SENSITIVE LAND REVIEW - SLR 90-0006
POLLOCK
APPLICATION: A request by Douglas Pollock (Northland Homes - Donald Pollock,
property owner) for Sensitive Lands approval to allow installation of a 35 foot
long, 42 inch diameter corrugated metal pipe in the Red Rock Creek
drainageway adjacent to SW6Sth Parkway. In addition, the applicant requests
permission to place approximately 2,000 cubic yards of fill material over the
drainage ripe. Location: 10995 SW 68th Parkway (WCTM 1S1 36DA, Tax Lot 200) .
Zoning: C-G (General Commercial).
DECISION: Notice is hereby given that the Planning Director's designee for
the City of Tigard has APPROVED the above request subject to certain
conditions. The f indings and conclusions on which the decision was based are
noted below:
FINDING OF FACT
1. Background
No previous land use or development actions regarding this
property have been reviewed by the City of Tigard.
2. Vicinity Information
Properties adjacent to this site are zoned C-G (General
Commercial) to the west and north. Properties zoned C -P
(Professional Commercial) are located to the south and east. The
parcel directly east and south of the subject property has
recently been developed with an office building for the Key
Pacific Bank. The property directly west of the site and across
SW 68th Parkway is currently vacant. Parcels to the north
include a variety of commercial uses including a motel,
restaurant, and service station which all front on SW Pacific
Highway.
SW 68th Parkway forms the western boundary of the site. SW 68th
Parkway is a fully developed street which is classified as a
major collector street by the City's Transportation Plan Map.
Red Rock Creek pa;.ses under SW 68th Parkway in a 42 inch
diameter drainage pipe.
3. Site Information and Proposal Description
The vacant 2.52 acre parcel has approximately 660 feet of
frontage on SW 68th Parkway and is approximately 150 feet deep.
Red Rock Creek bisects the parcel in its approximate center. The
parcel i._: covered with brush and a number of trees, although no
trees are located in the area proposed for filling.
The applicant requests Sensitive Lands approval to extend the
existing 42 inch culvert under SW 68th Parkway 35 feet to the

