city of Tigard
in 1962. An eight-year park development program provided picnic
areas, play equipment ballielda, waterfront facilities, reattoothb
and roads through the patk. Since that time there have been several
land additions to that parks area as well as additional development of
recreational Facilities within the park.
The Tigard Park Plan Wag adopted by the City Council in November,
1081. An individual park plan is provided for Cook Park within the
Tigard Park Plan.

Cook Park is situated at the south end of SW 92nd Avenue, south of the
Tigard High School and the Kneeland Estates Subdivision. A dairy farm
is located immediately east of the park. The Tualatin River forma the
southurn boundary of the park. The Tualatin Country Club, which is
located within the City of Tualatin, is on the opposite side of the
river.
4. Site Information and P;22011_gemalption
Cook Park is characterized by relatively flat terrain throughout the
site, although the banks of the Tualatin River are rather steep. The
entire park is within the flood plain of the Tualatin River. Of the
total park area of 51.06 acres, 14.5 acres are undeveloped and remain
in the natural state. The southeastern portion of the park and all
along the river front is heavily wooded with scattered trees located
throughout the picnic and play areas. Two soccer fields as well as
two baaeball fields are provided along the west side of the access
road. A picnic area and playground is located on the east side of the
access road. A restrooM building and covered picnic area are also
provided in this picnic area.
The City of Tigard proposes redevelopment of the existing play area
adjacent to the picnic area The existing playground equipment will
be removed from the project area One of the swingsets will be
relocated within the newly constructed playground area In order to
accomplish the proposed playground improvements, the City proposed
excavation of approximately 770 cubic yards of material within the
playground containment area This material will then be used to form
2 to 3 foot berms adjacent to the play area. In addition,
approximately 470 cubic yard of sand are proposed to be brought to the
site to form the new surface of the playground area. The sand wil/ be
deposited approximately one foot deep within the excavated area.
Other site improvemento will include installation of an irrigation
system in the Vicinity of the new playground, reestablidhment of lawn
area surrounding the site, construction of 590 linear feet of cast-in-
place concrete curb to form the playground enclosure, and construction
of sidewalks at the west end of the playground enclosdre area
Because the proposed improvements and
associated landform modification
would occur within the 100 year flood plain o1 the Tualatin River, the
city of Tigard requests that Senditive Land d approval be granted. No
conditional Use review of the proposed redevelopment of the playground
is necesSary because the Use is ekisting and the proposed
mod are 'minor in nature and are not antidipated to have any
off-ra•e impact.
5. AdendV and two Comments
the Engindering Department has reviewed the proposal and had offered
the following domens:

a. The proposed project will include localized grading and
deposition of 470 cubic yards of sand within an enclosure.

b. The site is entirely within the flood plain fringe of the
Tualatin River. The flood plain elevation is 126 feet, while
most of the site is below 118 feet. Site grading within the 100
year flood plain is a landform alteation that requires a
sensitive lands permit. The sensitive lands ordinance requires
that the proposed landform alteration "shall preserve or enhance
the ... maintenance of the zero foot-rise floodway and shall not
result in any narrowing of the floodway boundary." The ordinance
further requires that the proposed fill "not result in any
increase in the water surface elevation of the 100 year flood."
Although a zero foot floodway has not been determined in this
area, the proposed grading and other propoeed improvements are
not expected to increase the flood plain elevation because it is
within a fringe area designated as "flood areas from inadequate
drainage." consequently, the requested Sensitive Lands Permit
should be approved.
The Unified Sewerage Agency has reviewed the proposal and has
commented that the project should have little impact upon surface
waters provided that appropriate erosion control measures are employed
until the lawn in this area is re-established.
The Building Division and NPO #6 have reviewed the proposal and have
offered no comments or objections.
No other comments have been received.
B. FINDINGS AND CONCLUSIONS
The purpose OectiOn of Chapter 18.84 of the Community Development Code,
Seneitive Lands, states that sensitive lands are area
potentially
unsuitable for development becauee of the presence of wetlands, steep
slopes, ot drainageWays, or else because of being located Within a 100 year
flood Plain. sensitive land areas are designated as such to protect the
public health, safety and Welfare of the community through the regulation
of uses and adtivitied allowed. In order to protect and enhance the
values of flood plane, the city of Tigard had enacted regulations which
severely limit the activities that can occur within the 100 year flood
plain.

park equipment from the classification of structures. The continued
playground use within Cook Park and the equipment to be provided through
the proposed playground improvement project project are therefore permitted
in the 100 year floodplain lands area adjacent to the Tualatin River.
The proposed playground improvements will require some landform
modifications, although only a small amount of fill material will be
brought to the site from elsewhere. Code Section 18.84.040.A lists the
following criteria for approval of landform modifications within the 100
year flood plain:
1. Landform alterations shall preserve or enhance the floodplain storage
function and maintenance of the zero-foot rise floodway shall not
result in any narrowing of the floodway boundary,
2. Landform alterations or development within the 100-year floodplain
shall be allowed only in areas designated as commercial or industrial
on the comprehensive plan land use map, except that alterations or
developments associated with community recreation uses, utilitieo, or
public support facilities as defined in Chapter 18.42 of the Community
Development Code shall be allowed in areas designated residential
subject to applicable zoning standards;
3. Where a landform alteration or development is permitted to occur
within the floodplain it will not result in any increase in the water
surface elevation Of the 100-year flood;
4. The landform alteration or development plan includes a
pedestrian/bicycle pathway in accordance with the adopted
pedestrian/bicycle pathway plan, unless the construction of said
pathway is deemed by • the Hearings Officer as untimely;
5 The plans for the pedestrian/bicycle pathway indicate that no pathway
will be below the elevation of an average annual flood;
6. The necessary U.S. Army Corps of Engineers and State Of Oregon Land
boatd, Division Of State Lands approv als shall be Obtained; and
Where landform alterations and/or development are allowed within and
adjacent to the 100-year floodplain, the city shall require the
dedication Of bufficient open land area Within and adjacent to the
floodplain in accordance With the comprehensive plan. This area shall
include portions of a suitable elevation for the construction of a
pedestrian/bicycle pathway within the floodplain in accordance with
the adopted pedeettinn/hidydie pathway plan.

