RE Final Inspection A. 'royal, BUP2007- 00287, Deck
Thank you for your voluntary cooperation in bringing the free - standing deck on your
property under permit and into compliance.
Enclosed is a copy for your files and records of the issued permit and of our inspection
report granting final inspection approval.
As we have discussed and as I have noted on the permit record and the final inspection
report, the deck is not attached to the house in any way and is, therefore, considered to be an
accessory structure. Because your lot is in an R-7 zone accessory structures are subject to a
requirement for a five (5) foot setback from the rear property line whereas the house itself
and any structures attached directly to it are subject to a fifteen (15) foot setback It is
important, therefore, that the deck remain unattached. If it were to become attached,
whether directly or indirectly by being attached to some additional structure that was itself
attached to the house, the fifteen foot setback requirement would apply, the construction
and inspection approvals under this permit would no longer apply, and the then attached
deck would be in violation of both building code and zoning regulation requirements.
As we have also discussed, your Homeowners Association has its own set of Codes,
Covenants, and Restrictions (CC&Rs.) .) The City does not enforce or interpret CC&Rs and
our issuing a building permit and granting final inspection approval does not constitute or
im ply compliance with any applicable CC&Rs. We urge you to work with your
Homeowners Association to resolve any issues that may exist in that regard.