east. The applicant proposes to place approximately 2,000 cubic
yards of fill material within the drainageway above the culvert.
Work on this project is tentatively scheduled to occur in July,
1990. The application does not include any plans for development
of this site.
4. Agency and NPO Comments
The Engineering Department has the following commentss
. The existing culvert was constructed by the local
improvement district formed to construct SW 68th Parkway.
The street is fully improved but without a driveway to the
site.
2. The applicant has obtained a permit from the U. S. Corps of
Engineers to place a fill within a state waterway, as
required by Section 404, Clean Water Act, and ORS 541.605
681.695.
3. The U.S Corps of Engineers is currently preparing a
hydrologic model of Red Rock.Creek that will delineate the
100-year floodplain. Once this floodplain ie adopted by the
Federal Emergency Management Agency, any development of the
lot must comply with the City's ?Sensitive Lands Ordinance
requirements related to floodplain areas if portions of the
site are found to be within the 100 -year floodplain.
4. The proposed culvert extension will become a public facility
requiring it to be constructed to public standards and
dedicated to the City.
The Building Division has reviewed the proposal and has commented
that a fill permit must be obtained. In addition, an erosion
control plan must be provided. The plan shall conform to
"Erosion Control Plans - Technical Guidance Handbook, November,
1989°' available from the Building Division.
NPO #4, Metzger Water District, POE, and the Tualatin Valley Fire
and Rescue District have reviewed the proposal and have offered .
no comments or objections.
No other comments have been received.
B. ANALYSIS AND CONCLUSION
Community Development Code Section 18.84.015.0 requires that landform
alterations or development within a drainageway not within a 100 year
floodplain area be reviewed by the Planning Division subject to the
approval criteria for a Sensitive Lands permit. Code Section
18.84.040.0 contains the following criteria whereby the Director shall
make findings when reviewing an application to approve a landform
alteration or development within a drainageway:
LEGIBILITY STR
a. The extent and nature of the proposed land form alteration or
development will not create site disturbances to an extent
greater than that required for the use;
b. The proposed land form alteration or developm nt will not result
in erosion, stream sedimentation, ground instability, or other
adverse on -site and off -site effects or hazards to life or
property;
c. The water flow capacity of the drainageway is not decreased;
d. Where natural vegetation has been removed due to land form
alteration or development, the areas not covered by structures or
impervious surfaces will be replanted to prevent erosion in
accordance with Chapter 18.100, Landscaping and Screening,
e. The drainageway will be replaced by a public facility of adequate
size to accommodate maximum flow in accordance with the adopted
1981 Master Drainage Plan;
f. The necessary U.S. Army Corps of Engineers and State of Oregon
Land Board, Division of State Lands approvals shall be obtained;
Where land form alterations and /or development are allowed within
and adjacent to the 100 -year flood plain, the City shall require
the dedication of sufficient open land area within and adjacent
to the flood plain in accordance with the Comprehensive Plan.
This area shall include portions of a suitable elevation for the .
construction of a pedestrian /bicycle pathway within the flood
plain in accordance with the adopted pedestrian bicycle pathway
plan.
The extent and nature of the proposed landform alteration necessary
for installing the storm drain line and fill will not create site
disturbances greater than are necessary for construction. No other
site area is proposed to be disturbed. No mature trees are located in
the area proposed for fill. The applicant has noted that the upstream
end of the fill will be riprapped. The surface of the fill is
required to be revegetated as a condition of approval of the DSL /Corps
of Engineers permit. The applicant has also noted that construction
is planned for the anticipated dry season during the summer of 1990
Therefore, the proposed project should not result in undue erosion or
stream sedimentation.
Because the proposed drainage culvert will connect to an existing
culvert of the same size, the water flaw capacity of this section of
Red Rock Creek should not be affected by the proposed filling of this
section of the drainageway and placement of the drainage pipe. In
order to assure the long -term maintenance of the drainageway, the
culvert will be required to be constructed to City of Tigard
construction standards and a utility easement including the culvert
shall be dedicated to the City.
Necessary T.B. Army Corps of Engineers and Oregon Division of State
Lands approvals have already been obtained (DSL fill permit 5564,
dated April 4, 1990).
The proposed drainageway modification is not within a designated 100
year floodplain; therefore, dedication of land for flood protection,
greenway, and recreational purposes is not required.
The applicable Sensitive Lands approval criteria are therefore
satisfied.
C. DECISION
The Planning Director's designee approves Sensitive Lands request SL
90 -0006 subject to the following conditions:
THE FOLLOWING CONDITIONS. SHALL BE SATISFIED PRIOR TO ISSUANCE OF
SITE WORK AND FILL PERMITS.
1. Two (2) sets of detailed public improvement plans and profile
construction drawings shall be submitted for preliminary review
to the Engineering Division. Five (5) sets of approved drawings
and one (1) itemized construction cost estimate, all prepared by
a Professional Engineer, shall be submitted for final review and
approval (NOTE: these plans are in addition to any drawings
required by the Building Division and should only include sheets
relevant to public improvements. STAFF CONTACT: John Hagman,

2. The public improvement plans shall include a driveway that will
provide access for construction equipment and prevent soil from
entering the street. STAFF CONTACT: John Hagman, Engineering

3. An agreement shall be executed by the applicant, on forms
provided by the City, that provides a public utility easement, 20
feet in width, for the entire culvert within the site parcel.

4. Building permits wile not be issued and construction of proposed
public improvements shall not commence until after the
Engineering Division has reviewed and approved the public
improvement plans and a street opening permit or construction
compliance agreement has been executed. A 100 percent
performance assurance or letter of commitment, a developer.
engineer agreement, the payment of a permit fee and a sign

5. An erosion control plan shall be provided as part of the Fill
Permit. The plan shall conform to "Erosion Control Plans-

The L.pplicaht proposes to extend an existing. 42 -inch culvert 35 feet and place
a fill in Redrock Creek at SW 68th Parkway.
Findings:
1. The existing culvert was constructed by the Local Improvement District
formed to construct SW 68th Parkway. The street is fully improved but
without a driveway to the site
The applicant has obtained a permit from the U. S. Corps of Engineers to
place a fill within a state waterway as required by Section 404, Clean
Water Act, and ORS 541.605 - 641.695.
3. The U.S. Corps of Engineers is currently preparing a hydrologic model of
Redrock Creek that will delineate the 100 -year floodplain. Once this
floodplain is adopted by the Federal Emergency Management Agency, any
development of the lot must comply with the City's Sensitive Lands
Ordinance.
4. The proposed culvert extension will become a public facility requiring it
to be constructed to public standards and dedicated to the City.
Recommendations
1. Two (2) sets of detailed public improvement plans and profile construction
drawings shall be submitted for preliminary review to the Engineering
Division. Five (5) sets of approved drawings and one (1) itemized
construction cost estimate, all prepared by a Professional Engineer, shall
be submitted for final review and approval (NOTE: these plans are in
addition to any drawings required by the Building Division and should only