foot rise floodway, the floodway boundary should not be affected. Because
no fill material will be imported to the site with the exception of the
sand, the proposed development and landform modifications would not be
anticipated to have an impact on the water surface elevation of the 100-
year flood. The proposal is therefore consistent with approval criteria 1
and 3 above.
The proposed landform modifications would be located in an area designated
on the Comprehensive Plan Land Use Map for residenti I use but the
modifications and development would be associated with a community
recreation use and thus are consistent with approval criterion 2.
Approval criteria 4, 5, 6, and 7 above are not applicable to the current
proposal. Because the proposed work is not within a wetland or within the
river's channel, Corps of Engineers and Division of State Lands permits
are not required. The Tigard Area Comprehensive Pedestrian/BicyclePathway
Plan does not identify the area of the proposed work as the location of a
future pathway segment.
The applicable Community Development Code criteria for app49val of the
proposed laidform modification within the 100-year floodplain of the
Tualatin River necessary for the park improvement project are therefore
satisfied. The proposed landform modifications are consistent with
applicable Comprehensive Plan policies as follows. Other Comprehensive
Plan policies do not apply to the current proposal.
1. Policy 2.1.1 is satisfied because NPO #6 has been informed of the
proposal and has been given an opportunity to comment. In addition,
notice of the public hearing and an opportunity to comment on the
proposal has been sent to nearby property owners and has been
advertised in the Tigard Times.
2. Policy 3.1.1 is satisfied because the proposed landform modifiocation
Would not be located in an identified wetland area or in an area
having other severe development limitations identified in the Plan.
J. policies 3.2.1, 3.2.2 and 3.2.3 are satisfied because the proposed
Minor landform modification and development is located oetdide of What
would appear to be the zero-foot rise floodway and as such the streath
flow capacity of the iloodWay would be maintained. The landform
alteration is minor in character and Would involve no iMporting of
fill Matetial other than the relatively small amount of sand that will

5. Policy 4.2.1 requires that all development comply with applicable
federal, state and regional water duality standards. The applicant
will be required to submit an erosion control plan guaranteeing
compliance with the interim erosion control standards for the Tualatin
River basin as a part of the grading permit application.
C. CONCLUSION AND RECOMMENDATION
The Planning Division finds that the City of Tigard's proposed landform
modifications related to playground improvements in Cook Park is consistent
with the applicable Community Development Code appro' 1 criteria and
Comprehensive Plan policies as described above. The Planning Division
therefore recommends APPROVAL of Sensitive Lands application SLR 90-0007.
Approval should be subject to the following conditions:
THE FOLLOWING CONDITIONS SHALL 133 SATISFIED PRIOR TO ISSUANCE OF A GRADING
AND SITEWORK PERMIT:
1. An erosion control plan shall be provided as part of the building
permit submittal. The plan shall conform to "Erosion Control Flans-

Cook Park.
ELTILEIls:
1. The proposed project will include localized grading and 470 cubic yards of
sand Within an endlbsdre.
2. The bite id entirely within the flood plain fringe of the Tualatin RiVer.
The flood plain elevation is 126 feet, while most of the site ie below 118
feet. Site grading within the 100 year flood plain is land form alteration
that requires a sensitive lands perthit. The sensitive lands ordinance
requires that the proposed land form alteration "shall preserve or enhance
the maintenance of the Zero foot-rise flOOdWay and shall not result in
any narrowing of the floodway boUnddry." The ordinance further requires
that the proposed fill can "not result in any increase in the water surface
elevation of the 100 year fidod." Although a zero foot floodway had not
been determined in this area, the proposed grading and other proposed
improvements is not expected to increase the flood plain elevation because
it is within a fringe area designated as "flood areas from inadequate
dkninngeo" Consequently, the requested sensitive Lands Permit Should be
approved.
Recommendation: The Engineering Department had no objection to the proposal.

This project involves site work and equip } nt installation necessary to develop
a new childrens' playground at Cook Park. The following outlines in detail the
construction activity necessary to complete this project.
DEMOLITION:
Old Playground equipment will be removed from the project area and stored
elsewhere on the site to be removed by the City of Tigard. One of the older
swing set will be relocated in the new playground area.
SITE WORK:
This element will consist of:
1) Excavation of approx 770 cubic yards of material within the playground
containment area This material will be used to form two to three foot
berms adjacent to the play area
5510 linear feet s Of cast in place concrete curb to form the playground
enclosure.
1145 square feet of concrete w•= lks built around the playground enclosure
Urea.
4) !''"_+w automatic irrigation system in the vicinity of the new playground.
5) Reestablishment of new lawn area of approximately 14,050 square feet.
6) Two paved walkways of 1,320 20 and 720 square feet respectively Will also
be bid as alternates ad part of this projects
7) The playground enclosure area will be filled with approximately 470
cubic yards of beach sand.