1. This permit does not authorize trespass on the lands of others. The permit
holder shall obtain all necessary access permits or rights- of-way before entering
lands owned by another.
2. This permit does not authorize any work that is not in compliance with local
zoning or other local, state, or federal regulation pertaining to the operations
authorized by this permit. The permit holder is responsible for obtaining the
necessary approvals and permits before proceeding under this permit.
3. All work done under this permit must comply with Oregon Administrative Rules,
Chapter 340; Standards of Quality for Public Waters of Oregon. Specific water
quality provisions for this project are set forth on Attachment A.
4. Violations of the terms and conditions of this permit are subject to
administrative and /or legal action which may result in revocation of the permit
or damages. The permit holder is responsible for the activities of all
contractors or other operators involved in work done at the site or under this
permit.
5. A copy of the permit shall be available at the work site whenever operations
authorized by the permit are being conducted.
6. Employees of the Division of State Lands and all duly authorized representatives
of the Director shall be permitted access to the project area at all reasonable
times for the purpose of inspecting work performed under this permit.
7. Any permit holder who objects to the conditions of this permit may request a
hearing from the Director, in writing, within 10 days of the date this permit was
issued.
NOTICE: If removal is from state -owned submerged and submersible land, the applicant
mum comply with leasing and royalty provisions of ORS 274.530. If the project
involves creation of new lands by filling on state -owned submerged or submersible
lands, you must comply with ORS 274.905 - 274.940 This permit does not relieve the
permittee of an obligation to secure appropriate leases from the Division of State
Lands, to conduct activities on state -owned submerged or submersible lands. Failure
to comply with these requirements may result in civil or criminal l i abi l i ty. For

ATTACHMENT A
Special Conditions for Material Fill Permit No. 5564
1. permit authorizes the placement of up to 2,006 cubic yards of
material in Section 36, T1 5S, R1 V1 (Red Rock Creek) to extend a culvert
for access purposes as outlined In the attached permit application, map
and drawings.
2. Work in the waterway shall be done so as to minimize turbidity increases
in the water that would degrade water duality and damage aquatic life.
Turbidity shall not exceed 10% above natural stream turbi di ties, except
as allowed by OAR 340-41.
3. Care shall be taken to prevent any petroleum products, chemicals, or
other deleterious materials from entering the, water.
Waste materials and spoils shall be placed above the bankline and not in
any wetland areas.
5. There shall be no operation of equipment in the active flowing stream
between October 1 and June 1
6e Riprap shall be placed on the face of the fill under these conditions:
a. Only clean, erosion resistant rock from an upland source shall be
used as riprap. No broken concrete or asphalt shall be used.
b. All riprap rock shall be placed from above the bankline.
c. The completed revetment shall have a slope no flatter than 2:1
7. Removal of existing woody vegetation shall be minimal. There shall be no
removal of woody, vegetation upstream of the 35 foot culvert extension.
Native tree species (alder, ash or red cedar) shall be planted on the
south bank, upstream from the culvert on 10 foot centers to property
boundary.
8. Areas of streambank disturbance not covered by riprap shall be seeded or
planted with grass and/or legumes, shrubs and trees.
The culvert shall be placed in a manner that will not change the existing
streambed gradient.
10. The issuance of this permit is conditional upon obtaining the required
approvals from the City of Tigard.
11. The Division of State Lands retains the authority to temporarily halt or
modify the project in case of excessive turbidity or damage to natural
resources.

The applicant proposes to construct an engineered fill in Redrock Creek,
Existing 42 —inch and 24—inch culverts under SW 68th Avenue Parkway will be
extended beyond the fill. The fill will be surfaced with gravel,

permit is required A search of the file for the Local Improvement

a permit for the existing roadway. The applicant believes that the
proposed fill area is not wetlands, but the average annual flow of the
creek is unknown
Fills in waters of the state in excess of 50 cubic yards require a permit
from the Division of State Lands, This permit is administered by the COE
along with the Section 404 permit.
The City will require a Sensitive Lands Permit since the fill is to be
placed in a drainageway. The permit will require the applicant to show
that the proposed 42 —inch culvert has adequate capacity to convey the 25
year storm. The file for the roadway project does not appear to contain
this information.
5. The COE is currently preparing a hydrologic model of Redrock Creek that
will delineate th41 100 —year floodplain, Once this floodplain is adopted
by the Federal Emergency Management Agency, any development of the lot
must comply with the floodplain portion of the Sensitive Lands Ordinance,
6. The parcel to the east is currently being developed. Storm drainage
design should account for the changed drainage pattern caused by the
development.
7. The proposed 42 —inch culvert should be constructed-to City standards and
dedicated to the City. Construction drawings, as part of the fill permit,
should be submitted to the Engineering Division for approval.
